LUCIE COUNTY, FLORIDA, AMENDING THE COMPREHENSIVE PLAN FUTURE LAND USE MAP FOR +/-159 ACRES FROM RS (RESIDENTIAL SUBURBAN) AND SD (SPECIAL DISTRICT)TO MXD (MIXED-USE DEVELOPMENT)AND ESTABLISHING MXD SPECIFIC USE SUB-AREA POLICIES TO PERMIT INDUSTRIAL AND LIMITED COMMERCIAL USES; PROVIDING FOR FINDINGS, PROVIDING FOR CONFLICTING PROVISIONS, PROVIDING FOR SEVERABILITY, PROVIDING FOR APPLICABILITY, PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE, PROVIDING FOR CODIFICATION, PROVIDING FOR AN EFFECTIVE DATE, AND PROVIDING FOR ADOPTION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. On January 9, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Comprehensive Plan. 2. The Board of County Commissioners of St. Lucie as the governing body of St. Lucie County having jurisdiction over this application pursuant to Chapter 163, Florida Statues, is authorized and empowered to consider amendment to the adopted Comprehensive Plan of St. Lucie County. 3. On December 18, 2025, the St. Lucie County Planning and Zoning Commission acting as the Local Planning Agency, opened a public hearing, of which due notice was published in the St. Lucie News Tribune, allowed all interested members of the public to be heard, and continued the public hearing toits meeting on January 15, 2026 . 4. On January 15, 2026, the St. Lucie County Planning and Zoning Commission acting as the Local Planning Agency held a public hearing, of which due notice was published in the St. Lucie News Tribune, and recommended approval of the proposed amendment to the Board of County Commissioners. 5. On February 3, 2026, the Board of County Commissioners of St. Lucie County, Florida held a public hearing, of which due notice was published in the St. Lucie News Tribune and voted to approve the transmittal of the petitioned amendment to the State Land Planning Agency within the Florida Department of Commerce. 6. On April 21, 2026, the Board of County Commissioners of St. Lucie County, Florida held a public hearing, of which due notice was placed in the St. Lucie News Tribune and voted to approve the amendment of the Future Land Use Map of the St. Lucie County Comprehensive Plan. NOW,THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: Ordinance 2026-12 Page 1 of 10 A. ADOPTION OF THE AMENDMENT The Board of County Commissioners does hereby adopt the amendment to the Future Land Use Map of the St. Lucie County Comprehensive Plan, attached herein as Exhibit A. B. CHANGES TO THE COMPREHENSIVE PLAN The Board of County Commissioners does hereby state its intention to: 1. Amend the St. Lucie County Comprehensive Plan Future Land Use Map to change the future land use designation from RS (Residential Suburban) and SD (Special District) to MXD (Mixed Use Development) on approximately 159 acres more particularly described in the Legal Description attached herein as Exhibit B. 2. Amend the St. Lucie County Comprehensive Plan Future Land Use Map to establish the Pruitt Commerce Center Specific Use Activity Sub-Area policies as set forth in Exhibit C. C. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with the Ordinance are hereby superseded by this Ordinance to the extent of such conflict. D. SEVERABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable for any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstances. E. APPLICABILITY OF ORDINANCE This Ordinance shall be applicable as stated in Paragraph A and B. F. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of the Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. G. FILING WITH THE STATE LAND PLANNING AGENCY The Planning and Development Services Director shall send a certified copy of the Ordinance to the State Land Planning Agency within Florida Commerce, 107 East Madison Street, Caldwell Building, Tallahassee, Florida 32399-4120. H. EFFECTIVE DATE The effective date of this plan amendment, if the amendment is not timely challenged, shall be 31 days after the State Land Planning Agency notifies the County that the plan amendment package is complete. If the Ordinance is challenged within thirty (30) days after adoption, the Ordinance shall not be effective until the State Land Planning Agency or Administration Commission respectively enters a final order finding the adopted amendment in compliance in accordance with Section 163.3184(10), Florida Statutes. I. CODIFICATION This Ordinance, upon its effective date, shall be codified by incorporating any contained changes into the St. Lucie County Comprehensive Plan. J. ADOPTION. Ordinance No.2026-12 Page 8 of 10 Ordinance 2026-12 Exhibit C Pruitt Commerce Center Mixed Use Activity Area Plan Sub- Area Policies 1. Intent and Uses. The Pruitt Commerce Center Mixed Use Activity Area Plan is intended for planned non-residential development of superior quality, primarily designed to accommodate and promote targeted industries and employment generating uses. The following policies shall govern the Pruitt Commerce Center Mixed Use Specific Use Activity Area Plan. 2. PNRD Zoning. All development within the Pruitt Commerce Center shall be reviewed and approved through the Planned Nonresidential Development Plan (PNRD) process. 3. Transportation Concurrency. The development of Pruitt Commerce Center shall be subject to the County's transportation concurrency requirements and shall provide sufficient access, capacity, circulation and connectivity needed by the development. Traffic generated by the development that exceeds adopted level of service standards, as indicated in the Transportation Element of the County Comprehensive Plan, shall be mitigated by the development through a schedule of committed roadway construction projects, payments or legally available alternatives. The timing and sequence of any such construction, payments or alternatives shall be tied to specific development thresholds and determined during the PNRD review process. a. Transportation impacts associated with the development of Pruitt Commerce Center shall be evaluated during the PNRD review process in accordance with the County's transportation concurrency requirements. Transportation Impact Reports shall evaluate reasonable transportation improvements necessary to maintain adopted level-of-service standards, including consideration of roadway connectivity and circulation within the surrounding transportation network, which may include, as appropriate, roadway segments such as Graham Road, Picos Road and Rock Road. The determination of whether transportation improvements, payments, or legally available alternatives are required, and the timing, sequencing, and any proportional responsibility for such measures, shall be made during the PNRD approval process based on the findings of the Transportation Impact Reports, and in accordance with applicable state law, the County's transportation concurrency requirements, as set forth in the County Land Development Code and Comprehensive Plan, and the standards of review applicable to Site Plans. Prior to final PNRD site plan approval for any phase or portion of the Pruitt Commerce Center, the applicant shall provide legally sufficient and enforceable assurances, in a form acceptable to the County Attorney, to address transportation concurrency and any such transportation improvements, payments or legally available alternatives required for such phase or portion in accordance with the foregoing paragraph. b. In coordination with the St. Lucie County Area Regional Transit, the Pruitt Commerce Center MXD Specific Use Activity Area shall identify the potential location(s) of future transit stops to serve the subject site and shall provide for internal connectivity for pedestrian and bicycle travel. Ordinance No.2026-12 Page 9 of 10 4. Pruitt Commerce Center MXD Specific Use Activity Area Development Standards: a. Notwithstanding Comp. Plan Policy 1.1.8.4, the maximum Floor Area Ratio (FAR) is 0.35. b. The maximum coverage by buildings shall be 35%. c. Minimum open space shall be no less than twenty-five percent (25%). d.
