LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence including, but not limited to the staff report, has made the following determinations: Harold H. Smyth, presented a petition for a change in zoning from the AG-1 (Agricultural - 1 du/acre) zoning district to the IL (Industrial Light) zoning district for the property described in Part A below. On February 19, 2004, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereafter describedi request for a change in zoning from the AG-1 (Agricultural - 1 du/acre) zoning district to the IL (Industrial Light) zoning district for the property described in Part A below. On March 2, 2004, t~his Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed chadge in zoning was found not to be consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has not satisfied the requirements, of Section 11.06.03 of the St. Lucie County Land Development Code.i The proposed change in zoning was found not to be consistent with the existing and proposed use of property in the surrounding area. In that it would provide for the introduction of an industrial use adjacent to an existing residential use that would be in close proximity to the each other. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: File No.: RZ-03-048 Resolution 04-018 March 2, 2004 Page 1 OR BOOK 1934 PAGE 2565 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 The proposed change in the zoning district classification for that property described as follows and as depicted on the maps in Exhibit A: The North 150 feet Of the South 600 feet of the following described property: Commence at the intersection of State Road 68 (also described as Orange Avenue) and the West line of the Northwest Quarter of the Southeast Quarter of Section 12, Township 35 South and Range 38 East; run East along the South right-of-way line of the above describe¢ State Road 68 from the intersection of the South line of State Road 68 and the West line of the Northwest Quarter of the Southeast Quarter of Section 12, Townshi; 35 South, Range 38 East; run Easterly along the South right-of- way line 1,000 feet t¢ the Point of Beginning; thence continue Easterly on said South right-of-way line Nol Ih 89-~42'02'' East, a distance of 302.57 feet to a point; thence run Southerly South 00~, !5'50" East, a distance of 935 feet to a point; thence run Westerly on a line South 89~42'02'' West, a distance of 703.96 feet to a point; thence run Northerly on a line North 00~0'25" West, a distance of 460 feet to a point; thence run Easterly on a line N¢lrth 89-~42'02'' East, a distance of 400 feet to a point; thence run North on a line Nort~ 00~20'45'' West, a distance of 475 feet to the Point of Beginning, all of said lands being in the Northwest Quarter of the Southeast Quarter of Section 12, Township 35 South, Range 38 East, St. Lucie County, Florida. Tax Id. No. 2212-421-0002-000/4 (Location: Westi side of Trowbridge Road, approximately 400 feet south of the intersection of Orange Avenue and Trowbridge Road) owned by Harold H. Smyth, is hereby denied.
