HomeMy WebLinkAboutCD-02-018 - Montoya 2 Subdivision 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 CD-02-018 (MNSP-02-o10) AN ORDER GRANTING MINOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS MONTOYA 2 SUBDIVISION WHEREAS, the St. Lucie County Community Development Director has reviewed the application for site plan approval submitted by Edwin Merritt, reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1 . An 8-lot residential subdivision has been proposed for the project to be known as Montoya 2 Subdivision on the west side of Carlton Road approximately 3/4 miles south of the intersection of Carlton Road and State Road 70. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project is to be served by onsite wells and septic systems. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land Development Code, the site plan for the project to be known as Montoya 2 SID be, and the same is hereby, approved as shown on the site plan drawings for the project prepared by James A. Kirby, on January 22, 2002 and received by the St. Lucie County Community Development Director on July 16, 2002, and the preliminary plat for the project prepared on January 22, 2002 and submitted to the St. Lucie County Community Development Director on July 16, 2002, for the property described in below: That part of the South 1/2 of Seclton 9 lying West of the West right-of-way of Carlton Road, Township 36 South, Range 38 East, St. Lucie County, Florida; Less the Canal Right-of-way. Containing 69.5 acres more or less. (Tax 10#: 3209-131-0010-000/6) (Location: West side of Carlton Road, approximately 3/4 mile south of the Intersection of Carlton Road and Midway Road) B. The approvals and authorizations granted by this CD-Order are for the purpose of obtaining final plat approval and shall expire on August 14, 2004, unless the developer has obtained final plat approval for this development, or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. o ::::0 t:O Cl o ::><:: C. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Edwin Merritt, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. ...... A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director and mailed, return receipt requested to the developer and agentof record as identified on the site plan applications. E. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. F. This order shall be recorded in the Public Records of St. Lucie County.
