LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: Choice Pest Manac~ement, Inc., presented a petition for a Conditional Use Permit to allow for the operation of a pest control service on property in the CG (Commercial, General), depicted cn the attached maps as Exhibit "A" and described in Part "B" below, in the Lexingt3n Square Subdivision. On May 15, 2003, the St. Lucie County Planning and Zoning Commission held a public hearing on the petitio 3, after publishing notice at least 10 days prior to the hearing and notifying by mail all ewners of property within 500 feet of the subject property, and recommended that t ~e Board of County Commissioners approve a conditional use permit to allow for tt'e operation of a pest control service in the CG (Commercial, General) Zoning Dist 'ict for the property depicted on the attached Maps and described in Part B below. On June 10, 2003, this Board held a public headng on the petition, after publishing notice at least 10 day~ prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed Condibonal Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of t le St. Lucia County Land Development Code. The proposed Condi:ional Use will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. The proposed Conditional Use will be serviced by adequate public facilities and services. A Certificate of Capa ;ity as required under Chapter V, St. Lucie Land Development Code, a copy of whicl is attached to this resolution, was granted by the Community Development Directo'on June 10, 2003. C. D. E. F. Pursuant to Sectior 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Choice Pest Management, Inc. to allow for the operation of a pest control service in the CG (Commercial, General) Zoning Distdct is hereby granted for the property described below, subject to the following conditions: The size of the containers for the pest control chemicals shall be limited to a maximum of ' 5 gallons of liquid concentrate. 2. There shall be no outdoor storage of any pest control chemicals. The property on which this Conditional Use is being granted is described as follows: LEXINGTON SQUARE, LOT 11. (Tax ID#: 3415-702-0010-000/1) (Location: 6964 Heritage Drive) This Conditional Use Permit approval shall expire on June 10, 2004, unless a zoning compliance is obta ned or an extension is granted in accordance with Section 11.02.06(B)(3), St. Lucie County Land Development Code. The Conditional Use Permit approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Choice Pest Management, Inc., including any successors in interest, shall obtain all necessary permits and authorizations from the appropriate .ocal, State, and Federal regulatory authorities prior to the issuance of any local building permits or authorizations to commence development activities on the property described in Part B. This conditional use permit is not assignable. Should Choice Pest Management, Inc. choose to assign thi~ conditional use to another pest control service, the new operator shall be required to obtain a major adjustment to a conditional use permit to allow its continued operation at this location. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid for the period of Concitional Use approval. Should the Conditional Use approval granted by this resolution expi,'e or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Lanc Development Code, a new certificate of capacity shall be required.
