A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA,
REPEALING AND REPLACING RESOLUTION NO. 10-060 AND
CLARIFYING THE DIRECTIVE FOR EXPEDITED REVIEW OF
BUILDING PERMIT APPLICATIONS FOR AFFORDABLE
HOUSING PROJECTS; PROVIDING FOR DOCUMENTATION
STANDARDS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,on March 9, 2010,the Board of County Commissioners adopted Resolution
No. 10-060 directing the St. Lucie County Building Official to expedite the review of all building
permit applications for affordable housing projects receiving grant funds through St.Lucie County;
and
WHEREAS,the Affordable Housing Advisory Committee(AHAC),established pursuant
to Section 420.9076, Florida Statutes, is charged with reviewing County policies, procedures,
ordinances,land development regulations,and the Comprehensive Plan to recommend actions that
encourage or facilitate affordable housing; and
WHEREAS, the AHAC has recommended that Resolution No. 10-060 be amended to
clarify the eligibility for expedited building permit review to include projects that either receive
County grant funding or otherwise demonstrate,through objective documentation,that the project
includes affordability or income-restriction requirements;and
WHEREAS, pursuant to Sections 420.9071 and 420.9076, Florida Statutes, each local
government that receives State Housing Initiatives Partnership (SHIP) Program funds, as a
condition of participation in the program, must expedite the processing of building permits and
development orders for housing developments subject to affordability or income-restriction
requirements,to a greater degree than other development projects;and
WHEREAS,the Florida Legislature enacted the Live Local Act(Senate Bill 102 in 2023),
which amended various provisions of Chapter 420,Florida Statutes,to strengthen the state housing
strategy and emphasize the role of local governments in reducing regulatory barriers to housing
development, including using streamlined and expedited permitting and development review
processes;and
WHEREAS, the Board finds that clarifying and strengthening this directive will further
support affordable housing development within St. Lucie County and is consistent with the
County's efforts to reduce barriers and improve development timelines for income-restricted
housing.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St.Lucie County,Florida,that:
Section 1.Recitals.
The foregoing recitals are true and correct and are incorporated herein by reference.

Section 2. Expedited Review.
The St. Lucie County Building Official, in coordination with all relevant County Departments, is
hereby directed to expedite the review of all building permit applications for projects that (a)
receive grant funds administered by or through St. Lucie County for housing purposes, or (b)
otherwise provide housing subject to affordability or income -restriction requirements, as
demonstrated through regulatory agreements, land use restrictions, deed restrictions, funding
award letters, or other documentation confirming restricted rents or sales prices and applicable
income thresholds as determined by the County Administrator or his or her designee.
For purposes of determining eligibility for expedited review, such affordability or income restriction
requirements may be demonstrated prior to issuance of a building permit through regulatory
agreements, land use restrictions, funding award letters, or other documentation acceptable to the
County Administrator or his or her designee.
Any required affordability or income restriction instruments, including deed restrictions or regulatory
agreements, shall be recorded in the public records of St. Lucie County prior to issuance of a
Certificate of Occupancy.
Recording of such instruments shall be a condition of issuance of a Certificate of Occupancy.
For purposes of this Resolution, the term "expedite" shall mean prioritizing qualifying applications
in the review process and advancing them ahead of non -qualifying applications to the maximum
extent practicable, including concurrent or parallel review where feasible.
Section 3. Effective Date.
This Resolution shall take effect immediately upon adoption.
