AN ORDER GRANTING A STATUTORY EXTENSION PROVIDED BY
SECTION 252.363 FLORIDA STATUTES TO THE SCHEDULED
EXPIRATION DATE FOR THE APPROVED MINOR SITE PLAN
KNOWN AS AMERICAN STORAGE SOLUTIONS, IN ST. LUCIE
COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a development order extension timely submitted by Earthworks Group, Inc., on behalf
of NTI Holdings, LLC, and has made the following determinations:
1. On July 28, 2020, the Board of County Commissioners approved Resolution No. 2020-
163, for a Major Site Plan to be known as American Storage Solutions to construct a
self-storage warehouse facility consisting of three hundred (300) enclosed storage units
and fifty-one (51) boat and RV spaces, and an eight hundred (800) square foot security
office, in four (4) phases.
2. On April 2, 2024, the Planning & Development Services Director approved PDS Order
2024-019, granting a Minor Site Plan (Major Adjustment to the Minor Site Plan) for the
project known as American Storage Solutions to reduce the number of impacted trees,
change the driveway surface from concrete to asphalt, change the perimeter fence from
masonry to galvanized chain link to minimize root damage on the perimeter landscaping,
and remove a 4,050 square foot single story storage building from the previously
approved plan.
3. On October 5, 2024, Governor DeSantis issued Executive Order 24-214 for sixty (60)
days due to the threat of Tropical Storm Milton (Converted to Hurricane Milton) to the
residents of the State of Florida. This emergency declaration was effective on October
5, 2024, and would have expired 60 days later, on December 4, 2024. The order has
since been continually extended pursuant to Executive Orders 24-264, 25-26, 25-68,
25-119, 25-150, 25-191, and 25-242, which extended the State of Emergency to January
24, 2026.
4. On March 27, 2026, Earthworks Group, Inc., on behalf of NTI Holdings, LLC, filed a
request to toll and extend the termination date for the project known as American
Storage Solutions pursuant to Executive Order 24-214 (Hurricane Milton).
5. Senate Bill 250, approved by the Governor on June 28, 2023, and effective July 1, 2023,
amended Section 252.363(1)(a) Florida Statutes, increasing the extension of the
expiration dates for such permits or other authorizations to twenty-four (24) months per
state of emergency (plus the duration of the emergency declaration), but limiting the
extended period under overlapping states of emergency to forty-eight (48) months.

6. Section 252.363 Florida Statutes requires that a specific written notice be filed with the
issuing authority within ninety (90) days after the termination of the declaration of
emergency. The applicant applied for this extension on March 27, 2026, which is within
the time frame established by the Statute.
7. Planning Staff has performed an analysis of the project and determined that the
extension is consistent with the original St. Lucie County Development Order. Further
analysis is found in the memorandum titled American Storage Solutions Executive Order
Extension (EDO-2603-000070), April 29, 2026.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of
St. Lucie County, Florida:
A. Pursuant to Section 252.363, Florida Statutes, the administrative approval project known
as American Storage Solutions, has been found to be eligible for a statutory extension.
The approval granted under PDS Order 2024-019 is extended from its last scheduled date
of expiration, April 2, 2026, and now shall expire July 29, 2029, for the property described
below in Part B.
B. The property on which this Development Order Extension is being granted is described
as follows:

LOTS 1 THROUGH 19, INCLUSIVE, BLOCK 21, SAN LUCIE PLAZA, UNIT ONE,
ACCORDING TO THE MAP OR PLAN THEREOF AS RECORDED IN PLAT BOOK 5,
PAGE 57, PUBLIC RECORDS OF SAINT LUCIE COUNTY, FLORIDA.
CONTAINING 3.30-ACRES MORE OR LESS.
Location: West side of 25th Street, approximately 1,700 feet south of St. Lucie
Boulevard in Fort Pierce.

C. This statutory extension approval shall expire on July 29, 2029, unless a building permit
is issued and active or an extension has been granted by Section 11.02.06, St. Lucie
County Land Development Code.
D. The conditions of approval as outlined in PDS Order 2024-019 are an integral non-
severable part of the approval as granted by this administrative extension. If any condition
set forth within this Order are determined to be invalid or unenforceable for any reason
and the developer declines to comply voluntarily with that condition, this development
order extension approval granted by this Order shall become null and void.
E. The Certificate of Capacity granted by the Planning and Development Services Director
shall remain valid for the period of this development order. If this order expires or otherwise

terminates, the Certificate of Capacity shall automatically terminate.
F. A copy of this statutory extension shall be placed on file with the St. Lucie County Planning
and Development Services Department.
G. This order shall be recorded in theem Public Records of St. Lucie County.
