LUCIE COUNTY GRANTING APPROVAL OF THE MINOR SITE PLAN KNOWN AS THE CENTRAL COUNTY UTILITIES WATER PLANT, LOCATED EAST SIDE OF PEACOCK ROAD, TWO MILES SOUTH OF OKEECHOBEE ROAD IN UNINCORPORATED ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director, or authorized designee, has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1) Kimley-Horn on behalf of St. Lucie County presented a Site Plan to be known as the Central County Utilities Water Plant, to develop a 10.0 MGD (build-out) potable water treatment plant in phases, along with associated access and maintenance driveways, stormwater and landscaping on +/-35 acres within the U (Utilities) Zoning District located on the east side of Peacock Road, two miles south of Okeechobee Road, as depicted on the attached map as Exhibit "A" and described in Part "A" below. 2) On November 12, 2024, the Board of County Commissioners approved Resolution No. 2024-214, rezoning the petition site for the Central County Utilities Water Plant from AG-5 (Agricultural-5) to U (Utilities). 3) The St. Lucie County Development Review Committee has reviewed the Minor Site Plan and found that it met the technical requirements of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part "B" of this Order. 4) The proposed project, with conditions of approval, will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5) All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. PDS Order 2026-10 Page 1 File No MJSP-2407-000130 6) The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7) The site plan is anticipated to have minimal demands on public facilities, meeting the requirements for a certificate of capacity in accordance with Chapter V. of the Land Development Code. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. The property on which the Final (Major) Site Plan is being granted is described as follows: Legal Description: THE SOUTH 1235.00 FEET OF THE WEST 1235.00 FEET OF THE FOLLOWING PARCEL: NORTHEAST 1/4 OF SECTION 13, TOWNSHIP 36 SOUTH, RANGE 38 EAST, LESS THE EAST 35 FEET AND LESS THE WEST 65 FEET AND LESS THE SOUTH 42.5 FEET, LYING AND BEING IN ST. LUCIE COUNTY, FLORIDA. CONTAINING APPROXIMATELY 35 ACRES. Parcel ID Number: 3213-111-0002-000-8 (a portion of) B. Pursuant to Sections 11.02.03. and 11.02.07 of the St. Lucie County Land Development Code, the Minor Site Plan for the project known as the Central County Utilities Water Plant is hereby approved, for the subject property described in Part A above, as shown on the site plan drawings for the project, prepared by Kimley-Horn. With a revision date of December 9, 2025, as attached and incorporated herein respectively as Exhibit B, and subject to the following conditions: 1. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the following actions shall be required: a. A vegetation removal permit or exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. b. Listed species surveys shall be provided/updated as required per state and/or federal survey protocol. Should any listed species be PDS Order 2026-10 Page 2 File No: MJSP-2407-000130 found as a result of these updated surveys appropriate permits from state and federal agencies shall be required. c. A tree mitigation plan for the onsite impacts per LDC 6.00.05.D. shall be certified by the Environmental Resources Department. 2. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the subject +/-35 acre site. 3. Prior to issuance of Certificate of Occupancy, the developer shall provide a wall waiver from the property owner to the south or update the landscape plan, site plan, and any other associated documents to depict an eight foot tall opaque wall or fence where abutting residential use, along with the associated landscaping per LDC 7.09.04.E. As noted and provided by the LDC, the opaque fence/wall may be reduced from eight to six feet or waived in its entirety if each adjacent property owner provides signed consent pardoning this requirement. Landscaping requirements shall then comply with the standards outlined in LDC 7.09.04.B. 4. The odor control system depicted on the design plans shall be integrated as needed to minimize off-site impacts. 5. When central sewer services (operational lines) are completed adjacent to the site (within the abutting Peacock Road right-of-way), a central sewer connection shall be required within 365 days of these facilities becoming "Available." In the absence of central wastewater facilities, at this time, the project may proceed with the proposed septic system. 6. As provided in Resolution 2025-12, which granted a Road Paving Waiver for the subject project, the owners, heirs and assigns of the project sign herein agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Peacock Road. 7. A Site Development Permit is required prior to performing site improvement activities. 8. Prior to issuance of a Certificate of Occupancy, a Fee-in-Lieu of sidewalk approval from the Board is required. If the FIL is not approved by the board, construction of a sidewalk along the project's frontage of Peacock Road will be required. 9. Should the stabilized fire lane(s) become frequently used by motorized vehicles, the County Engineer may require the developer or successors in interest to pave all or part of such area pavement may be required to comply with the Land Development Code. Within 90 days of developmental approval, the applicant, property owner, developer, successors, or assigns, shall proceed with actions to convey to St. Lucie County, in a manner or form acceptable to the County Attorney, 40' of right-of-way along the project's frontage of Peacock Road. C. The Minor Site Plan granted by this Order shall expire on April 27, 2028, unless a Building Permit is obtained, or an extension is granted in accordance with Section 11.02.06(B)(3) of the Land Development Code. D. The developer is advised as part of this approval that the property owner(s), developer, etc., including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part "A". Issuance of this authorization or permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filled in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of any action or activity authorized through this Minor Site Plan until the appeal is resolved. F. The conditions set forth in Part "B" are an integral non-severable part of the Site Plan granted by this Order. If any condition set forth in Part "B" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. G. The Certificate of Capacity, attached as Exhibit C, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity PDS Order 2026-10 Page 4 File No: MJSP-2407-000130 shall automatically terminate. H. A copy of this Order shall be attached to the site plan drawings, which shall be placed on file with the St. Lucie County Planning and Development Services Department and copies provided to the developer and agent of record as identified on the Site Plan application.
