A RESOLUTION BY THE ST. LUCIE COUNTY BOARD OF COUNTY
COMMISSIONERS AMENDING THE ADOPTED FEES AND CHARGES FOR
BUILDING PERMITS, REVIEWS, AND INSPECTIONS; IMPLEMENTING
CERTAIN BUILDING PERMIT EXEMPTIONSREQUIRED BY CHAPTER 2026-
63, LAWS OF FLORIDA (HB 803), INCLUDING PERCENTAGE -BASED
PRIVATE PROVIDER FEE REDUCTIONS, LIMITATIONS ON INSPECTION
AND REINSPECTION FEES, AND AN EXEMPTION FROM BUILDING
PERMIT REQUIREMENTS FOR CERTIVAN WORK VALUED AT LESS THAN
$7,500 ON PROPERTY CONTAINING A SINGLE-FAMILY DWELLING;
ESTABLISHING AN EXEMPTION PROCESSING FEE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida has made the
following determinations:
WHEREAS, Chapter 125, F.S., provides for the enforcement of the Florida Building Code and
authorizes enforcement of local technical amendments to the Florida Building Code; and
WHEREAS, Chapter 553, F.S., provides for the uniform adoption, updating, amendment,
interpretation, and enforcement of a single, unified state building code, called the Florida Building Code;
and
WHEREAS, Section 125.56, F.S., authorizes the Board of County Commissioners to establish a
schedule of reasonable inspection fees in order to defer the costs of inspection and enforcement of the
provisions of this act, and of the Florida Building Code; and
WHEREAS, Chapter 125, F.S., authorizes the collection of fees necessary to perform
governmental operations and services; and
WHEREAS, Section 125.01, F.S., and the St. Lucie County Land Development Code Section
11.12.00 authorize this Board to establish a schedule of fees in order to cover the costs of technical and
administrative activities required pursuant to the St. Lucie County Land Development Code; and
WHEREAS, Section 553.80(7)(a)2., Florida Statutes, authorizes local governments to use
building permit fee revenues for activities related to the enforcement of the Florida Building Code,
including but not limited to the construction and renovation of facilities, purchase of hardware and
software, and training of personnel necessary to carry out such enforcement responsibilities; and
WHEREAS, the Board of County Commissioners has established a schedule of fees for building
permit functions and has periodically updated the schedule pursuant to Resolution Numbers 89-022; 94-
128; 98-154; 99-020; 01-108; 01-132; 02-040; 02-087; 06-171; 13-196; 20-
2011; 24-053; 25-93; and 2026-39; and
WHEREAS, Chapter 2026-63, Laws of Florida (CS/CS/HB 803), amends sections 553.79 and

553.791, Florida Statutes, effective July 1, 2026; and
WHEREAS, section 553.79(1)(g), Florida Statutes, requires a local government that issues
building permits to exempt an owner of a single-family dwelling or the owner's contractor from the
requirement to obtain a building permit to perform qualifying work valued at less than seven thousand
five hundred dollars ($7,500) on the owner's property; and
WHEREAS, the statutory exemption does not apply to work on property that is partially or
entirely located within a flood hazard area, or to electrical, plumbing, structural, mechanical, or gas work
performed on property containing a single-family dwelling; and
WHEREAS, a construction project may not be divided into multiple projects for the purpose of
qualifying for the exemption or avoiding otherwise applicable permitting requirements; and
WHEREAS, an owner or the owner's contractor seeking the exemption must submit a written
request to the County with a copy of the contract or other documentation demonstrating the nature and
value of the work to be performed; and
WHEREAS, the Board finds that a modest administrative processing fee is reasonable to recover
the County's cost of receiving, reviewing, recording, and acknowledging exemption requests without
imposing a building -permit, plans -review, or inspection fee; and
WHEREAS, section 553.79(1)(g), Florida Statutes, provides that the County has no legal duty to
the owner, contractor, or their successors or assigns for work performed pursuant to the exemption; and
WHEREAS, section 553.79(1)(f), Florida Statutes, provides that inspection fees may not be
based on the total cost of a project and may not exceed the actual inspection costs incurred by the local
enforcement agency; and
WHEREAS, section 553.791, Florida Statutes, requires a local jurisdiction to reduce permit fees
by the cost savings realized when a private provider performs plans review or building inspection services,
