HomeMy WebLinkAbout26-082 RESOLUTION NO. 2026-082 File No.: RPW-2601-000001 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Steve Brickley of Brickley Land Surveying, Inc., on behalf of Scott and Jessice Mosher, submitted a waiver request regarding the fair share contribution requirements for the proposed development located at 3201 Linda Vista Avenue, between Linda Vista Avenue and South 21st Street and approximately 900 ft. south of Edwards Road. 2 The applicant desires to subdivide (replat) a 1.25-acre parcel into five (5) lots, three (3) of which will have access from Linda Vista Ave. and two (2) via 21st St. which are unpaved. A proposed site plan has been reviewed by the Development Review Committee (DRC) and deemed appropriate for continued processing towards a site plan approval, generally as exhibited in Exhibit B, below, proposing to subdivide into five (5) lots, each with a minimum of 8,000 sq. ft. (0.18 acre) in size. 3. Staff has performed a detailed analysis of the project and determined it to not be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Public Works Memorandum titled "Paving Waiver Request—Proposed Linda Vista Trails Subdivision, dated April 20, 2026. 4. On May 5, 2026, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners approved the requested Paving Waiver and elected to waive the fair share contribution based on the minimum traffic impacts generated by the proposed development subject to the following condition: 1. The current and future owners and their heirs/assigns agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Linda Vista Ave. and 21st St. adjacent to the project's respective frontage. The property for which this paving waiver is approved is located as displayed in Exhibit A, below, and described as follows: LEGAL DESCRIPTION LOT 23, LESS THE SOUTH 25.6 FEET; LOT 17, LESS THE NORTH 1/2 OF SAID LOT; AND ALL OF LOTS 18, 19, 20, 21 AND 22, BLOCK C, MARAVILLA HEIGHTS, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 1 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING +/- 54,670 SQUARE FEET, 1.25 ACRES, MORE OR LESS. ADDRESS: 3201 Linda Vista Avenue, Fort Pierce, FL 34982 PARCEL I.D. NO(s).: 2428-601-0146-000-0 C. A copy of this Order shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
