LUCIE COUNTY, FLORIDA, TO APPROVE A SMALL SCALE N D-g 3 m� gIr AMENDMENT OF THE ADOPTED COMPREHENSIVE PLAN FUTURE ^' 0 LAND USE MAP — TO CREATE A +/- 20.85-ACRE SUBAREA OF THE LUCIE ROCK MIXED USE ACTIVITY AREA (INITIALLY o o ESTABLISHED AS AN EXTENSION OF THE MIXED USE ORANGE 1 _ AVENUE/I-95 ACTIVITY AREA) THAT WOULD ALLOW AN 80-FOOT g BUILDING HEIGHT LIMIT WITHIN A PORTION OF ESTABLISHED 0 MEDIUM AND HIGH INTENSITY DEVELOPMENT AREAS, LOCATED Z BETWEEN NORTH ROCK ROAD, NSLRWCD CANAL NO. 41 AND A THE RELIEF CANAL AND PROVIDING FOR FINDINGS, CONFLICTING PROVISIONS, SEVERABILITY, APPLICABILITY, FILING WITH THE FLORIDA DEPARTMENT OF STATE, FILING WITH THE FLORIDA DEPARTMENT OF COMMERCE, AN EFFECTIVE DATE, CODIFICATION AND ADOPTION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1 . On January 9, 1990, the Board of County Commissioners of St. Lucie County adopted the St. Lucie County Comprehensive Plan. 2. The Board of County Commissioners as the governing body of St. Lucie County having jurisdiction over this application pursuant to Chapter 163, Florida Statutes, is authorized and empowered to consider amendment to the adopted Comprehensive Plan of St. Lucie County. 3. A petition was filed by Patti Tobin of HJA Design Studio, on behalf of MC320, LLC, owner of the land subject to the amendment, requesting a Comprehensive Plan Future Land Use Map Amendment (FLUMA) to create a +/- 20.85-acre subarea of the Lucie Rock Mixed Use Activity Area (initially established as an extension of the Mixed Use Orange Avenue/I-95 Activity Area), an area in which an 80-foot building height limit is set, within the established Medium and High Intensity Development Areas. 4. On April 16, 2026, the St. Lucie County Planning and Zoning Commission acting as the Local Planning Agency held a public hearing, of which due notice was published in the St. Lucie News Tribune, and recommended approval of the proposed amendment to the Board of County Commissioners. 5. On May 5, 2026, the Board of County Commissioners held the required public hearing, of which due notice was placed in the St. Lucie News Tribune, mailed to owners of property within 500ft. and a notice sign posted on the premises, and deemed the adoption of the amendment to the Comprehensive Plan to be in the best interests of the citizens and residents of the County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: A. ADOPTION OF THE AMENDMENT The Board of County Commissioners does hereby adopt the amendment to the St. Lucie County Comprehensive Plan, attached herein as Exhibit A. B. FINDING OF CONSISTENCY The Board of County Commissioners specifically determines that the approval of this amendment to the adopted Comprehensive Plan Future Land Use Element is internally consistent with the goals, objectives and policies contained in the St. Lucie County Comprehensive Plan and provides for the recognition that impacts of this approval on the public facilities of St. Lucie County will not occur until such time as a Final Development Order for development on this property is issued. C. CHANGES TO THE COMPREHENSIVE PLAN AND FUTURE LAND USE MAP The St. Lucie County Planning and Development Services Director is hereby authorized and directed to cause these changes to be made in the Future Land Use Element of the St. Lucie County Comprehensive Plan and to make notation of reference to the date of adoption of this Ordinance, upon the effective date. D. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with the Ordinance are hereby superseded by this Ordinance to the extent of such conflict. E. SEVERABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable for any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. Ordinance No.2026-14 Page 2 F. APPLICABILITY OF ORDINANCE This Ordinance shall be applicable as stated in Paragraph A, B, and C. G. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of the Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. H. FILING WITH THE STATE LAND PLANNING AGENCY The Planning and Development Services Director shall send a certified copy of the Ordinance to the Department of Commerce, Community Planning and Development Programs, 107 East Madison Street, Caldwell Building, Tallahassee, Florida 32399-4120. I. EFFECTIVE DATE This Ordinance shall take effect thirty-one (31) days after the adoption. If the Ordinance is challenged within thirty (30) days after adoption, the Ordinance shall not be effective until the State Land Planning Agency or Administration Commission respectively issues a final order finding the adopted small-scale amendment to be incompliance in accordance with Section 163.3184(10), Florida Statutes. J. CODIFICATION This Ordinance, upon its effective date, shall be codified by incorporating any contained changes into the St. Lucie County Comprehensive Plan. K. ADOPTION.