prohibits charges for services performed by the private provider, and authorizes only a reasonable
administrative fee based on actual County costs; and
WHEREAS, for commercial construction projects, section 553.791, Florida Statutes, requires a
reduction of at least twenty-five percent (25%) of the portion of the permit fee attributable to plans review
or inspection services performed by a private provider and at least fifty percent (50%) when the private
provider performs all required plans review and inspections; and
WHEREAS, section 553.791, Florida Statutes, authorizes private -provider fee reductions to be
calculated on a flat -fee basis, percentage basis, or by another reasonable method used by the local
enforcement agency to assess the costs of plans review and building inspection services; and
WHEREAS, the Board finds that the percentage -based reductions established in the Schedule of
Fees constitute a reasonable, uniform, and administratively workable method for calculating the fee
reductions required when a private provider performs plans -review or building -inspection services; and

WHEREAS, the Board finds that the Schedule of Fees must be revised to implement the fee -
related requirements of Chapter 2026-63, Laws of Florida, including the requirements that permit fees be
reduced when private providers perform plans -review or building -inspection services and that inspection
and reinspection fees comply with sections 553.79 and 553.791, Florida Statutes.
THEREFORE, BE IT RESOLVED, by the Board of County Commissioners for St. Lucie County
Florida:
1. The foregoing recitals are true and correct and are incorporated herein by reference.
2. The Schedule of Fees attached hereto and incorporated herein as Exhibit A is hereby adopted.
3. This Resolution supersedes Resolution No. 2026-39 and any prior resolution only to the extent of a
conflict with the Schedule of Fees adopted herein.
4. This Resolution shall take effect on the effective date.

Schedule of Fees
Fee Schedule Amended: Resolutions 01-018, 01-132 02-040, 02-087, 06-171, 13-196, 20-2011 (temporary
reduction due to COVID-19-expired), 2024-53, 2025-93, and 2026-39 and 2026-123
1. Where work for which a permit is required is started before obtaining said permit, the fees herein
specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully
complying with the requirements in the execution of the work nor from any other penalties prescribed
herein.
2. Unless otherwise stated, a Building Permit Fee is based on multiplying the value of the building or
addition by the multiplier set by resolution by the Board of County Commissioners. Such value shall
be determined by using the most recent Building Valuation Data compiled by the International
Code Council (ICC). The Efee is based on multiplying the value of the work authorized by the
permit by 0.0070. The value is determined by the Building Code Administrator. The multiplier may
be evaluated at the beginning of each fiscal year to determine anywhether modifications for- approval
byshould be presented to the Board of County Commissioners for approval. The pfee includes a
certificate of completion or occupancy., as applicable. The valuation -based permit fee is a fee
supporting_permitting administration and does not include any inspection or plan review fees. Any
separately imposed inspection fee shall not be based on the total cost of the project and shall not
exceed the County's actual cost of performin tg he inspection.
BUILDING PERMIT EXEMPTION FOR CERTAIN WORK VALUED AT LESS THAN $7,500:
Pursuant to section 553.79(1)(g), Florida Statutes, an owner of a single-family dwelling or the owner's
contractor is exempt from the requirement to obtain a building permit to perform qualifying work valued
at less than seven thousand five hundred dollars ($7,500) on the owner's prope , subject to the following_
1. Excluded Work and Property. The exemption does not apply to work on Property that is partially
or entirely located within a flood hazard area, as defined by the Florida Building Code, or to
electrical, plumbing, structural, mechanical, or gas work performed.
2. No Project Splitting. A construction project may not be divided into multiple projects for the
purpose of qualifying for the exemption or avoiding otherwise applicable permitting requirements.
