HomeMy WebLinkAbout03-044RESOLUTION NO. 03-44 A RESOLUTION DISSOLVING THE ESTATES OF LONGWOOD MUNICIPAL SERVICE TAXING UNIT FOR STREET LIGHTING WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On August 29, 1989, the Board adopted Resolution No. 89-244 which created the Estates of Longwood Municipal Service Taxing Unit (MSTU) to pay the cost of providing street lighting within the Estates of Longwood Subdivision. 2. Although the streets lights were installed in the Estates of Longwood Subdivision, the subdivision developer was unwilling or unable to transfer the Florida Power and Light Company account for the street lighting to St. Lucie County, and, as a result, the County has been unable to implement the MSTU as provided in Resolution No. 89-244. 3. Section 1-13.5-15, St. Lucie County Code of Ordinances, provides that the Board may dissolve a MSTU provided that all indebtedness secured by the proceeds of taxes or special assessments levied by the unit are paid off or there is otherwise full compliance with the terms, conditions or covenants of the documents or note which established the indebtedness. 4. No indebtedness was established for the Estates of Longwood MSTU and no indebtedness was secured by the proceeds of the taxes levied by the Estates of Longwood MSTU NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. This Board hereby dissolves the Estates of Longwood Municipal Services Taxing Unit for street lighting as created by Resolution No. 89-244. 2. This resolution shall be recorded in the public records of St. Lucie County, Florida, and shall take effect upon recording. 3. The County Attorney is directed to send a copy of this resolution to the St. Lucie County Property Appraiser and the St. Lucie County Tax Collector.
