FENCE (WALL) IN THE REAR YARD OF CERTAIN PROPERTY ABUTTING THE FLORIDA EAST COAST RAILWAY RIGHT-OF-WAY (ROW) LOCATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County, Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Denley and Sally Daw petitioned for a variance from Section 8.00.04.(B.)(2.) — Fences, Walls and Hedges of the St. Lucie County Land Development Code to allow for an 8 ft. tall fence (wall) to be permitted (after the fact) on the west side of the property, located at 5505 S Indian River Drive, in the RE-2 (Residential, Estate—2) Zoning District. 2. On July 22, 2026, this Board held a public hearing on the petition, after publishing a notice of such hearing, installing a sign on the property, and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including that of the petitioners' representative, staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: a. The granting of the 8 ft. tall fence variance arises from conditions that are unique and peculiar to the subject property due to its proximity to the FEC Right-of-Way (ROW). The addition of Brightline passenger rail service, combined with existing freight train operations and facilities immediately adjacent to the property, represents an intensified rail corridor condition that is not commonly found in similar RE-2-zoned parcels other than along Indian River Drive. b. Granting the requested fence variance could potentially affect neighboring properties by obstructing light, air, or existing views; however, the increased fence height may also provide measurable benefits by reducing the visual and noise impacts associated with passing trains along this corridor. Furthermore, the variance is not expected to increase the danger of fire, substantially contribute to congestion on public streets, endanger public safety, or significantly diminish or impair property values within the surrounding neighborhood. c. The variance requested is the minimum variance that will make possible the reasonable use of the land, in that the property slopes downward from west to east by approximately six feet, which allows for an elevated view of the site when standing on or near the railroad tracks. The railroad grade itself is raised an additional two feet, July 22,2026 BOA Resolution No.2026-008 File No.VAR-2604-000071 Page 1 further increasing the height differential. As a result, a six-foot-tall fence would provide only about four feet of effective screening, whereas an eight-foot-tall fence will offer improved reduction of sound, vibration, and visibility from passing trains. d. The variance requested will not be opposed to the general spirit and intent of the St. Lucie County Land Development Code or Comprehensive Plan. Although the Code limits fence height in residential districts to six feet, the subject parcel's unique adjacency to the privately owned Florida East Coast Railway Right-of-Way creates buffering and compatibility needs comparable to situations where the Code already allows increased height. The previously constructed eight-foot fence (wall) will improve safety, privacy, and noise mitigation for the residence without negatively impacting neighboring properties or community character. Therefore, the request is consistent with the intent of the Code's fence height provisions and supports the Comprehensive Plan's goals for protecting residential areas and promoting compatible land use transitions. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. The petition of Denley and Sally Daw requests a fence (wall) height variance from Section 8.00.04.(B.)(2.)—Fences, Walls and Hedges of the St. Lucie County Land Development Code to allow for an 8 ft tall fence (wall) to be permitted (after the fact) on the west side of the property, for the property depicted on the attached on the boundary survey created by NexGen Surveying, a Florida Licensed Surveyor and Mapper, dated October 07, 2025, as Exhibit "A" and "B" and that variance is approved as subject to the following conditions: I. The applicant shall resolve outstanding review comments by the County's Surveyor listed in the Plans Correction Report — (VAR-2604-000071) prior to the after-the-fact permit on file being issued for the 8-foot-tall fence on the subject property. 2. An After-the-Fact Vegetation Removal Permit shall be obtained for vegetation previously cleared without an ERD permit within sixty (60) days of the variance approval. B. The petition site is described and located as follows: Legal: PLAT OF S 614.21 FT OF GOVT LOT 1 OF SEC 1-36-40 N 164.11 FT OF S 264.11 FT. LYG E OF FEC RR-LESS RD R/W- Address: 5505 S. This Resolution shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action must be filed with the courts of the State of Florida within thirty(30) days following the rendition of the decision of this Order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code.
