WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on

testimony and evidence, including, but not limited to the staff report, has made the following o rn
determinations:
1) MC320, LLC, and representative, Patti Tobin of HJA Design Studio, presented a
petition for a Conditional Use Permit to develop and operate a metal foundry totaling o 0
approximately 76,200 square feet in the IH (Industrial, Heavy) Zoning District, as part
of a window manufacturing facility subject of a companion Major Site Plan application,
for a property located west of N. Rock Rd., south of N. Rock Rd. Ext. (Access Rd.),
and north of the NSLRWCD Relief Canal, in unincorporated St. Lucie County, Florida,
as depicted on the attached map as Exhibit A and described in Part A.
2) On April 16, 2026, the St. Lucie County Planning and Zoning Commission held a public
hearing on this petition, after advertising in the newspaper of local circulation, installing
a sign on the property, and notifying by mail all owners of property within 500 feet of
the subject at which all interested persons were given an opportunity to be heard, and
recommended that the Board of County Commissioners approve the request for the
property described in Part A.
3) On May 5, 2026, the Board of County Commissioners of St. Lucie County, Florida,
after advertising in the newspaper of local circulation, installing a sign on the property,
and notifying by mail all owners of property within 500 feet of the subject at which all
interested persons were given an opportunity to be heard.
4) The St. Lucie County Development Review Committee has reviewed the Conditional
Use Permit Petition and found it to meet the technical requirements and to be
consistent with the St. Lucie County Comprehensive Plan.
5) The proposed Conditional Use Permit has satisfied the requirements of Section
11.07.03 of the St. Lucie County Land Development Code and is consistent with the
goals, objectives, and policies of the St. Lucie County Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. The property on which the Conditional Use Permit is being granted is described as
follows:

B. The Conditional Use Permit to develop and operate a metal foundry totaling
approximately 76,200 square feet in the IH (Industrial, Heavy) Zoning District, as part
of a window manufacturing facility subject of a companion Major Site Plan application
as generally depicted in Exhibit C herein, is hereby approved subject to the following
conditions:
1. The applicant shall implement site-specific control measures to minimize off-
site impacts related to noise, vibration. and odor on adjacent properties
2. The developer and/or operator shall submit copies of the Environmental
Protection Agency (EPA) and Florida Department of Environmental Protection
(FDEP) permit to St. Lucie County. Ninety (90) days of baseline monitoring to
be provided to St. Lucie County. which is deemed to be part of the permit
documentation.
3. All monitoring reports submitted to the EPA and FDEP shall be submitted to the
County within 30 days of submission to said agencies.
4. No dry sweeping to be conducted on-site. Enclosed dry handling is required.
5. Exterior lighting shall be downcast and hooded to minimize light trespass.

6. The western landscape area shall feature a berm and integrated opaque wall or
fence, totaling 8ft. to further screen dumpster locations to minimize dumpster
loading noise.
C. The St. Lucie Planning and Development Services Director shall be authorized to
make a notation of the reference to the date of adoption of this Resolution on the
Official Zoning Map.
D. A Concurrency Deferral Affidavit, a copy which is attached to this Resolution as Exhibit
"B" was signed by the applicant in March 2026.
E. The approvals and authorizations granted by this Resolution are for the purpose of
obtaining a Building Permit and/or Zoning Compliance Certificate from St. Lucie
County and are not assigned to any other party or institution. Should the petitioners
choose or decide to assign this business to another entity or individual, a minor
adjustment to the Conditional Use Permit shall be required.
F. The conditions set forth in Part B are an integral non-severable part of the approval
granted by this Resolution. If any condition set forth in Part B is determined to be
invalid or unenforceable for any reason and the applicant or property owner declines to
comply voluntarily with that condition, the Conditional Use approval granted by this
Resolution shall become null and void.
G. Pursuant to Section 11.07.05(I) of the St. Lucie County Land Development Code,
approvals and authorizations granted by this Resolution shall expire after twelve (12)
months from the date of approval, unless a Building Permit or Certificate of Zoning
Compliance is obtained for the uses described in Part A above, or an extension has
been granted in accordance with Section 11.07.05(F), or applicable law.
H. A copy of this Resolution shall be mailed to the owner of record as identified on the
application.
I. This Resolution shall be recorded in the Public Records.

defer the certificate of capacity and reservation of capacity in public facilities for the above
property until a later time, but no later than the application for a final development order for the

I understand and acknowledge that the above listed property will be subject to the certificate of
capacity before any final development order can be issued, and that St. Lucie County can make
no guarantee that adequate public facilities will be available when I apply for the final

I further acknowledge that according to Section 5.08.01 of the St. Lucie County Land
