LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a development order extension timely submitted by Insite Studio, Inc., on behalf of SCG-National Navy Association, Inc. aba National UDT-SEAL Museum (property owners Tr Int Imp Trust Fund), and has made the following determinations: 1. On January 27, 2011, the Planning & Development Services Director approved PDS Order 11-011, granting a Minor Site Plan for an 8,400 square foot addition. 2. On May 3, 2013, the Planning & Development Services Director approved a Minor Adjustment to a Minor Site Plan for a display area and modification to the stormwater retention areas. 3. On July 15, 2014, the Planning & Development Services Director approved a Minor Adjustment to a Minor Site Plan to construct an entry addition (214 sq. ft.) and install an obstacle course. 4. On April 22, 2025, the Board of County Commissioners approved Resolution No. 2025- 055, granting a Conditional Use to expand the National Navy UDT-SEAL Museum and operations. 5. On June 5, 2025, the Planning & Development Services Director approved PDS Order No. 2025-049, a Major Adjustment to a Minor Site Plan to construct a two-story, 30,747- square-foot museum expansion with an open-air terrace level. The proposed facility would include exhibit space, offices, a conference room, and an event space within the Institutional Zoning District. 6. On May 29, 2025, Governor DeSantis issued Executive Order 25-119 for sixty (60) days due to the threat of Hurricane Milton to the residents of the State of Florida. The order has been continually extended for sixty (60) days pursuant to Executive Orders 25-150, 25- 191, 25-242, 26-16, 26-74, and 26-110, which extended the State of Emergency to July 20, 2026. The deadline for filing an extension notification is September 18, 2026. 7. On June 8, 2026, Zach Kepler of Insite Studio, Inc., on behalf of National Navy Association, Inc. aba National UDT-SEAL Museum, filed a request to toll and extend the File No.: EDO-2606-000074 PDS Order 2026-052 Page: 1 termination date for the project known as National Navy UDT-SEAL Museum pursuant to Executive Order 26-110 (Hurricane Milton). 8. Senate Bill 250, approved by the Governor on June 28, 2023, and effective July 1, 2023, amended Section 252.363(1)(a) Florida Statutes, increasing the extension of the expiration dates for such permits or other authorizations to twenty-four (24) months per state of emergency (plus the duration of the emergency declaration, accounting for the date of the order approval), but limiting the extended period under overlapping states of emergency to forty-eight (48) months. 9. Section 252.363 Florida Statutes requires that a specific written notice be filed with the issuing authority within ninety (90) days after the termination of the declaration of emergency. The applicant applied for this extension on June 8, 2026, which is within the time frame established by the Statute. 10. Planning Staff has performed an analysis of the project and determined that the extension is consistent with the original St. Lucie County Development Order. Further analysis is found in the memorandum titled National Navy UDT-SEAL Museum Expansion - Major Adjustment to a Minor Site Plan & Conditional Use (EDO-2606-000074), September 3, 2026. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 252.363 of the Florida Statutes State of Emergency Act, the administrative approval project known as National Navy UDT-SEAL Museum, has been found to be eligible for a statutory extension. The approval granted under Resolution No. 2025-055 (Conditional Use) and PDS Order 2025-049 (Major Adjustment to a Minor Site Plan) is extended from its last scheduled date of expiration, April 22, 2026, and now shall expire July 17, 2029, for the property described below in Part B. B. If any condition set forth within this Order are determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, this development order extension approval granted by this Order shall become null and void. E. The Certificate of Capacity granted by the Planning and Development Services Director shall remain valid for the period of this development order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. F.
