WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County, o°o z m
Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited m o<
to the staff report, has made the following determinations: 'm m

1. SAB Capital LLC, applied for a Variance from the provisions of St. Lucie County Land g °
Development Code Section 7.04.01, Table 7-10, to permit construction of a single-family m
dwelling on a +/-9,825 sq. ft. lot located in the RS-4 (Residential, Single-Family - 4)

Zoning District, which requires a minimum 10,000 sq. ft. area for lots served by a well. 7J 0

2. On January 28, 2026, this Board held a public hearing on the petition, after publishing a 0
notice of such hearing, installing a sign on the property, and notifying by mail all owners
of property within 500 feet of the subject property.
3. After consideration of the testimony presented during the public hearing, including that of
the petitioner, staff comments, exhibits, and the standards of review for granting
variances set out in Section 10.01.02, St. Lucie County Land Development Code, the
Board of Adjustment has made the following acknowledgements and determinations:
The applicant was unaware of the lot area deficiency prior to purchasing the property
and had previously built a residence on one of the lots in this community.
The variance request arises from unique land conditions that create a hardship for the
current owner wherein Lot 9, the subject lot, is not a nonconforming lot of record, per
County records dated July 1, 1984 due to contiguous ownership with the parcel to the
east, and together formed a conforming parcel.
Had the two contiguous lots not been in the same ownership, they would have both been
buildable. Moreover, a variance was previously granted for the relief now requested.
The variance is the minimum necessary to make reasonable use of the property, by
allowing a single-family home to be permitted, within the RS-4, Single-family-4 Zoning
District.
The other prerequisites to granting a variance have been met.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:

A. The petition of SAB Capital LLC, requesting a variance from Section 7.04.01 (Table 7-
10) — Lot Size and Dimensional Requirements of the St. Lucie County Land
Development Code to allow for a single-family home on a +/-9,825 sq. ft. lot that does
not meet the minimum 10,000 sq. ft. land area requirement for lots served by a well for
the property depicted on the boundary survey created by Triangle Land Surveying, Inc.
dated June 25, 2025, and included as Exhibit "A" and described in Part "B" below, is
hereby approved subject to the following conditions:
1. The single-family home shall connect to central water services when made available
through the St. Lucie County Utilities Department.
2. The current and future owners and their heirs/assigns agree to participate and shall
be a "yes" vote in any lawfully established MSTU, MSBU or other special
assessment district created for the purpose of establishing central water services to
Salerno Road.
B. The petition site is described and located as follows:
Legal: LOT 9, BLOCK 123, LAKEWOOD PARK - UNIT 10, AS PER PLAT THEREOF,
AS RECORDED IN PLAT BOOK 11, PAGES 29A THROUGH 29D, OF THE
PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

C. This Order shall become effective upon the date indicated below. An appeal from the
Board of Adjustment's action may be processed within thirty (30) days following the
rendition of the decision of this order in accordance with Section 10.01.07, of the St.
Lucie County Land Development Code.
D. This Order shall be recorded in the public records of St. Lucie County.
