LUCIE COUNTY APPROVING A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07. OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. LJA Engineering, Inc., on behalf of Gerald & Iris Concannon, submitted a waiver request regarding the paved access and fair share contribution requirements applicable to the proposed subdivision of property located at 13450 Williams Road. The property is located approximately 0.75 miles west of the southern end of the currently paved section of McCarty Road. 2 The applicant proposes to subdivide two (2) existing parcels totaling 35.28 acres, into four (4) parcels with access from Williams Road, a County-maintained, unpaved roadway. A proposed site plan has been reviewed and deemed appropriate for continued processing towards the agricultural subdivision. 3. Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Public Works Memorandum titled "Paving Waiver Request— Williams Road," dated July 7, 2026. 4. On July 21, 2026, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners hereby approves the requested Paving Waiver and elected to waive the fair share contribution based on the minimal traffic impacts generated by the proposed development, subject to the following condition: 1. The developer shall include language on the final plat stating that the owners, heirs and assigns of the lots indicated on the proposed plat agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Williams Road, where abutting either. The property for which this paving waiver is approved is described as follows: LEGAL DESCRIPTION That part of the Northwest Quarter of the Southwest Quarter of Section 8, Township 36 South, Range 39 East, St. Lucie County, Florida, more particularly described as follows: From the intersection of the East right of way line of Canal No. 87 and the North right of way line of Williams Road, run South 89' 19' 17" East along said North road right of way line 638.17 feet to the Point of Beginning; thence continue South 890 19' 17' East 638.17 feet; thence North 000 17' 09" West 1203.34 feet to the South right of way line of Canal No. 88; thence North 890 18' 01"West along the South right of way line 638.95 feet; thence South 000 17' 09" East 1203.34 feet to the North right of way line of Williams Road and the Point of Beginning. AND Parcel of land lying and being in Section 8, Township 36 South, Range 39 East, in St. Lucie County, Florida being more particularly described as: That part of the Northwest 1/4 of Southwest 1/4, more particularly described as follows: Beginning at the intersection of East right of way line of Canal No. 87 and North road right of way line of Williams Road run South 89019'17" East along North road right of way line 638.17 feet; thence North 0001 T09" West 1203.34 feet to South right of way line of Canal Road No. 88; thence North 89018'01" West along South right of way line 638.95 feet to East right of way line of Canal No. 87; thence South 00021'37" East along East right of way line 1203.84 feet to North road right of way of Williams Road and Point of Beginning. A copy of this Resolution shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the applicants and agent of record as identified on the paving waiver application.
