WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the F 8 0 application for an administrative variance, including, but not limited to the staff report and made n Z the following determinations: 8 m N n N 8o m 1. Petition by John Neprud for an Administrative Variance to reduce the internal setback w x requirement for the Whispering Creek Co-Op's minimum 10-foot building setback street, ° by 2', for a total building setback of 8'from the street to the proposed staircase,for property located at 2023 St Lucie Boulebard, Unit 188, Fort Pierce, FL, and further described in Paragraph "B", within the RMH-5 (Residential, Mobile Home-5), Zoning District. 2 73 o n 2. The Administrative Variance provides for a 20 percent reduction of the minimum required 10 ft. building setback from the street, allowing a reduction from 10 ft. to 8 ft for a proposed staircase attached to a single-family home. The encroachment into the minimum required front building setback is for a length of approximately 2 ft., generally parallel to the side property line, for the proposed 4 ft. wide staircase depicted on the boundary survey provided by the owner on March 13, 2026 as shown in Exhibit "A". 3. After consideration of staff's analysis found in a memorandum dated June 15, 2026, entitled "2023 St Lucie Boulevard, Unit 188 Front Yard Setback Administrative Variance Front yard setback reduction for a proposed staircase," including exhibits and the standards of review for granting administrative variances set out in Land Development Code Section 10.01.14.C., the Planning & Development Services Director has made the following determinations: The requested administrative variance meets the standards of review, where applicable, as set forth in Section 10.01.14.C. of the St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: a. The Mobile Home Park was in legal existence upon the effective date of this Ordinance (Ordinance No. 06-013). b. The placement of the proposed structure will meet the intent of all separation standards as required for all Mobile Home parks, any other applicable provision of this Code, Florida Building Codes or the fire code(s) and that the requested variance is the minimum necessary to locate the proposed structure on the property. c. A similar structure existed on the subject property at the proposed location of the new structure on the effective date of this Ordinance (Ordinance No. 06-013.) The placement of the proposed structure, if a mobile home, will not be located closer than ten (10) ft (3 m) side to side, eight (8) ft (2.4 m) end to side, or six (6) ft (1.8 m) end to end horizontally from any other mobile home, manufactured home, single family detached dwelling or community building unless the exposed composite walls and roof of either structure are without openings and constructed of materials that will provide a one-hour fire rating or the structures are separated by a one-hour fire-rated barrier. e. The placement of the proposed structure, if an accessory structure, if located immediately adjacent to a site line is constructed entirely of materials that do not support combustion and provided that such buildings or structures are not less than three (3)ft(0.9 m)from an accessory building or structure on an adjacent site. An accessory building or structure constructed of combustible materials shall be located no closer than five (5) feet (1.5 m) from the site line of an adjoining site. f. The literal application of the provisions of the Code for required minimum yard setback will result in an undue hardship on the property owners and would otherwise prohibit the use of the petitioned property as others are used in the surrounding neighborhood. g. The variance requested will not result in any encroachment into any access/utility easement or other common area. h. The variance requested will not conflict with any other provision of this Code. NOW, THEREFORE, BE IT ORDERED by the Planning & Development Services Director: A. Pursuant to Section 10.01.14C., LDC, the 2023 St Lucie Blvd, Unit 188 — Neprud Front Setback Administrative Variance is hereby approved as described herein. The administrative variance approval provides the setback variance for the specific footprint and the type of structure shown on the approved survey; depicted herein as Exhibit "A" does not reduce or waive any other required setbacks for any future structures or additions. The variance remains for the type of structure in the specific footprint in perpetuity and runs with the land. B. The property on which this approval is being granted is generally described as: Legal Description: WHISPERING CREEK CO-OP (OR 1469-2744) UNIT 188 Parcel ID: 1433-504-0160-000-9 C. This Order shall become effective upon the date indicated below. An appeal from the Planning & Development Services Director's action may be submitted within thirty (30) days, in accordance with Section 10.01.14.C.9. of the St. Lucie County Land Development Code.
