LUCIE COUNTY, FLORIDA, WHICH PROJECT WAS TO BE KNOWN AS ROSE CAR WASH. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: CONDITIONAL USE PERMIT Timothy Rose, presented a petition for a Conditional Use Permit to the operation of a 2,542 square foot self-service car wash, to be known as Rose Car Wash, in the CN (Commercial, Neighborhood) Zoning District for the property described in Part B. On November 15, 2001, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners deny the hereinafter described request for a Conditional Use Permit in CN (Commercial Neighborhood) Zoning for the property described in Part B. On December 4, 2001, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed Conditional Use, the construction and operation of a self-service car wash, has been determined not to be compatible with the surrounding uses of land in the area of the property described in Part B below, with said uses including the Lakewood Park Methodist Church, the Lakewood Park residential subdivision and the small open space park to the north/northwest of the proposed site. SITE PLAN Timothy Rose presented a petition for a Site Plan approval to construct a 2,542 square foot self-service car wash, which requires a conditional use permit approval prior to the granting of any site plan approvals for the project to be known as Rose Car Wash; and to be located on the property described in Part B. Through this determination no further approval consideration of the proposed minor site plan can take place since the use depicted on this Minor Site Plan has been determined to be inappropriate for the requested location. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: CONDITIONAL USE PERMIT Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Timothy Rose to provide for the operation of a 2,542 square foot self-service car wash, to be known as Rose Car Wash, in the CN (Commercial, Neighborhood) Zoning is hereby denied. The property on which this Conditional Use Permit is being denied is described as follows: Legal Description: Lakewood Park Subdivision Unit 12A, Lots 11 & 12, Block 169 as recorded in Plat Book 11, Page 35 of the Public Records of St. Lucie County Florida. Containing 0.73 acres more or less. (Location: West side of the Sunshine State Parkwayrrurnpike Feeder Road, approximately 600 feet north of the intersection of Sunshine State Parkway and Winter Garden Parkway.) SITE PLAN Pursuant to the actions described in Part A above, the Minor Site Plan for the project to be known as Rose Car Wash is hereby denied. A copy of this resolution shall be attached to the conditional use and site plan files for the Rose Car Wash, which files shall be placed maintained in the office of the St. Lucie County Community Development Director. Further, the Community Development Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this Resolution.
