LUCIE ON CONDY'ION THAT THE CURRENT OWNER OF THE PROPERTY, LTC RANCH JOINT VENTURE, AND THE PROSPECTIVE PURCHASER GOLF ONE AMERICA, INC. ACKNOWLEDGE AND AGREE IN WRITING THAT ST. LUCIE COUNTY, BY CONSENTING TO, AND PARTICIPATING IN, THE FILING OF THIS BOUNDARY PLAT, DOES NOT AGREE TO, APPROVE OR OTHERWISE COMMIT r'o ANY VACATION, ABANDONMENT OR TRANSFER OF INTEREST IN ALL OR PART OF THE RIGHT-OF-WAY FOR ARTERIAL "A" TO ANY OTHER PARTY OR ENTITY UNTIL A FORMAL RIGHT-OF-WAY ABANDONMENT/VACATION REVIEW PROCESS HAS BEEN CONDUCTED IN ACCORD WITH APPLICABLE LOCAL DEVELOPMENT CODES AND FLORIDA LAW AND THAT TH~ ABANDONMENTNACATION HAS BEEN APPROVED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On January 21, 2003, this Board agreed to consent to sign the plat of North Pointe Plat No. 1 on condition that the current owner (LTC Ranch Joint Venture) and prospective purchaser (Golf One America, Inc.) of the property covered by the North Pointe Plat No. 1 acknowledge and agree in writing that the County, by consenting to the recordation of the North Pointe Plat No. 1, does not agree to approve or otherwise commit to any vacation, abandonment or transfer of the right- of-way for "Arterial A" that was previously conveyed to the County. NOW, THEREFOKE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. This Board does nereby consent to and participate in the filing of a Boundary Plat for North Pointe Plat No. 1 with the City of Port St. Lucie on condition that the current owner, LTC Ranch Joint Ventures, and the prospective purchaser Golf One America, Inc, acknowledge and agree in writing that St. Lucie County by consenting to, and participating in, the filing of Boundary Plat of North Pointe, does not agr_ee to, approve or otherwise commit to any vacation, abandonment or transfer of interest in all or part of Arterial "A" to any other party or entity until a formal fight-of- way abandonment/vacation review process has been conducted in accord with applicable local development codes and Florida Law and the abandonment/vacation has been approved by the Board of County Commissioners of St. Lucie County, Florida. 2. The County Administrator is hereby directed to forward a copy of this resolution to Mr. Robert N. Klein, Esquire, Dean, Mead, Minton & Klein, 1903 South 25th Street, Fort Pierce, Florida 34947; and to Mr. Alan Ciklin, Esquire, Boose, Casey, Ciklin, Et al., 515 North Flagler Drive, Suite 1900, West Palm Beach, Florida 33401-4330. The County Attomey is directed to record this Resolution in the Public Records of St. Lucie County, Florida.