3. Written Request and Documentation. Before commencing work under the exemption, the owner
or the owner's contractor shall submit a written request to the Building & Code Regulation
Division with a copy of the contract or other documentation demonstrating the nature and scope
of the proposed work and that the total value of the work is less than seven thousand five hundred
dollars ($7,500).
4 Exemption Request Processing Fee. A nonrefundable administrative processing fee of seventy-
five dollars ($75.00) shall be paid when the written request is submitted. The fee compensates the
County solely for receiving reviewing recording, and issuing an acknowledgment of the
exemption request The fee is not a building -permit plans -review, or inspection fee and does not
authorize or require the County to perform building -code plans review or inspection of the exempt
work.
5. Eligibility Review and Acknowledgment. The County may review the request and supporting
documentation solely to determine whether the submitted information demonstrates eli ig bility for
the exemption. The County's acknowledgment does not constitute approval of the design1
construction, workmanship, or code compliance of the exempt work.
6. Other Applicable Requirements. The exemption from the building -permit requirement does not
exempt the property or work from otherwise applicable zoning, setback, easement, drainage,
environmental, contractor -licensing, homeowners' association, or other legal requirements.
7. No County Duty or Representation. The County's receipt, review, acknowledgment, or recording
of an exemption request does not create a duty to inspect the work or constitute a representation
that the work complies with the Florida Building Code or other applicable law. The Cogn1y has no
legal duty to the owner, contractor, or their successors or assigns for work performed pursuant to
the exemption.
8. Statutory Control. If this section conflicts with section 553.79(1)(g), Florida Statutes, the statute

AUTOMATED BUILDING PERMIT FEE. -
All building permits, certificates or other permits issued or authorized by the Planning & Development
Services, Building & Code Regulation Division shall be subject to a five dollar ($5.00) administrative
charge. This charge is not a plans -review or inspection fee and supports generally applicable building -
code administration and enforcement functions that the County continues to perform, including on private
provider permits.
Funds collected pursuant to this fee shall be deposited into a separate trust account and shall be used solely
for activities related to the enforcement of the Florida Building Code, consistent with §553.80(7)(a)2.,
Florida Statutes. Such authorized uses may include, but are not limited to:
• Acquisition, implementation, maintenance, upgrading, or replacement of automated building
permit software and related information management systems;
• Purchase or replacement of computer hardware and technology necessary to support building code
enforcement activities;
• Geastmetion, renovation, e mt of faeilifies used for- building eede enfer-eement
epos
• Training of personnel engaged in the review, processing, inspection, and enforcement of building
permits and related functions.
Funds collected shall not be used for purposes unrelated to the administration and enforcement of the
Florida Building Code
PRIVATE PROVIDER PERMIT FEES.
When a fee owner or the fee owner's contractor retains a private provider pursuant to section 553.791,
Florida Statutes the following fee reductions and limitations apply:
1 Fee Reduction. Any inspection or plan review fees charged for such services, as shown by
separate line items on each permit application will be reduced by 100% when a fee owner, or their
contractor, elects to use a private provider in accordance with F.S. 553.791 to perform these
services.
2 Administrative Charges No separate private -provider administrative fee shall be imposed. The
County may retain generally applicable fees attributable to permit intake, completeness review,
issuance records management statutory oversight, and other administrative or enforcement
functions actually performed by the County.
3. Surcharges. The surcharge required by section 553.721, Florida Statutes, shall be calculated using
the permit fee after application of the applicable private -provider reduction.
4. Registration and Representative Changes. No fee shall be charged to register aprivate provider
or a private -provider firm, update registration information, or change a duly authorized
representative identified for a private -provider project. A change in the duly authorized
representative does not require a permit revision.
5. Reinspection and Reaudit Fees. The County shall not charge a reinspection or reaudit fee as a
result of a County audit inspection occurring before the private provider's inspection or for an
administrative matter that does not involve detection of a violation of the Florida Building Code
or an applicable permit requirement.
6. Statutory Control. If this Schedule conflicts with section 553.791, Florida Statutes, the statute
controls.
