LUCIE COUNTY, FLORIDA, WHICH PROJECT WAS TO BE KNOWN AS ROSE CAR WASH. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: CONDITIONAL USE PERMIT Timothy Rose, presented a petition for a Conditional Use Permit to the operation of a 2,542 square foot self-service car wash, to be known as Rose Car Wash, in the CN (Commercial, Neighl:orhood) Zoning District for the property described in Part B. On September 19, 2002, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifyin~ by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners deny the hereinafter described request for a Conditional Use Permit in CN (Commercial Neighborhood) Zoning for the property described in Part B. On October 15, 2002, this Board held a public hearing on the petition, after publishing a notice of such hea'ing and notifying by mail all owners of property within 500 feet of the subject property. The proposed Conditional Use is adjacent to a church, including an outdoor memorial garden and a single 'amily residential area. The proposed Con¢itional Use has been determined not to be consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. 6. The proposed Conditional Use will have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 7. The proposed Conditional Use, a car wash, is not compatible with the church, memorial garden and single family residential neighborhood. 10. 11. 12. SITE PLAN Timothy Rose presented a petition for a Site Plan approval to construct a 2,542 square foot self-service car wash, to be known as Rose Car Wash; in the CN (Commercial Neighborhood) Zoning District for the property described in Part B. The Development Review Committee has reviewed the petition for a Minor Site Plan approval and found it to meet all technical requirements of the Land Development Code and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part D of this Resolution. The required Condit onal Use Permit associated with this Minor Site Plan has been determined not to be consistent with the goals, objectives, and policies of the St. Lucie County Comprehens ve Plan. The proposed projec: is not compatible with the residential character of the surrounding area and would be inconsistent with the surrounding neighborhood and the religious facility to the north. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: CONDITIONAL USE PERMIT Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Timothy Rose to provide for the operation of a 2,542 square foot self-service car wash, to be known as Rose Car Wash, in CN (Commercial,, Neighborhood) Zoning and as depicted on the site plan drawings described in Part D, is hereby denied for the property described in Part B. The property on which this Conditional Use Permit is being denied is described as follows: Legal Description: Lakewood Park Subdivision Unit 12A, Lots 11 & 12, Block 169 as recorded in Pl~t Book 11, Page 35 of the Public Records of St. Lucie County Florida. Containing 0.7:3 acres more or less. (Location: Wes side of the Sunshine State Parkway/Turnpike Feeder Road, approximately 600 feet north of the intersection of Sunshine State Parkway and Winter Garden Parkway.) The property on which this site plan approval is being denied is described in Part B of this Resolution.
