LUClE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence including, but not limited to the staff report, has made the following determinations: John Tenhoeve, presented a petition for a change in zoning from the RS-2 (Residential, Single- --amily - 2 du/acre) Zoning District to the AG-1 (Agricultural - 1 du/acre) Zoning Dist'ict for the property described in Part A below. On November 21,2002, the St. Lucie County Planning and Zoning Commission held a public hearing on t3e petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners deny the hereafter described request for a change in zoning from the I (Institutional) Zoning District to the AG-1 (Agricultural - 1 du/acre) Zoning District for the property described in Part A below. On December 3, 2002, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, at which time the Board continued the petition to the January 21,2003 public hearing at 7:00 pm or as soon as possible thereafter. On January 21, 2033, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed change in zoning is not consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. The proposed change in zoning has not satisfied the requirements of Section 11.06.03 of the St. Lucie County Land Development Code. The change in zoning petition would permit the incorporation of inconsistent uses (commercial business) within a strictly residential area, thereby negatively impacting the surrounding properties. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The proposed change in the Zoning District Classification, as depicted in Exhibit A, for that property described as follows: Section 13, Range 35 South, Township 39 East, The north 150 feet of the north 1/2 of the southwest/4 of the nor~east ~/4 lying easterly of the east right-of-way of 1-95, less the east 30 feet and less the north ' 20 feet of the east 164 feet thereof Plus, The south 222.12 feet of the north 372.12 feet of the north 1/2 the southwest 1/4 of the northeast 1/4 lying easterly of 1-95 les s the south 192.12 feet of the east 255 feet thereof and less road right- Of-way. Together with, The south 192.12 feet of the north 372.12 feet of the east 255 feet of the north 1/2 of the southwest ~/4 of the no~heast 1/3 - less the east 30 feet. Containing 4.99 acres, more or less. Tax Id. Nos. 2313-131-0D01-000/7, 2313-131-0001-020/3 and 2313-131-0001-030/6 (Location: 1475 Bennett Road) owned by John Tenhoeve, is hereby denied..
