HomeMy WebLinkAbout26-107 RESOLUTION NO. 26-107 A RESOLUTION AMENDING RESOLUTION NO. 20-251, TO AMEND THE POLICY FOR DISPOSITION OF INDIGENT AND UNCLAIMED BODIES BY AMENDING THE PAYMENT SCHEDULE FOR FUNERAL HOME SERVICES;AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Sections 406.50 and 406.52, Florida Statutes, require the County to assume responsibility for the burial or cremation of the remains of unclaimed and indigent persons when the death occurs, or which remains were found, within the County and the State of Florida Anatomical Board does not accept the body; and 2. Section 406.52, Florida Statutes, further designates the Board of County Commissioners as a legally authorized person as defined in Section 497.005, Florida Statutes, for the purposes of authorizing cremation of such bodies; and 3. On September 23, 2003, the Board adopted Resolution No. 03-248, which established the St. Lucie County policy, including related fees, for disposition of indigent and unclaimed bodies and codified the County's long-standing practices regarding the disposition of such bodies; and 4. On November 10, 2020, the Board adopted Resolution No. 20-251, which amended Resolution No. 03-248 to increase the payment schedule for funeral home services for decedents over two years of age from $500 to $750; and 5. The Medical Examiner's Office has updated its policies, and effective immediately, will no longer issue cremation fee credits for unclaimed and indigent cases if a funeral home is reimbursed by the County for those services; and 6. Local funeral homes have requested that the payment schedule be increased due to the change; and 7. It is appropriate and necessary to further amend the payment schedule for funeral home services to account for the additional cremation authorization fee and to continue the County's ability to provide for the disposition of indigent and unclaimed bodies. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, that Resolution No. 20-251, is hereby amended as follows: 1. The St. Lucie County Cremation/Burial Policy and Procedures are amended to read as follows: II. Procedures Payment Schedule for Funeral Home Services: The maximum amounts that the County will pay for services are as follows: Decedents ages 0 to 24 months: $35.00 Decedents ages 2+years: $800.00 2. Except as amended herein, all other provisions of Resolution No. 20-251 shall remain in full force and effect. 3. This Resolution shall take effect upon the date of adoption.
