Home My WebLink About03-015JOANNE HOLMAN, CLERK OF THE CIRCUIT COURT - SAINT LUCIE COUNTY File Number: 2179154 OR BOOK 1883 PAGE 1188 Recorded:05/31/03 10:47 RESOLUTION NO. 03-015 File No.: BCC-03-007 A RESOLUTION GRANTING AN EXTENSION OF A PLANNED UNIT DEVELOPMENT APPROVAL FOR A PROJECT KNOWN AS OCEAN OASIS WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: On November 24, 1992, this Board through Resolution 92-238 approved the Preliminary Development Plan for the project known as Ocean PUD (f/ida The Villages of South Hutchinson Island), a proposed 101 unit, Planned Unit Development (95 single-family units and six multi-family units), on property located on the east side of South A-l-A, approximately 3-miles south of the St. Lucie County Nuclear Power Plant. On December 14, 1993, this Board, through Resolution 93-254, granted the first extension to the Preliminary Planned Unit Development approval, to the proposed project. On June 21, 1994, this Board, through Resolution 94-082, granted the second extension to the Preliminary Planned Unit Development approval, to the proposed project. On March 7, 1995, this Board, through Resolution 95-063, approved the petition of James P. Brown, on behalf of Jon H. Berkey, as Trustee, for Partial Final Planned Unit Development approval for the project to be known as Ocean PUD (n/Ida The Villages of South Hutchinson Island) in the PUD Zoning District, after publishing a notice of such hearing in the Port St. Lucie News and the Tribune and notifying by mail all owners of property within 500 feet of the subject propeEty. On December 27, 1999, the Community Development Director issued an administrative approval granting a minor adjustment to the approved Planned Unit Development Plan for the Ocean Oasis Site Plan. On April 16, 2002, this Board granted approval to a 12 month extension for this project, with said Site Plan Extension establishing a new expiration date of December 27, 2002. March 18, 2003 Page 1 Resolution 03-015 BCC-03-007 OR B0OK 1683 PAGE i169 The developer of the Ocean Oasis Planned Unit Development has requested that they be granted a final 12-month extension to their Planned Unit Development approval, which if approved would carry this projects approval period through to December 27, 2003. On April 16, 2003, this Board held public hearings on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED bythe Board of County Commissioners of the St. Lucie County, Florida: Pursuant to Section 11.02.06(B)(3) of the St. Lucie County Land Development Code, the Planned Unit Development granted for the construction of the Ocean Oasis Planned Unit Development, is hereby extended for an additional 12 months, which would now expire on December 27, 2003, subject to the following conditions: The maximum development density for this project is now 91 units, and shall be developed as single family detached dwelling units. This is the final extension of the Final Development for the Planned Unit Development project known as Ocean Oasis. This project is no longer eligible for any further extensions to the site plan for this Planned Unit Development Site Plan. Unless the plats for the entirety of this subdivision, all phases included, are recorded in the land records of St. Lucie County by December 27, 2003, the approvals granted/extended by this resolution, and all prior resolutions granting development plan approval, shall expire and no further building permits shall be issued or development authorization granted until a new Planned development review has approved by the Board of County Commissioners. In order to secure a continued vested right to develop the remaining recorded lots within this subdivision, the developer shall by December 27, 2003 have completed, bonded or otherwise posted adequate security in a manner and form acceptable to St. Lucie County for all of the required infrastructure. As part of the final recording of all plats for this development, the power pole that has been erected in the middle of the northern project entry drive shall be relocated out of the project driveway. St. Lucie County shall not be responsible for any of the costs associated with the relocation of this power pole. Location: East Side of South A-l-A, approximately 3 miles south of tho Ft. Pierce City limit Lines) The approvals and authorizations granted by this Resolution are for the purpose of obtaining final plat approvals and building permits on this property, and shall expire on December 27, 2003. A copy of this resolution shall be placed on file with the St. Lucie County Community Development Director.
