INTO THE 50 FT. MINIMUM FRONT YARD SETBACK FOR AN OVERALL SETBACK OF 10 FT., FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County, Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Louis and Joyce Cevetello petitioned for a variance to allow deviations from the following sections of the St. Lucie County Land Development Code, Section 7.04.01 (Table 7-10) - Lot Size and Dimensional Requirements for a proposed detached garage to encroach 40 feet into the required 50-foot front yard setback (providing a front setback of 10 feet, for property located at 3519 Sunrise Blvd. within the AR-1 Agricultural, Residential -1 Zoning District, as described in Paragraph B below. 2. After publication of a notice of such hearing, installation of a sign on the property, and notification by mail to all owners of property within 500 feet of the subject property, this Board held a public hearing on February 25, 2026. 3. After consideration of the testimony presented during the public hearing, including that of the petitioner, staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The front setback variance request arises from conditions that are unique and peculiar to the land, structures and/or physical surroundings involved, including to its flag lot configuration. The flag shaped lot results in the applicant's "front" yard facing the neighbor's rear yard to the east, unlike typical lots with more road frontage or a more uniform width that have rear yards that back up to each other with more consistent shared side property lines. As testified by the applicant, the yard contains native and ornamental landscaping, a central sprinkler system, septic tank with drain field, and a buried propane storage tank, which influence siting, and does appear to be the minimum variance that will make possible the reasonable use of the land, building, or structures. Additionally, the placement of the detached garage at the proposed location is stated to avoid the removal of approximately seven native trees. Moreover, granting the variance will not impair or injure other property or improvements in the neighborhood. The Petition of Louis and Joyce Cevetello, requesting variance from Section 7.04.01 (Table 7-10) - Lot Size and Dimensional Requirements of the St. Lucie County Land Development Code to allow a detached garage to encroach 40 feet into the required 50- foot front yard setback (providing a front setback of 10 feet) for the property described in Part B below, and as depicted on the boundary survey created by Andrew Snyder Professional Surveyor and Mapper, dated December 29, 2009, attached herein as Exhibit "A" is approved as requested.
