HomeMy WebLinkAbout03-166RESOLUTION NO. 03-166 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA, ADOPTING THE FINAL ASSESSMENT ROLL FOR THE SMALLWOOD AVENUE MUNICIPAL SERVICES BENEFIT UNIT AND CREDITING THE ASSESSED PROPERTIES AS SET FORTE IN THE FINAL ROLL; AND PROVIDING AN EFFECTIVi~ DATE WHEREAS, on February 5, 2002, pursuant to Chapter 1-13.5 of the St. Lucie County Code of Ordinances and Compiled Laws (the "Code"), the Board of County Commissioners for St. Lucie County (the "Board") adopmd Resolution No. 02-061 which created the Smallwood Avenue Municipal Services Benefit Unit (the "Smallwood Avenue MSBU") to fund the cost of a project to provide potable water supplied by Fort Pierce Utilities Authority to certain properties on Smallwood Avenue in unincorporated St. Lucie County, Florida (the "Project") as shown on the attached Exhibit "A"; and WHEREAS, on November 5, 2002, the Board adopted Resolution No. 02-258 and thereby, (1) adopted the Preliminary Assessment Roll for the Smallwood Avenue MSBU which was based on the estimated costs for the ?roject, (2) authorized the levy ora special non-ad valorem assessment (the "Special Assessment") 'within the Smallwood Avenue MSBU in the amount set forth in the Preliminary Assessment Rol~, and, (3) authorized the collection of the Special Assessment by the uniform method of collectim~ pursuant to Chapter 197, Florida Statutes, beginning with the tax bill for 2003 for a period of 10 years; and WHEREAS, on December 17, 2002 pursuant to Section 197.3632, Florida Statutes, the Board adopted Resolution No. 02-280 which stated the Board's intent to use the uniform method of collecting the Special Assessments levied by the Smallwood Avenue MSBU; and WHEREAS, on August 12, 2003, the Board reviewed the final costs for the completed Project and determined tha~ the final costs are lower than the estimated costs as ~et forth in the Preliminary Assessment Roll and therefore the Special Assessments should be credited in accordance with Section 1-13.5-7 of the Code as set forth in the Final Assessment Roll (Exhibit "B"). NOW, THEREFOKE, BE IT RESOLVED by the Board of County Commissioners for St. Lucie County, Florida, as fo lows: -1- Section 1: The Final Assessment Roll for the Smallwood Avenue MSBU (Exhibit "B") is hereby approved and confirmed and the Final Assessment Roll is substituted for the Preliminary Assessment Roll in accordance with the provisions of Chapter 1-13.5-7 of the Code to reflect the credits for the final Project costs. Section 2: Exce3t for the substitution of the Final Assessment Roll for the Preliminary Assessment Roll, all of the findings, determinations, and actions made or taken by the Board pursuant to Resolutions Nos. 01-061,02-258, and 02-280, including but not limited to the collection of the Special Assessments 3y the uniform method beginning with the tax bill for 2003 for a period of 10 years, shall remain in full fome and effect and apply equally to the Final Assessment Roll.
