LUCIE COUNTY, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Site Plan submitted by District Planning Group, LLC on behalf of Buc-ee's Ft. Pierce, LLC, and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. Buc-ee's Ft. Pierce, LLC, a Delaware limited liability company, applied for approval of a Minor Site Plan to permit construction of a 76,245 sq. ft. one-story, travel center retail store, 120 vehicle fueling stations with overhead canopies, 786 parking spaces and two (2) loading areas, three (3) outparcel lots, stormwater management, landscaping, electric vehicle charging stations, fuel storage tanks, interstate side pylon sign, and off- site roadway improvements on the land depicted on Exhibit A and described in Part A. 2. On September 17, 2024, the Board of County Commissioners adopted Resolution 2024- 171 approving the rezoning of the subject property from the AG-1 (Agricultural-1 Zoning District) and the PTV (Planned Towns and Villages) Zoning District to the PRW(Planned Retail Workplace) Zoning District and a Preliminary Regulating Plan/Preliminary Development Plan for the subject site. 3. The St. Lucie County Development Review Committee has reviewed the Minor Site Plan, as depicted on Exhibit C, and found it to meet all technical requirements, subject to the conditions set forth in Part B of this Order. 4. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 7. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 8. The Minor Site Plan/Final Development Plan is in substantial conformity with the approved Preliminary Regulating Plan/Preliminary Development Plan. Pursuant to Section 11.02.03. of the St. Lucie County Land Development Code, the proposed Minor Site Plan known as Buc-ee's, as shown on the site plan drawings prepared by Kimley-Horn and Associates, Inc., and signed and sealed by Christopher J. Hollen, on June 16, 2026, and received by the St. Lucie County Planning & Development Services Department on June 16, 2026, and as depicted in Exhibit C, is hereby approved, subject to the following conditions: Environmental Resources Department 1. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the following shall be accomplished: a. A Vegetation Removal Permit or Exemption shall be obtained from the Environmental Resources Department per LDC 6.00.03. b. An updated 100% gopher tortoise survey conducted by a state certified gopher tortoise agent will be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol, as these surveys are only valid for 90 days. c. Applicant shall pay any required County tree mitigation fees prior to issuance of the building permit. d. The Applicant or its successor or assigns shall conduct a pre-construction meeting with construction personnel, all applicable state and federal regulatory agencies, and Environmental Resources Department staff to verify vegetation protection measures have been installed. 2. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. Property Acquisitions Department 3. Prior to installation of landscaping in the public right-of-way, the Applicant, property owner, developer, successors, or assigns shall obtain a revocable license agreement for the proposed landscaping within the future County right-of-way of Koblegard Road. 4. Until such time as a MSTU (Municipal Services Taxing Unit), a MSBU (Municipal Services Benefits Unit) or other SAD (Special Assessment District) is in effect that includes the operation and maintenance of the street lighting on Koblegard Road, south of Indrio Road, the operation and maintenance of the street lighting, including the cost PDS Order 2026-056 Page 4 of 11 File No.: MNSP-2501-000153 of power for such lighting, for the length of its frontage on Koblegard Road, shall be the responsibility of the Applicant and its successors in interest. Public Works Department, Engineering Division 5. A Site Development Permit is required prior to performing site improvement activities. In accordance with the Land Development Code and permit requirements, the Applicant shall retain the Engineer of Record for site inspections and final certification. 6. A Road Improvement Agreement and appropriate bond are required for all permanent improvements within the Right-of-Way. 7. For Plat approval prior to completion of required improvements, a Subdivision Improvement Agreement and appropriate bonding is required. Planning and Development Services, Building Division 8. The Applicant shall hold a pre-application meeting with the Building Division of Planning and Development Services Department for this project due to the size and multiple permits required. The primary permit will be for the core retail structure. Additional stand-alone permits will be required for, but not limited to, the: grease recycling enclosure; lift station, bike parking, electrical vehicle charging stations, trash compactor, fuel station canopy, fuel pumps, tank pit pad, underground fuel tanks, site lighting with underground electrical, fencing, and handicap parking and ADA access. Planning