LUClE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: Florida Center for Recovery, Inc., presented a petition for a conditional use permit to allow for the operation of a social services and health services (in-patient drug and alcohol abuse rehabilitation facility) in the I (Institutional) Zoning District for the property described in Part A below. On September 19, 2002, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve a conditional use permit to allow for the operation of a social services and health services (in-patient drug and alcohol abuse rehabilitation facility) in the I (Institutional) Zoning District for the property described in Part A below. On October 15, 2002, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 1 '~ .07.03 of the St. Lucie County Land Development Code. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. The proposed project will be serviced by adequate public facilities and services. A Certificate of Capacity, a copy of which is attached to this resolution, was granted bythe Community Development Director on October 15, 2002. File No.: CU-02-008 October 15, 2002 Resolution 02-155 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Florida Center for Recovery, Inc. to provide for the operation of a Social Services and Health Services use (in-patient drug and alcohol abuse rehabilitation facility) in the I (Institutional) Zoning District is granted for the property described below, subject to the following conditions: The proposed facility shall be limited to Drug and Alcohol Abuse Rehabilitation only The number of patients shall be limited to a maximum of 72. A gate shall be constructed at the entrance of the existing wall in order to provide security for the project. 4. The conditional use granted through this petition is non-transferable. The conditional use permit shall be limited to the property described in Part B below. B. The property on which this Conditional Use is being granted is described as follows: WHITE CITY S/D SECTION05, TOWNSHIP 36 SOUTH, RANGE 40 EAST. BEGINNING AT THE NORTHWEST CORNER OF LOT 100 RUN EAST 135 FEET, THENCE WEST 135 FEET, THENCE NORTH TO THE POB-LE$S ROAD AND CANAL RIGHT-OF-WAY WHITE CITY S/SECTION05, TOWNSHIP 36 SOUTH, RANGE 40 EAST. THAT PART OF LOT 106 LYING EAST OF DRAINAGE CANAL #103 - LESS THAT PART LYING NORTH OF DRAINAGE CANAL #103 - AND NORTH 130 FEET OF LOTS 112 AND 113 LYING EAST OF DRAINAGE CANAL #103 AND ALL OF LOT 107 - LESS ROAD AND CANAL RIGHT-OF-WAY. (Tax ID#: 3403-502-0046-000/1) (Location: 3451 West Midway Road) and is owned by Florida Center for Recovery, Inc., as depicted in the attached Exhibit B. The approvals and authorizations granted by this Resolution are for the purpose of obtaining a zoning compliance on this proper[y, and shall expire on October 15, 2003, unless the developer has obtained a zoning compliance or an extension is granted in accordance with Section 11.07.05(F), St. Lucie County Land Development Code. The Conditional Use Permit approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Florida Center for Recovery, Inc., shall obtain all necessary development permits and construction authorizations from the File No.: CU-02-008 Resolution 02-155 October 15, 2002 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits or zoning compliance of authorizations to commence development activities on the property described in Part B. The Conditional Use Permit approval granted through this Resolution to the petitioner, Florida Center for Recovery, Inc., is not assignable or transferable to any other individual, party or interest without the prior consent of the Board of County Commissioners, following a public hearing in accord with the Major Adjustment procedures to an Approved Conditional Use Permit as may be provided for in the St. Lucie County Land Development Code. The conditions set forth in Part A is an integral nonseverable part of the Conditional Use Permit approval granted by this resolution. If the conditions set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Conditional Use Permit approval granted by this resolution shall become null and void. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid for the period of Conditional Use approval. Should the Conditional Use approval granted by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Land Development Code, a new certificate of capacity shall be required. The St. Lucie County Community Development Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
