LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence presented, inclUding but not limited to the staff report, has made the following determinations: Liberty Baptist Church presented a petition for a Conditional Use Permit to allow for educational services as an accessory use to religious facility in the I (Institutional) Zoning District for the property described in Part A below. On August 16, 2001, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereinafter described request for a Conditional Use Permit in the I (Institutional) Zoning District for the property described in Part A below. On September 18, 2001, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. At the September 18, 2001 public hearing, and after accepting public testimony on the proposed petition, the Board continued the public hearing on this matter until October 2, 2001, at which time additional testimony and Board deliberations would continue. On October 2, 2001, the Board reconvened the public hearing on the petition and accepted additional public comments and testimony. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the File No.: CU-01-005 October 2, 2001 Resolution 01-136 Page I OR BOOK !4~9 PAGE 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 requirements of Section 11.07.03 of the St. Lucie County Land Development Code. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. The proposed project will be serviced water by FPUA (Fort Pierce Utilities Authority). Sewer services will be provided onsite through a septic system. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by the Community Development Director on October 2, 2001. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Liberty Baptist Church, Inc., of Ft. Pieme to allow for educational services as an accessory use to a religious facility in I (Institutional) Zoning District is granted for the property described below, subject to the following conditions: The approved Conditional Use Permit is fro the proposed 3.92 - acre pamel of land only. Upon development of the property, west of Dunn ' Road, owned Liberty Baptist Church, Inc. of Ft. Pierce, an additional Conditional Use Permit will be required to operate educational services. Any expansion to the square footage for the Liberty Baptist Church facility that will be used for educational purposes will result in a modification to the existing site plan and the proposed conditional use permit. The hours of operation for educational services will be limited to 8:00 a.m. until 3:00 p.m., Monday through Friday. B. The property on which this Conditional Use Permit is being granted is described as follows: File No.: CU-01-005 October 2, 2001 Resolution 01-136 Page 2 UR BOOK 1489 PAGE 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 PARCEL1: From the northwest corner of Lot 92, White City Subdivision, according to the plat thereof as recorded in Plat Book 1, Page 23, of the Public Records of St. Lucie County, Florida; run thence east along the north line of said lot, 235 feet for the point of beginning; thence continue east, 210 feet; Thence south, parallel with the west lot line, 623.02 feet, more or less, to the north right-of-way line of Midway Road; thence west, 210 feet; Thence north parallel with the west lot line, 620.70 feet, more or less, to the point of beginning; less to road right-of-way as in Official Records Book 235, Page 813 of the Public Records of St. Lucie County, Florida, and PARCEL2: From the northwest corner of Lot 92, White City Subdivision, according to the plat thereof as recorded in Plat Book 1, Page 23, of the Public Records of St. Lucie County, Florida; run thence east, 15 feet; thence south, parallel with the west lot line, 409 feet for the point of beginning; thence run east, 220 feet; thence south, parallel with said west lot line, 211.70 feet, to the north right-of-way line of Midway Road; thence west; along said north right-of-way line, 220 feet, more or less, to the east right-of-way of Dunn Road; thence north, on said east right-of-way line, 209.26 feet, more or less, to the point of beginning; less to road right-of-way as in Official Records Book 235, Page 813, of the Public Records of St. Lucie County, Florida. (Tax ID. No. 3403-502-0156-100/6). (Location: 3660 West Midway Road, northeast corner of West Midway Road and Dunn Road) The approvals and authorizations granted by this Resolution for the purpose of obtaining site plan/building permit approvals on this property, shall expire on October 2, 2002, unless the developer has obtained a site plan or building permit approval for the use described in Part A above, or an extension has been granted in accordance with Section 11.07.05(F), St. Lucie County Land Development Code. The Conditional Use Permit approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Liberty Baptist Church, Inc. of Ft. Pierce, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. Should the Conditional Use approval granted by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Land Development Code, a new certificate of capacity shall be required. The St. Lucie County Community Development Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
