HomeMy WebLinkAbout26-025 PDS ORDER 2026-025 File No.: WDA-2512-000045 AN ORDER GRANTING A USE DETERMINATION FOR MANUFACTURING OF ARMORED VEHICLES IN THE INDUSTRIAL LIGHT ZONING DISTRICT AND GRANTING ADMINISTRATIVE RELIEF FOR A DEFERMENT OF THE INSTALLATION OF LANDSCAPING, REMOVAL OF MILLINGS, AND RESTORATION OF STORMWATER RETENTION FOR PROPERTY LOCATED AT 309 ANGLE ROAD, FORT PIERCE, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request to allow manufacturing and repair of armored vehicles in the IL (Industrial, Light) zoning district in accordance with Land Development Code (LDC) Section 3.01.02.B. and to defer the restoration of stormwater detention, removal of millings and installation of landscaping in accordance with the provisions for relief set forth in St. Lucie County Ordinance 12-003 and LDC Section 7.09.04(0.)for the property located at 309 Angle Road, Fort Pierce, FL and has made the following determinations: 1. The applicant, Bradley J. Currie. AICP. representing Marvid Corporation, is requesting a use determination for the manufacturing of armored vehicles in the IL (Industrial, Light) zoning district and administrative deferral from the provisions of LDC Section 7.09.04. and 7.07.00. The deferral request is to postpone the restoration of previously approved stormwater detention and landscaping across the subject site. The 4.2-acre parcel is located north of Canal #3 on Angle Road, in Fort Pierce, FL. The subject property has frontage on Angle Road, a Zoning Designation of IL (Industrial, Light) and RS-4. (Residential, Single-Family, 4du/ac) and a corresponding IND, (Industrial) and RH. (Residential High, 15du/ac) Future Land Use designation. 2. On March 14, 1989, the Board of County Commissioners of St. Lucie County, Florida. approved the Major Site Plan for the project known as B&B Machine and Fabricating. 3. On May 15. 2012, the Board of County Commissioners of St. Lucie County, Florida. adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to allow, after a full analysis of all potential impacts, certain landscape improvements to be deferred to a future date. 4. This request for Administrative Relief has met the provisions for relief set forth in LDC Section 7.09.04(0.). Staff has provided a written analysis that demonstrates the proposed relief is based upon conditions that are unique and peculiar to the site and unnecessary hardship for the owner. The Development Review Committee reviewed the request and Planning Staff performed an analysis of the request for deferral of the installation of landscaping along the northern and western property boundaries of the subject site until adjacent parcels are developed. The analysis is found in the Planning and Development Services Department memorandum entitled "309 Angle Road- Waivers, Deferrals, and Alternatives— Waiver& Use Determination (WDA-2512-000045)"dated May 15, 2026. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood. traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. NOW,THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Ordinance 12-003 and the St. Lucie County Land Development Code, the request from Bradley Currie, AICP, on behalf of Marvid Corporation, for administrative relief to allow manufacturing and repair of armored vehicles in the IL (Industrial. Light) zoning district and to defer the restoration of stormwater detention and the installation of landscaping is hereby approved subject to the following conditions: 1. The deferral period of landscaping will expire twelve(12) months after the approval of PDS Order No. 2026-025. 2. Any proposal by the applicant to expand the site plan or proposed facility use during the deferral period shall trigger landscape requirements to be met for the entire site. 3. After the approved deferment period, the property shall comply with the minimum code standards of all applicable sections of the Land Development Code. If the property does not meet all applicable standards. it may be subject to a Code Compliance violation. 4. Within twelve (12) months of the Waivers. Deferrals, and Alternatives application approval, the applicant shall have installed the remaining landscape requirements, including installation of sod and replanting of any landscape that is missing or not of good health in accordance with the B&B Machine and Fabricating Major Site Plan (1989). 5. Prior to commencement of development outside of previously approved and impacted areas, including but not limited to; clearing. filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a gopher tortoise survey conducted by a state certified gopher tortoise agent may be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol. 6. Prior to commencement of development outside of previously approved and impacted areas, including, but not limited to clearing, filling. excavation, grading, or planting of vegetation. as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 7. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species WDA-2512-000045 PDS 2026-025 Page 2 of 5 shall be eradicated from the site. 8. No industrial uses. operations, or activities shall be permitted within the portion of the subject property zoned Residential, Single-Family, 4 (RS-4). All industrial uses shall be confined to the area zoned Industrial, Light (IL). B. The property on which this deferment is being granted is described as follows: ALL OF LOTS OR TRACTS 30 AND 31, HOME ACRES SUBDIVISION UNIT 2, ACCORDING TO THE PLAT THEREOF. AS RECORDED IN PLAT BOOK 7, PAGE 28, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. LESS AND EXCEPTING THAT CERTAIN PARCEL OF LAND MORE PARTICULARLY DESCRIBED IN OFFICIAL RECORDS BOOK 49, PAGE 375 AND LESS AND EXCEPTING ROAD RIGHTS OF WAYS MORE PARTICULARLY DESCRIBED IN DEED BOOK 150. PAGE 443 AND DEED BOOK 151, PAGE 256. OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING 4.2 ACRES. MORE OR LESS. Address: 309 Angle Road, Fort Pierce, FL 34947 Parcel ID#: 2408-604-0004-000-0 C. The approvals and authorizations granted by this Order are granted to the applicant for the purpose of obtaining construction permits or a Zoning Compliance Certificate from St. Lucie County. D. The developer is advised as part of this approval for 309 Angle Road, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to. the United States Army Corps of Engineers, Florida Department of Environmental Protection, South Florida Water Management District, and St. Lucie County's Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this approval if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. The conditions set forth in Part A are an integral non-severable part of the Administrative Relief approval as granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Administrative Relief approval granted by this order shall become null and void. A copy of this Order shall be placed on file with the Planning and Development Services Director and mailed to the developer or agent of record as identified on the written request for administrative relief.
