A RESOLUTION GRANTING PRELIMINARY AND FINAL
PLANNED NONRESIDENTIAL DEVELOPMENT APPROVAL
FOR A 0.59-ACRE PROJECT TO BE KNOWN AS NETTLES
ISLAND, INC. REAL ESTATE OFFICE-PNRD AND FOR A
CHANGE IN ZONING FROM HIRD (HUTCHINSON ISLAND
RESIDENTIAL DISTRICT) TO PNRD (PLANNED NON-
RESIDENTIAL DEVELOPMENT) FOR PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
CHANGE IN ZONING
Nettles Island, Inc., presented a petition for a change in zoning from the HIRD
(Hutchinson Island Residential District) Zoning District to the PNRD (Planned
Nonresidential Development) Zoning District for the property described in Part A
below.
On February 19, 2004, the St. Lucie County Planning and Zoning Commission held a
public hearing on the petition, after publishing notice at least 10 days prior to the
hearing and notifying by mail all owners of property within 500 feet of the subject
property, and recommended that the Board of County Commissioners approve the
hereafter described request for a change in zoning from the HIRD (Hutchinson
Island Residential District) Zoning District to the PNRD (Planned Nonresidential
Development) Zoning District for the property described in Part A below.
On March 16, 2004, this Board held a public hearing on the petition, after publishing
notice at least 10 days prior to the hearing and notifying by mail all owners of
property within 500 feet of the subject property.
The proposed change in zoning is consistent with the goals, objectives, and policies
of the St. Lucie County Comprehensive Plan and has satisfied the requirements of
Section 11.06.03 of the St. Lucie County Land Development Code.
The proposed change in zoning is consistent with the existing and proposed use of
property in the surrounding area.

Neff/es Island, Inc, has presented a petition for Final Planned Nonresidential
Development site plan approval for 0.59-acres for the purpose of operating a 2,050
square foot real estate office, to be referred to as VNI Realty, PNRD, to be located
on the property described in Part A.
The Development Review Committee has reviewed the petition of Nettles Island,
Inc., for a Final Planned Nonresidential Development Site Plan and found it to meet
all technical requirements of the Land Development Code and to be consistent with
the Future Land Use maps of the St. Lucie County Comprehensive Plan, subject to
the conditions set forth in Part D of this Resolution.

this Board that Final Site Plan approval for the project known as VNI Realty~ PNRD
be granted.
On March 16, 2004, this Board held a public hearing of which due public notice was
published and mailed notices was sent to all property owners within 500 feet at least
10 days prior to the hearing.
The proposed project is consistent with the general purpose, goals, objectives and
standards of the St. Lucie County Comprehensive Plan, the St. Lucie County Land
Development Code and the Code of Ordinances of St. Lucie County.
The proposed project is consistent with, and has satisfied the requirements of
Section 11.02.07 of the St. Lucie County Land Development Code.
The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety and general welfare.
All reasonable steps have been taken to minimize any adverse effect of the
proposed project on the immediate vicinity through building design, site design,
landscaping and screening.
The proposed project will be constructed, arranged and operated so as not to
interfere with the development and use of neighboring property, in accordance with
applicable district regulations.
Ft. Pierce Utility Authority will provide water services to the subject property and St.
Lucie County Utilities will provide sewer service to the subject property.

NOW, THEREFORE, BE IT RESOLVED bythe Board of County Commissioners of St. Lucie
County, Florida:
CHANGE IN ZONING
Pursuant to Section 11.02.05(B) of the St. Lucie County Land Development Code,
the petition of Nettles Island, Inc., for a change in zoning from the HIRD (Hutchinson
Island Residential District) Zoning District to the PNRD (Planned Nonresidential
Development) Zoning District for the project to be known as VNO Realty - PNRD,
and described as follows:
BEGINNING AT THE SOUTHEAST CORNER OF LOT 122, SHOWN ON THE PLAT OF
NETTLES ISLAND SECTION 1, RECORDED IN PLAT BOOK 16, PAGE 1 "A", ST. LUCIE
COUNTY, FLORIDA, PUBLIC RECORDS; THENCE RUN SOUTH 21 ° 13'52" EAST FOR
83.31 FEET; THENCE SOUTH 68° 46' 08" WEST FOR 32.43 FEET TO A POINT OF
CURVATURE OF A CURVE TO THE RIGHT, HAVING A CENTRAL ANGEL OF 50° 43' 09"
AND A RADIUS OF 409.01 FEET; THENCE WESTERLY ALONG THE ARC OF SAID
CURVE 47.95 FEET TO THE END OF SAID CURVE; THENCE SOUTH 75° 29' 09" WEST,
A DISTANCE OF 100.00 FEET TO THE POINT OF CURVATURE OF A CURVE TO THE
RIGHT HAVING A CENTRAL ANGLE OF 25° 00' 00" AND A RADIUS OF 95.77 FEET;

A copy of this Resolution shall be attached to the site plan drawings described in
Part C, which plan shall be placed on file with the St. Lucie County Community
Development Director.
SITE PLAN
Pursuant to Section 11.02.05 and Section 11.02.10 of the St. Lucie County Land
Development Code, the Final Preliminary Planned Nonresidential Development site
plan for the project to be known as VNI Realty- PNRD be, and the same is hereby,
approved as shown on the site plan drawings for the project prepared by Thomas
Lucido & Associates, Inc., dated June 6, 1997, and last revised July 10, 2004 and
date stamped received by the St. Lucie County Community Development Director on
July 11,2003, subject to the following conditions:

The approval granted is conditioned for the operation of a real estate office
only, any other use will require a modification to the approved PNRD and
approval by the Board of County Commissioners.
The petitioners shall upgrade the existing landscaping along the northern
and southern property lines, as depicted on the proposed landscape plan
approved by the Environmental Resource Division.

The approvals and authorizations granted by this Resolution are for the purpose of
obtaining building permits/zoning compliance for the VNI Realty on the property
described in Part G and shall expire on March 16, 2006, unless the developer has
obtained a building permit approval for the site plan described in Part H or an
extension has been granted in accordance with Section 11.07.05(F) of the St. Lucie
County Land Development Code.
The Certificate of Capacity, a copy of which is attached to this resolution, shall
remain valid for the period of Final Planned Nonresidential Development Site Plan
approval. Should the Final Planned Nonresidential Development Site Plan approval
granted by this Resolution expire or an extension be sought pursuant to Section
11.02.06(B)(3) of the St. Lucie County Land Development Code, a new certificate of
capacity shall be required.
The conditions set forth in Part D are an integral nonseverable part of the site plan
approval granted by this Resolution. If any condition set forth in Section D is
determined to be invalid or unenforceable for any reason and the developer declines
to comply voluntarily with that condition, the site plan approval granted by this
resolution shall become null and void.
A copy of this resolution shall be attached to the site plan drawings described in Part
D, which plan shall be placed on file with the St. Lucie County Community
Development Director. Further, the Community Development Director is hereby
authorized and directed to cause the notation of this resolution to be made on the
Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to
the date of adoption of this Resolution.
