LUCIE COUNTY GRANTING A MAJOR SITE PLAN TO DEVELOP A 319 SINGLE-FAMILY DETACHED UNIT SUBDIVISION FOR A PROJECT TO BE KNOWN AS SERENOA WITHIN THE PUD (PLANNED UNIT DEVELOPMENT) ZONING DISTRICT ON +/-114.85 ACRES OF PROPERTY LOCATED SOUTH OF ANGLE ROAD AND EAST OF FLORIDA'S TURNPIKE IN UNINCORPORATED ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report and traffic analysis review, has made the following determinations: 1. Cotleur & Hearing, on behalf of property owners Gustavo Tellez and Lilia C. Fandino, presented a Major Site Plan application to develop a 319-unit detached single-family subdivision, along with drainage and utility infrastructure, amenities, preserve, and buffers within the PUD(Planned Unit Development) Zoning District for a project known as the Serenoa PUD, bounded by Florida's Turnpike on the west, Angle Rd on the north, Old FFA Rd. on the east, and Canal No. 43 on the south, in unincorporated St. Lucie County, Florida, as legally described in Part "B" and depicted on the attached map as Exhibit "A". 2. On May 6, 2025, the Board of County Commissioners granted the PUD Rezoning & Preliminary PUD Plan approval, with conditions, via Resolution 2025-108, for the subject parcels. 3. On June 2, 2026, this Board held a public meeting on this petition. 4. The Development Review Committee has reviewed the Major Site Plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, and Section 11.02.05. B. of the St. Lucie County Land Development Code. 5. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services Department memorandum titled Serenoa (FKA NVR Ryan Homes) PUD Final Site Plan — MJSP- 25-6-000139, dated May 27, 2026. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed conditional use on the immediate vicinity through site design, landscaping, and screening. 7. The proposed Major Site Plan, with conditions therein, will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and Resolution No. 2026-106 File No.: MJSP-2506-000139 Page 2 general welfare. 8. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Site Plan is hereby approved as shown on the drawing prepared by Cotleur & Hearing, dated August 11, 2023 with revision date of June 2, 2026, for the property described in Part "B" below, subject to the following conditions: 1) Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the following shall occur: a. a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03; and b. the developer shall provide an executed Conservation Easement over the onsite preserve area, along with the approved Preserve Area Monitoring and Management Plan (PAMMP), with an attached affidavit and cashier's check (payable to the Clerk of the Court for recording fees) to the County Attorney. C. The applicant shall also provide a georeferenced GIS shapefile or CAD file of the conservation easement boundaries to St. Lucie County. d. Listed species surveys shall be updated as necessary per individual species -specific requirements or written correspondence stating any potential impacts have been resolved from the appropriate state and federal agency. If any listed species impacts are found to be present as a result of these updated surveys, appropriate mitigative measures per state and federal agency requirements shall be provided prior to initiation of any clearing activities. e. An Environmental Resource Permit (ERP) from South Florida Water Management District (SFWMD) shall be provided to verify the limits of the wetlands. Should the limits of the wetland substantially deviate from the environmental consultant's delineation, a new Wetland Waiver application shall be submitted in accordance with Comprehensive Plan Policy 6.1.14.4. 2) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. 3) Prior to the 60th certificate of occupancy, of Phase 2 (western pod), a multi -use path between the eastern and western pods across Arterial A shall be constructed. Prior to the final certifications for Phase 1 close-out, 60% of the linear park improvements shall be completed. 4) The Amenity Plan for common areas shall be submitted to, reviewed by, and require approval by the Planning & Development Services Director prior to issuance of the first residential Certificate of Occupancy. At least one Amenity Parcel and associated features, planned to serve the entire development, shall be Resolution No. 2026-106 File No.: MJSP-2506-000139 Page 3 completed or adequate security posted prior to the issuance of building permits of more than 40% of the approved 128 units. 