RESOLUTION 03-004
A RESOLUTIOh DENYING ORDINANCE 03-002 (FORMERLY
DRAFT ORD. 02-025) WHICH PROPOSED A CHANGE TO
THE ST. LUCIE COUNTY LAND DEVELOPMENT CODE BY
AMENDING SECTION 2.00.00 (DEFINITION)TO MODIFY THE
DEFINITION OF COMMERCIAL VEHICLES AND CREATING
TOWING CLASSES; BY AMENDING SECTION 7.10.14
RESTRICTIONS ON HEAVY VEHICLES IN RESIDENTIAL
DISTRICTS TO PERMIT ONE CLASS A TOW TRUCK THAT IS
ON THE ST. LUCIE COUNTY SHERIFF'S OFFICE ROTATION
LIST TO BE STORED IN A RESIDENTIAL NEIGHBORHOOD
BY DELETING EXTENSION OF PARKING RESTRICTION.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
On August 1, 1990, fhe Board of County Commissioners of St. Lucie County, Florida,
adopted the St. Lucie County Land Development Code.
On August 29, 2002, the Local Planning Agency/Planning and Zoning Commission held
a public hearing on 'he draft ordinance 02-015 after publishing notice in the Port St.
Lucie News and the -ribune at least 10 days prior to the hearing and recommended that
the proposed ordinance be denied.
On September 17, 2002, this Board held its first public hearing on the proposed
ordinance, after publ shing a notice of such hearing in the Port St. Lucie News and the
Tribune on September 5, 2002.
On October 19, 2002, this Board held its second public hearing on the proposed
ordinance, after pub[ shing a notice of such hearing in the Port St. Lucie News and the
Tribune on October 3, 2002, and following the acceptance of public comments,
continued the public hearing on this matter until January 21,2003.
On January 21, 2003, this Board reconvened the public hearing on this matter and
accepted additional public comments.
The proposed amendment to the St. Lucie County Land Development Code has been
determined to be inconsistent with the general purpose, goals, objectives and standards

of the St. Lucie Counly Comprehensive P~an and is not in the best interest of the health
safety and public weFare of the citizens of St. Lucie County, Florida.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
The proposed amenc merit to Section 7.10.14 of the St. Lucie County Land Development
Code as described i'~ Draft Ordinance 03-002 (formerly Draft Ord. 02-025) is hereby
denied.
A copy of this Resolution shall be placed on file with the St. Lucie County Community
Development Director.
