LUCIE COUNTY APPROVING A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07. OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Tod Mowery, AICP, of Redtail DG, Inc., on behalf of BLC Land, LLC, submitted a waiver request regarding the paved access and fair share contribution requirements applicable to the proposed subdivision of property located at 18496 Kelly Road, Fort Pierce, FL, 34945. The property is located approximately +/- 0.50 miles west of the northwest corner of Kelly Road and S. Header Canal Road. 2 On July 11, 2023, the Board of County Commissioners approved Resolution No. 2023- 115, granting a road paving waiver for a subdivision of a 195-acre tract into seven (7) lots fronting Pineapple Lane and Kelly Road. 3. On November 27, 2023, the Planning and Development Services Director approved PDS Order No. 2023-087, authorizing a Minor Site Plan to subdivide a 194.93-acre property into five (5) parcels. 4. On May 1, 2024, the Pineapple Kelly Plat was recorded in Plat Book 124, Page 17, creating the subject parcel as Lot A. 5. The applicant proposes to subdivide a 113.008-acre parcel (identified as Lot A of the Pineapple Kelly Plat) into three (3) parcels with shared access from Kelly Road. Kelly Road and Pineapple Lane are County -maintained, unpaved roadways. A proposed site plan has been reviewed and deemed appropriate for continued processing towards the agricultural subdivision. 6. Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Public Works Memorandum titled "Paving Waiver Request — Kelly Road & Pineapple Lane", dated July 7, 2026. 7. On July 21, 2026, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. Page 1 Resolution No. 2026-129 File No. RPW-2606-000002 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners hereby approves the requested Paving Waiver and elected to waive the fair share contribution based on the minimal traffic impacts generated by the proposed development, subject to the following condition: 1. The developer shall include language on the final plat stating that the owners, heirs and assigns of the lots indicated on the proposed plat agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Kelly Road and Pineapple Lane, where abutting either. B. The property for which this paving waiver is approved is described as follows: LEGAL DESCRIPTION LOT "A" AS SHOWN ON THE PLAT OF PINEAPPLE KELLY, AS RECORDED IN PLAT BOOK 124, PAGES 17 AND 18, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING 4,922,633.74 SQUARE FEET OR 113.008 ACRES, MORE OR LESS. ADDRESS: 18496 Kelly Road, Fort Pierce, FL, 34945 PARCEL I.D. NO.: 2214-700-0001-000-9 C. A copy of this Resolution shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the applicant and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