5) Lot and spatial differentiation standards shall include the requirement that at least one of every five consecutive lots shall have a front fagade positioned (plane variation) at least five feet forward or behind the adjacent setback line. Minimum driveway depth remains 22 feet. 6) Prior to issuance of building permits for residential units, the Applicant shall integrate alternative home planting plans, to reduce visual monotony between lots. 7) Proposed pet waste stations may be relocated (except for at the Preserve entrances and amenity centers) to provide for more strategic locations that serve more homes, to be located in common areas including drainage easements. At least two additional pet waste stations shall be provided to the Plan (currently 14) prior to the final residential Certificate of Occupancy. 8) In accordance with the Site Plan, the developer(s), successors in interest, or assigns shall: a. be required to improve Angle Road from the project's access point to the nearest road, in accordance with the limits on the plans; b. Improve Old FFA Rd., from Angle Road to the southern property line, concurrent with development of this community or provide payment -in -lieu (proportionate share contribution for the project's frontage); C. provide for a secondary connection to Old FFA Rd., sited to ensure compliance with the County' s minimum access design and separation standards, within 365 days of such time that Old FFA Rd. is paved and connects to the County's Road system to the south; and d. install and maintain the Turnpike and Arterial A buffers which are to utilize the planting arrangement detailed in the Typical Buffer Enhancement Exhibit and shall cover the entire width and depth of buffers. These buffers shall be planted at the time the adjacent development infrastructure is installed and shall achieve the closed forest effect and 90% opacity within two years, with general utilization of this enhanced planting set along the northwest property line of the west pod to help to buffer the existing Angle Rd. single-family residence to the west. 9) The dedication shall be accompanied by a maintenance and access agreement for Arterial A between the County and the Developer. 10) Prior to issuance of the first Certificate of Occupancy, the applicant, property owner, developer, successors, or assigns, shall convey to St. Lucie County, in a manner or form acceptable to the County Attorney, 35' of right-of-way along Angle Road and 160' feet of right-of-way for Arterial A. Based on the Applicant's commitment, the Developer/Applicant shall forego impact fee credits for the Arterial A land donation. 11) A minimum six-foot wide sidewalk shall be provided along each phase frontage of Angle Road, and Phase 2 frontage on Old FFA. The Board of County Commissioners may authorize the applicant to pay a Fee -in -Lieu of construction of the sidewalk. Should an access point to Old FFA be achieved by the project Resolution No. 2026-106 File No.: MJSP-2506-000139 Page 4 during Phase 2 development, a sidewalk shall be installed (not paid -in -lieu) from this access point to Old FFA north to Angle Road along this portion of frontage. Prior to issuance of the Site Development Permit, the final cross section(s), including the canal and adjacent property as applicable to this extension shall be depicted. 12) A Road Improvement Agreement and appropriate bond will be required for all permanent improvements within the Right -of -Way. 13) A Site Development Permit is required prior to performing site improvement activities. 14) For plat approval prior to completion of required improvements, a Subdivision Improvement Agreement and appropriate bonding is required. 15) A Revocable License agreement or other method acceptable to the Public Works Director and County Attorney will be required for the proposed utilities crossing the future Arterial A Right -of -Way. 16) The stormwater runoff from the public right of way splitting the site is noted to be collected within the onsite stormwater system. An easement would be required over the stormwater system allowing the County the right, but not the obligation to access the system for emergency repairs/maintenance. B. This Major Site Plan for the Serenoa PUD shall expire within 24 months of the effective date of this order unless a building permit is issued, or an extension is granted in accordance with the provision of Land Development Code Section 11.02.06. D. The developer is advised as part of this Major Site Plan approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part "A" are an integral non -severable part of the Site Plan approval granted by this Resolution. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Resolution shall become null and void. F. A Concurrency Certificate, signed by the Planning & Development Services Directory on May 28, 2026, is attached as Exhibit C and made a part of the Resolution. G. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. H. This Order shall become effective upon the date indicated below. An appeal of the Board of County Commissioners' action may be processed within thirty (30) days in accordance with Section 11.11.02.F, of the St. Lucie County Land Development Code. This Resolution shall be recorded in the Public Records of St. Lucie County.
