LUCIE COUNTY TO AMEND THE ADOPTED COMPREHENSIVE PLAN FUTURE LAND USE MAP FOR +/-75.97 ACRES BOUNDED BY KINGS HIGHWAY ON THE WEST AND COPENHAVER ROAD TO THE EAST, APPROXIMATELY 600 FEET NORTH OF PICOS ROAD FROM COM (COMMERCIAL) AND RU (RESIDENTIAL, URBAN) TO MXD (MIXED USE DEVELOPMENT), WITH SPECIFIC SUB AREA POLICIES, LOCATED IN UNINCORPORATED ST. LUCIE COUNTY, FLORIDA; PROVIDING FINDINGS; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF COMMERCE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR ADOPTION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. On January 9, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Comprehensive Plan. 2. The Board of County Commissioners of St. Lucie as the governing body of St. Lucie County having jurisdiction over this application pursuant to Chapter 163, Florida Statutes, is authorized and empowered to consider amendment to the adopted Comprehensive Plan of St. Lucie County. 3. On December 18, 2025, the St. Lucie County Planning and Zoning Commission acting as the Local Planning Agency held a public hearing, of which due notice was published in the St. Lucie News Tribune, and recommended approval of the proposed amendment to the Board of County Commissioners. 4. On January 13, 2026, the Board of County Commissioners of St. Lucie County, Florida held the required public hearing, of which due notice was placed in the St. Lucie News Tribune and approved transmittal of the amendment to the Florida Department of Commerce for agency review; and 5. On February 19, 2026, the Florida Department of Commerce provided correspondence on the transmitted amendment indicating there were no comments from this state agency, other state agencies, and local jurisdictions; and Ordinance No. 2026-7 File No.: FLUMA-2308-000025 Page 2 6. On April 7, 2026, the Board of County Commissioners convened the duly noticed public hearing on the proposed Comprehensive Plan Future Land Use Map Amendment and, at the request of the applicant, voted to continue the hearing until their May 19, 2026 Meeting. 7. On May 19, 2026, the Board of County Commissioners reconvened the public hearing, of which additional courtesy notice was provided via mail to owners of property within 500ft. of the affected land, and deemed the adoption of the amendments to the Comprehensive Plan to be in the best interests of the citizens and residents of the County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: A. ADOPTION OF THE AMENDMENT The Board of County Commissioners does hereby adopt the amendment to the St. Lucie County Comprehensive Plan, amending the Future Land Use Map for the above referenced property from COM (Commercial) and RU (Residential, Urban) to MXD (Mixed Use District) along with Sub-Area Policies attached herein as Exhibit A. B. FINDING OF CONSISTENCY The Board of County Commissioners of St. Lucie County, Florida, specifically determines that the approval of this amendment to the adopted Comprehensive Plan Future Land Use Element is internally consistent with the goals, objectives and policies contained in the St. Lucie County Comprehensive Plan and provides for the recognition that impacts of this approval on the public facilities of St. Lucie County will not occur until such time as a Final Development Order for development on this property is issued. C. CHANGES TO THE COMPREHENSIVE PLAN AND FUTURE LAND USE MAP The St. Lucie County Planning and Development Services Director is hereby authorized and directed to cause these changes to be made in the Future Land Use Map of the Future Land Use Element of the St. Lucie County Comprehensive Plan and to make notation of reference to the date of adoption of this Ordinance. D. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts Ordinance No. 2026-7 File No.: FLUMA-2308-000025 Page 3 thereof, in conflict with the Ordinance are hereby superseded by this Ordinance to the extent of such conflict. E. SEVERABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable for any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. F. APPLICABILITY OF ORDINANCE This Ordinance shall be applicable as stated in Paragraph A, B, and C. G. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of the Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. H. FILING WITH THE STATE LAND PLANNING AGENCY The Planning and Development Services Director shall send a certified copy of the Ordinance to the Department of Commerce, Community Planning and Development Programs, 107 East Madison Street, Caldwell Building, Tallahassee, Florida 32399-4120. I. EFFECTIVE DATE This Ordinance shall take effect thirty-one (31) days after the adoption. If the Ordinance is challenged within thirty (30) days after adoption, the Ordinance shall not be effective until the State Land Planning Agency or Administration Commission respectively issues a final order finding the adopted amendment in compliance in accordance with Section 163.3184(10), Florida Statutes. J. CODIFICATION This Ordinance, upon its effective date, shall be codified by incorporating any contained changes into the St. Lucie County Comprehensive Plan. COM,Commercial RU,Residential Urban The Specific Use Area within this low intensity Mixed Use Activity Area is restricted in use to the equivalent of the IND (Industrial) Future Land Use designation as described in the Future Land Use Element unless otherwise amended through the Comprehensive Plan Amendment process. Development of this site shall be approved through the Planned Non-Residential Development process and shall include appropriate open space and buffers adjacent to residential uses and environmental conditions. Access to the development shall be provided from the west via Kings Highway, except limited (non-commercial/non-industrial) access through the open space & buffering area may be approved where a recorded access easement existed prior to 1990 (initial Comprehensive Plan Adoption).
