LUCIE COUNTY, GRANTING MINOR SITE PLAN APPROVAL FOR A SEVEN-LOT SUBDIVISION KNOWN AS RANGE LINE ROAD INDUSTRIAL, ON APPROXIMATELY 137 ACRES LOCATED AT 10075 RANGE LINE ROAD, IN UNCORPORATED ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Site Plan submitted on behalf of Dairy Feeds. Inc. and the comments from the Development Review Committee on this application. and has made the following determinations: 1. Dairy Foods, Inc., represented by Mike McCarty. of McCarty and Associates. requested approval of a Minor Site Plan for a seven (7) lot subdivision. The site is generally located at 10075 — 10161 Range Line Road, within the IH (Industrial, Heavy) and U (Utilities) Zoning Districts, and is more particularly described in Part B and depicted in Exhibit A. 2. The Development Review Committee has reviewed the Minor Site Plan for the Range Line Road Industrial Subdivision, as referenced in Part A, certified that the plans are consistent with the Land Development Code (LDC) under Section 11.02.00 (Procedure for Review of Site Plans). certified that they are consistent with goals, objectives, and policies of the Comprehensive Plan, and certified that they are consistent with the County's Code of Ordinances; all subject to the conditions set forth in Part A of this Order. 3. Planning staff performed an analysis of the project and found it to be consistent with the LDC and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum entitled Range Line Road Industrial Minor Site Plan. dated July 14. 2025. 4. The proposed project will not have an undue adverse effect on adjacent property. the character of the neighborhood, traffic conditions. parking. utility facilities or other matters affecting public health, safety. and general welfare. 5. The proposed project will be constructed, arranged. and operated so as not to interfere with the development and use of neighboring property. in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to LDC Section 11.02.03.. the Range Line Road Industrial Minor Site Plan is hereby approved as shown on the Site and Landscape Plans, as prepared by McCarty and Associates. dated December 5, 2024, and included as Exhibit B to this Final Development Order; reviewed the Landscape Plan prepared by Daniel Sugg, PLA, dated April 16, 2025, and included as Exhibit C to this Final Development Order; and subject to the following conditions. 1. The applicant may receive approval for Fee-in-Lieu of sidewalk for the Range Line Road frontage from the Board of County Commissioners. A subdivision improvement agreement and bonding will be required if platting will be pursued prior to construction of required infrastructure. (Complete) 3. A Site Development Permit is required prior to performing site improvement activities. 4. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., listed species surveys (e.g., gopher tortoise, crested caracara, sandhill crane, etc.) shall be provided/updated as required per state and/or federal survey protocol. Should any listed species be found as a result of these updated surveys appropriate permits from state and federal agencies shall be required. 5. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 6. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, the developer shall provide an executed Conservation Easement over onsite preserve areas, where applicable, along with the approved Preserve Area Monitoring and Management Plan (PAMMP), with an attached affidavit and cashier's check (payable to the Clerk of the Court for recording fees)to the County Attorney. The applicant shall also provide a georeferenced GIS shapefile or CAD file of the conservation easement boundaries to St. Lucie County. 7. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, an Environmental Resource Permit (ERP) from South Florida Water Management District (SFWMD) shall be provided, where applicable, to verify the limits of the wetlands. Should the limits of the wetland substantially deviate from the environmental consultant's delineation, a new Wetland Waiver application shall be submitted in accordance with Comprehensive Plan Policy 6.1.14.4. 8. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. 9. Within 90 days of developmental approval, the applicant, property owner, developer, successors, or assigns, shall convey to St. Lucie County, in a manner or form acceptable to the County Attorney, 50 feet of right-of-way along the frontage of Range Line Road, as determined by the Public Works Department. 10. Prior to the issuance of any building permits on any of the lots within the area referred to as the Range Line Road Industrial Park site plan, the developer, his successors or assign(s) to that property shall be required to submit a complete site plan for review and approval, regardless of the size of the project. Each site plan shall be prepared in accordance with the requirements set forth in Section 11.02.00 of the St. Lucie County Land Development (LDC). 11. Each individual site plan submittal shall be required to provide traffic impact analysis prepared in accordance with LDC Section 11.02.09. 4., providing for a cumulative impact review of the development traffic impacts. The developer, his successors or assign(s), or the Property Owners Association where applicable, shall be responsible for any future turn lanes and signalization at the project's intersection with Range Line Road, if or when warranted, coordinating proportionate contributions or similar where appropriate. F. A Certificate of Capacity for the subdivision only, a copy of which is attached hereto as Exhibit D, shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A, all such appeals must be filed in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03.B., of the St. Lucie County LDC.