and Development Services, Planning Division 9. A Final Record Plat, encompassing the subject development and providing for division from the Indrio and 195 PTV, shall be submitted for review and approval prior to commencement of vertical construction. The Final Record Plat shall be recorded prior to issuance of a Certificate of Occupancy. At the sole discretion of the County Building Official, a Stocking Certificate, permitting occupancy by employees for the purpose of stocking merchandise, or a Temporary Certificate of Occupancy, permitting entry by the general public, may be issued prior to the recording of the Plat. 10. Koblegard Road and Indrio Road shall be improved as provided in the construction plans provided by Kimley-Horn and Associates, Inc., and signed and sealed by Eric J. Klier, P.E., on June 15, 2026. These improvements include the following: a. Construct approximately 1,250 feet of Koblegard Road as a 4-lane facility from lndrio Road south to the project's southern boundary including a roundabout and including the traffic signal and mast arm modifications for northbound traffic at the Koblegard and lndrio Road intersection, including: i. Two (2) left-turn lanes ii. One (1) through lane iii. One (1) right-turn lane PDS Order 2026-056 Page 5 of 11 File No.: MNSP-2501-000153 b. Southbound on Koblegard Road at Indrio Road - Construct an additional south- bound left-turn lane and restripe the south-bound through lane/left turn lane to convert to a southbound through lane. c. Eastbound on Indrio Road at Koblegard Road - Add one dedicated right-turn lane (length as determined by the Florida Department of Transportation (FDOT)). d. Westbound on Indrio Road at Koblegard Road - Extend the westbound left-turn lane to 615 feet (including 50 feet taper). e. An eastbound right-turn lane (as reviewed and permitted by FDOT) shall be constructed on Indrio Road to Buc-ee's Driveway. 11. Improvements, as reviewed and permitted by the FDOT, shall be made to the 195 north-bound and south-bound off-ramps at Indrio Road, as provided in the construction plans provided by Kimley-Horn and Associates, Inc., and signed and sealed by Eric J. Klier, P.E., on June 15, 2026. These improvements include the following: a. On northbound 195 Off-Ramp: Construct the 2nd northbound right-turn lane and urbanize the northbound right-turn off ramp. b. On the southbound 1-95 Off-Ramp, mill and resurface approximately 550 feet, as reviewed and approved by FDOT. c. Coordinate the traffic signals at Indrio Road and the 1-95 SB off-ramp and Indrio Road and the 1-95 NB off-ramp with each other. 12. The off-site transportation improvements described in paragraphs 9 and 10 above, shall be completed and accepted by St. Lucie County or FDOT, as applicable, prior to the issuance of a Certificate of Occupancy for the retail store or gas station. At the sole discretion of the County Building Official, a Stocking Certificate, permitting occupancy by employees for the purpose of stocking merchandise, or a Temporary Certificate of Occupancy, permitting entry by the general public, may be issued prior to the completion of the roadway improvements. 13. The development of Outparcel Tracts 2, 3 and 4 shall be accomplished in a form and manner advancing the traditional neighborhood design envisioned for the TVC through eligible lot types. Parking on said lots is anticipated to be located on the west side facing Buc-ee' s vehicle fueling and parking and the buildings located adjacent to the eastern property line(s). 14. Prior to issuance of the associated building permit, the proposed pylon sign to be sited within the Airport Overlay Zone shall receive any applicable authorizations from the Airport Director for the Treasure Coast International Airport. 15. Prior to issuance of the associated building permit, the location of the pylon sign shall be adjusted approximately seven (7) feet to the east, so the leading edge of the sign is PDS Order 2026-056 Page 6 of 11 File No.: MNSP-2501-000153 25 ft. from the property line as required by LDC 3.01.03.GG.2.n.(4) and LDC 9.02.01. D.2. C. The approvals and authorizations granted by this Order shall expire twenty-four (24) months after approval, unless a building or site development permit is secured, or a site plan extension is granted in accordance with Section 11.02.06.B.2., St. Lucie County LDC. D. The developer is advised as part of this Minor Site Plan Approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Federal Aviation Administration, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this Site Plan approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning & Development Services Department Director on August 3, 2026. G. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "B" above, all such appeals must be filed in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.04.D., St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. H. A recorded copy of this Order shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
