Wiley's Landin.q is a 2-lot subdivision for property located on the west side of Christensen Road, approximately 2,400 feet south of West Midway Road in the AR-1 Agricultural, Residential - 1 du/acre) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: File No.: MNSP-03-028 March 25, 2004 CD Order 04-004 Page 1 OR BOOK 1939 PABE 890 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 22 23 24 25 26 27 28 29 3O 31 3~ 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the proposed minor site plan to be known as Wiley's Landing Subdivision, is hereby approved as shown on the site plan drawings for the project prepared by Velcon Group, inc., March 161 2004, and received by the St. Lucie County Community Development Director on March 16, 2004, for the property described as follows: A PORTION OF LOT 119, WHITE CITY, ACCORDING TO THE MAP OR PLAT THEREOF RECORDED IN PLAT BOOK 1, PAGE 23, ALL IN SECTION 5, TOWNSHIP 36 SOUTH, RANGE 40 EAST, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING ATHE INTERSECTION OF THE NORTHEAST CORNER OF LOT 119 WITH THE WESTERLY RIGHT-OF-WAY LINE OF CHRISTENSEN ROAD; THENCE RUN SOUTH 00o04'17" EAST ALONG SAID RIGHT-OF-WAY, A DISTANCE OF262.81 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 00°04'17" EAST ALONG SAID RIGHT- OF-WAY, A DISTANCE OF 397.03 FEET TO THE SOUTHEAST CORNER OF SAID LOT 119; THENEC RUN NORTH 89°52'55'' WEST ALONG THE SOUTH LINE OF LOT 119, A DISTANCE OF 530.04 FEET TO A POINT; THENCE RUN NORTH 05 °24'15" WEST, A DISTANCE OF 398.88 FEET TO A POINT; THENCE RUN SOUTH 89°52'55''EAST, A DISTANCE OF 567.11 FEET TO THE POINT OF BEGINNING. (Part of Tax ID #: 3403-502-0204-000~7) (Location: West side of Christensen Road, approximately 2,400 feet south of West Midway Road) The approvals granted by this administrative order shall expire on March 25, 2006, unless a final plat approval is granted or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. Once final plat approval is granted, the site plan becomes vested for the purposes of building permits. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioners, John and Kathleen Wiley, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental' Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director and mailed, return receipt requested, to the developer and agent of record as identified on the site plan applications. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This order shall be recorded in the Public Records of St. Lucie County.
