A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY GRANTING A MAJOR SITE TO DEVELOP UP TO
A 1,400,000 SQUARE FEET WINDOW MANUFACTURING FACILITY
PLAN TO BE KNOWN AS PROJECT ORCHID LOCATED WEST OF
NORTH ROCK ROAD, SOUTH OF THE NORTH ROCK ROAD
EXTENSION (ACCESS ROAD) AND NORTH OF THE RELIEF CANAL,
IN THE IL, INDUSTRIAL LIGHT AND IH, INDUSTRIAL HEAVY ZONING
DISTRICTS, IN UNINCORPORATED ST. LUCIE COUNTY.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
testimony and evidence, including, but not limited to the staff report, has made the following
determinations:
1) MC320, LLC, and representative, Patti Tobin of HJA Design Studio, presented a
petition for Major Site Plan for an approximate 1,400,000 sq. ft. glass window
manufacturing complex on the subject property located west of N. Rock Rd., north of
the Relief Canal. The Site Plan includes a +/-1,283,744 sq. ft. manufacturing building,
+/-76,140 sq. ft. foundry building, 27,300 sq. ft. two-story office, and two (2) 450 sq. ft.
guard houses, along with support improvements in the IL, (Industrial Light) and IH
(Industrial, Heavy) Zoning Districts, for a property located west of N. Rock Rd., south of
N. Rock Rd. Ext. (Access Rd.), and north of the NSLRWCD Relief Canal, in
unincorporated St. Lucie County, Florida, as depicted on the attached map as Exhibit
A and described in Part A.
2) On May 5, 2026, the Board of County Commissioners of St. Lucie County, Florida,
held a public meeting and evaluated the proposal.
3) The St. Lucie County Development Review Committee has reviewed the Major Site
Plan, as depicted on Exhibit C, for the project and found it to meet all technical
requirements and to be consistent with the Future Land Use Map of the St. Lucie
County Comprehensive Plan, subject to the conditions set forth in Part B of this
Resolution.
4) The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan and the Code of Ordinances of St. Lucie County.
5) The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities or other
matters affecting the public health, safety and general welfare.
6) All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping and
screening.
7) The proposed project will be constructed, arranged and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. The property on which the Major Site Plan is being granted is described as follows:

CANAL RIGHT-OF-WAY. ALL LYING AND BEING IN ST. LUCIE COUNTY,
FLORIDA.

B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the
Major Site Plan to develop an approximate 1,400,000 sq. ft. glass window
manufacturing complex on the subject property located west of N. Rock Rd., north of
the Relief Canal. The Site Plan includes a +/-1,283,744 sq. ft. manufacturing building,
+/-76,140 sq. ft. foundry building, 27,300 sq. ft. two-story office, and two (2) 450 sq. ft.
guard houses, along with support improvements in the IL, (Industrial Light) and IH
(Industrial, Heavy) Zoning Districts, as generally depicted in Exhibit C herein, as
prepared by HJA Design Studio and Kimley Horn, dated April 9, 2026, is hereby
approved, subject to the following conditions, as may be amended and superseded by
the associated Development Agreement governing the property:
1. The developer or successor in interest shall fulfill off-site transportation and support
stormwater improvements, through construction or a proportionate share payment to
the County, at the County's discretion, as follows:
a. Prior to the first Certificate of Occupancy:
i. Intersection of N. Rock Road & Orange Avenue:
o Construct eastbound left-turn lane (245 ft).
o Extend existing westbound right-turn lane to 245 ft.
o Construct southbound left-turn lane (650 ft).
ii. Orange Avenue (Rock Rd. to West of Kings Hwy):
o Construct second westbound lane (-2,080 ft).
o Construct second eastbound lane (-2,080 ft).

