HomeMy WebLinkAbout26-039 PDS ORDER 2026-039 File No. MNSP-2511-000180 AN ORDER GRANTING APPROVAL OF A MAJOR ADJUSTMENT TO THE MINOR SITE PLAN KNOWN AS UNITED TELEPORTS, FOR THE CO- LOCATION OF THE AMAZON KUIPER COMMUNICATIONS FACILITY, FOR A PROPERTY LOCATED AT 10161 RANGE LINE ROAD, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Major Adjustment to the Minor Site Plan submitted by NB+C Engineering Services, LLC, on behalf of Amazon Kuiper, evaluated the comments of the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. NB+C Engineering Services, LLC, submitted an application for a Major Adjustment to the Minor Site Plan known as United Teleports, for the co-location of an Amazon Kuiper communications facility. The Adjustment provides for the construction of a communications and public utility facility, consisting of satellite dishes, space for equipment and shelter facilities, and a utility backboard within a fenced compound. The project is land located at 0 10161 Range Line Road, Port St. Lucie, FL, within the IH (Industrial, Heavy)Zoning District. U 2. On July 1, 1998, the Community Development Director approved a Lot Split 98-19 for a re cL 126.672-acre parcel into two (2) parcels consisting of Lot 1 containing 3.78 acres and Lot F 0 2 containing 122.88 acres. On August 26, 2020, the Board of Adjustment approved BOA Resolution No. 2020-006, W w w granting a Variance to allow multiple existing structures to encroach into the minimum vr W o required yard setbacks. The approval authorized fifteen (15) existing satellite antennas to d Q remain within the required minimum side and/or rear yard setbacks, a 22-foot diameter -ow to �, W .. water storage tank to remain within the required minimum rear yard setback, and an IL C9 IL z approximately 368-square-foot one-story concrete pump house to remain within the _IDwE required minimum yard setback. = o VQ_lrew 0 L`° 4. On October 6, 2020, the Planning and Development Services Director approved PDS Order No. 2020-065, granting a Minor Adjustment to the Minor Site Plan known as United Teleports - SES. The approval authorized the construction of an 85-foot by 88-foot elevated steel platform structure, a 417-square-foot mezzanine addition, incorporation of the existing ground-mounted satellite antennas and associated foundations, and minor revisions to the parking and landscaping layout. 5. On December 29, 2021, the Planning and Development Services Director approved PDS Order No. 2021-060, granting a Lot Split Adjustment (Lot Line Adjustment) for an approximately 126.72-acre parcel into two (2) parcels consisting of Lot 1 containing 117.92 acres and Lot 2 containing 8.78 acres. 6. On October 15, 2023, the Planning and Development Services Director approved PDS Order No. 2023-080, granting a Major Adjustment to the Minor Site Plan for United Page 1 PDS No. 2026-039 File No.: MNSP-2511-000180 Teleports to construct two (2) new 10,000-square-foot buildings. The approval expired on October 26, 2025, and was not built. 7. The St. Lucie County Development Review Committee has reviewed the proposed a Major Adjustment to the Minor Site Plan and found it to meet the technical requirements of the St. Lucie County Land Development Code, Comprehensive Plan, and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, subject to the conditions set forth in Part "A" of this Order. 8. Planning staff has performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services memorandum titled Amazon Kuiper Major Adjustment to the Minor Site Plan, United Teleports, (MNSP-2511-000180), dated June 2, 2026. 9. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 10. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 11. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the a Major Adjustment to the Minor Site Plan to be known as United Teleports, for the co-location of an Amazon Kuiper communications facility is hereby approved, as shown on the site plan drawings dated December 8, 2025, with a revision date of May 12, 2026, attached as Exhibit "A", for the project prepared by NB+C Engineering Services, LLC., subject to the following conditions: 1. Within 90 days of developmental approval, the applicant, property owner, developer, successors, or assigns, shall convey to St. Lucie County, in a manner or form acceptable to the County Attorney, 50 feet (wide) of right-of-way along the frontage of Range Line Road, as determined by the Public Works Department. 2. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, listed species surveys, including but not limited to crested caracara, gopher tortoise, and wading bird surveys, shall be updated as necessary per individual species-specific requirements or written correspondence stating any potential impacts have been resolved from the appropriate state and federal agency. If any listed species impacts are found to be present as a result of these updated surveys, appropriate mitigative measures per state and federal agency requirements shall be provided prior to initiation of any clearing activities. Prior to commencement of development, including but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 4. Prior to issuance of a Certificate of Occupancy or equivalent, all Category I listed invasive plants shall be eradicated from the site. 5. Prior to issuance of a Certificate of Occupancy or equivalent, a 6 FT sidewalk is required along adjacent road Right-of-Ways. The Board of County Commissioners may authorize the applicant to pay a Fee-in-Lieu of construction of the sidewalk. If the applicant wishes to pursue the Fee-in-Lieu option, it must be formally requested and approved by the Board of County Commissioners. If the Fee-in-Lieu is not approved, construction of the sidewalk will be required. 6. A Site Development Permit is required prior to performing site improvement activities. In accordance with the permit and Land Development Regulations, the applicant shall retain the FOR for site inspections and final certification. B. The property on which this Major Adjustment to a Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION: PARENT TRACT (BOOK 4780, PAGE 154) A parcel of land lying in Section 1, Township 37 South, Range 38 East, St. Lucie County, Florida, being more particularly described as follows: Commence at the Northeast corner of Section 1, Township 37 South, Range 38 East, St. Lucie County, Florida; thence run South 00°05'54" West, along the range line a distance of 4,426.86 feet to the Northwest corner of the Commerce at the Northeast corner of Section 1, Township 37 South, Range 38 East, St. Lucie County, Florida; thence run South 00°05'54" West, along the range line a distance of 4,426.86 feet to the Northwest corner of said range line, a distance of 330.00 feet; thence North 89°59'06"West, a distance of 660.00 feet to a point of intersection with a line lying and being 660.00 feet West of and parallel with said range line; thence North 00°00'54" East, along said parallel line, a distance of 330.00 feet; thence South 89°59'06" East, a distance of 660.00 feet to the Point of Beginning and said range line. The approvals granted by this administrative order shall expire twenty-four (24) months from the effective date, unless a Building Permit is obtained or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Major Adjustment to a Minor Site Plan, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal, and local regulatory agencies including, but not limited to, the Federal Aviation Administration, United States Army Corps of Engineers, the Florida Department of Environmental Protection, Page 4 PDS No. 2026-039 File No.: MNSP-2511-000180 South Florida Water Management District, the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part"A" above, all such appeals must be filed in writing with the County Administrator within thirty(30)days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings, which shall be placed on file with the St. Lucie County Planning and Development Services Department and copies provided to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This Order shall be recorded in the Public Records of St. Lucie County.