iii. N. Rock Road Widening/Paving:
o Widen road to minimum 24-foot width from Orange Ave. to the St.
Lucie County Correctional Facility driveway (-1,950 ft).
o Pave the remainder of N. Rock Road to the project's north driveway
(-1,800 ft).
iv. Proiect Site Access-
* Construct northbound left-turn lane at the project's south driveway on
N. Rock Road.
b. Completion Required Prior to Final Certificate of Occupancy (CO):
o N. Rock Road (East-West Segment): Construct a paved 24-foot
minimum width roadway within the dedicated right-of-way.
c. Ongoing/Threshold-Based Obligations:
o Traffic Signal (Rock Rd. & Orange Ave.): Commencement of
installation must begin within 12 months of written notice that the
signal is warranted/authorized by FDOT or the County, with the
developer coordinating with the County for signal timing optimization.
2. Within 12 months of Site Plan approval, the applicant, property owner, developer,
successors, or assigns, shall convey to St. Lucie County, in a manner or form
acceptable to the County Attorney, 5 feet of right-of-way along the frontage of the
Access Road, also known as Sunnyland Drive, 30 feet of right-of-way along Emerson
Avenue, and 20 feet of right-of-way along N Rock Road, as determined by the Public
Works Department.
3. A Fee-in-Lieu of sidewalk is proposed by the applicant and requires approval from
the Board of County Commissioners. If the agreement is not approved by the board,
the sidewalk will be required to be constructed and included in the Site Development
Permit plans.
4. The applicant shall implement site-specific control measures to minimize off-site
impacts related to noise, vibration, and odor on adjacent properties (See Conditional
Use Permit for specific requirements for the Foundry).
5. Exterior lighting shall be downcast and hooded to minimize light trespass.
6. The western landscape area shall feature a berm and integrated opaque wall or
fence, totaling 8ft., to further screen dumpster locations to minimize dumpster
loading noise.
7. A Road Improvement Agreement and appropriate bond will be required for all
permanent improvements within the Right-of-Way.
8. A Site Development Permit is required prior to performing site improvement
activities. In accordance with the permit and Land Development Regulations, the
applicant shall retain the FOR for site inspections and final certification.
9. Prior to recording of this Resolution (Development Order), the landscape plan shall
be refined to comply with the Land Development Code (LDC), including but not
limited to LDC 7.09.00.
10. Prior to recording of this Resolution (Development Order), the tree survey shall be
updated to comply with LDC 11.02.09.A.2.i.
11. Prior to issuance of a vegetation removal permit or exemption thereof, a tree
mitigation plan shall be reviewed and approved by the Environmental Resources
Department.
12. Prior to commencement of development, including but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, listed
species surveys shall be updated as necessary per individual species-specific
requirements. If any listed species impacts are found to be present as a result of
these surveys, appropriate mitigative measures per state and federal agency
requirements shall be provided prior to initiation of any clearing activities.

13. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a
vegetation removal permit or exemption shall be issued by the Environmental
Resources Department per LDC 6.00.03.
14. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, monitoring
reports from the certified arborist shall be provided following each root pruning event
and following each relocation event to ensure best management practices (BMPs)
are followed.
15. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, monitoring
reports from the certified arborist shall be provided prior to issuance of a certificate of
completion/occupancy, following twelve (12) months after the last round of canopy
trees has been relocated, and at the 18-month follow up inspection. Should any
relocated trees die within these timeframes or beyond, the applicant shall provide
another method of tree mitigation, or a combination of methods as outlined in LDC
6.00.05.D, as tree mitigation shall be in perpetuity.
16. Prior to commencement of development, including but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, listed
species surveys shall be updated as necessary per individual species-specific
requirements. If any listed species impacts are found to be present as a result of
these surveys, appropriate mitigative measures per state and federal agency
requirements shall be provided prior to initiation of any clearing activities.
17. Prior to issuance of a certificate of occupancy, all Category I listed invasive plant
species shall be eradicated from the parcel per LDC 7.09.05.
C. The approvals and authorizations granted by this Resolution shall expire on May 5,
2028 unless a building permit is secured or a site plan extension is granted in
accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code, or
as otherwise provided by law.
D. The developer is advised as part of this Major Site Plan approval that the property
owner(s), developer, etc. including any successors in interest, shall obtain all
applicable development permits and construction authorizations from the appropriate
State and Federal and local regulatory agencies including, but not limited to, the
United States Army Corps of Engineers, Environmental Protection Agency, the Florida
Department of Environmental Protection, Florida Department of Transportation, South
Florida Water Management District, the St. Lucie County Fire District, and the St. Lucie
County Environmental Resources, Public Works, and Building Departments prior to the
commencement of any development activities on the property described in Part A.
Issuance of this permit by the County does not in any way create any rights on the part
of the developer to obtain a permit from a state or federal agency and does not create
any liability on the part of the County for issuance of this permit if the developer fails to
obtain requisite approvals or fulfill the obligations imposed by a state or federal agency
or undertake actions that may result in a violation of state or federal law.
E. The conditions set forth in Part B are an integral non-severable part of the approval
granted by this Resolution. If any condition set forth in Part B is determined to be
invalid or unenforceable for any reason and the applicant or property owner declines to
comply voluntarily with that condition, the Major Site Plan approval granted by this
Resolution shall become null and void.

F. A Concurrency Certificate, a copy which is attached to this Resolution as Exhibit "B"
was signed by the Planning & Development Services Director on June 16, 2026.
G. This Resolution shall become effective upon the date of recording. Should the property
owner, developer or authorized agent wish to appeal any condition described in Part B
above, all such appeals must be filed in writing with the County Administrator within 30
days of the rendering of this Resolution, as described in Section 11.02.04(B), St. Lucie
County Land Development Code. Should an appeal to this Resolution be filed, no
permitting reviews or further administrative action shall take place on the processing of
this development project until the appeal is resolved.
H. The approvals and authorizations granted by this Resolution are for the purpose of
obtaining a Building and/or Site Development Permit from St. Lucie County.
I. A recorded copy of this Resolution shall be attached to the site plan drawings
described in Part B, which plan shall be placed on file with the St. Lucie County
Planning & Development Services Department Director.
J. A copy of this Resolution shall be mailed to the owner of record as identified on the
application.
K. This Resolution shall be recorded in the Public Records.
