LUClE COUNTY, FLORIDA AND FOR FINAL DEVELOPMENT PLAN APPROVAL FOR A PROJECT KNOWN AS PARCEL 34 A THROUGH @ THE PESERVE (a/ida THE LAKES @ PGA VILLAGE) WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: A3JUSTMENT TO AN APPROVED PUD Reserve Homes Ltc., L.P., presented a petition for a Minor Adjustment to an Approved Preliminary Planne¢ Unit Development (PUD) or certain property in St. Lucie County, Florida, to aggrega:e Parcel 33, Phase 2; Parcel 34; Parcel 35 and Parcel 36 into Reserve Parcel 34 A through E and decrease the total number of residential units from 647 to 213 the purpose of which is to receive Final Planned Unit Development approval for a 213-unit single-family residential development in Parcel 34 A through E at the Reserve (a/k/~ the Lakes @ PGA Village). On May 23, 1989, this Board approved the application of Reserve Homes, Ltd., through Resolution =J9-144, for Final Planned Unit Development approval for a portion of the Reserve, a Development of Regional Impact, known as PUD III @ the Reserve. PUD III @ the Reserve was approved for a total of 1636 residential units, an 18-hole golf course and a three-hole practice golf course on a total of 256.08 acres. On December 20, ' 988, this Board approved Resolution 88-357 granting approval to the Application for Development Approval (ADA) for the Development of Regional Impact (DRI) known as the Reserve. The Reserve DRI is approved as amended through Resolution 98-100, for a total of 4,100 dwelling units; 1,600,000 square feet of industrial development; 290,000 square feet of commercia development; 100,000 square feet of office space and 250 hotel/motel rooms. Reserve Homes, L-D, L.P., has requested that this Board consider granting approval to a proposed IVinor Adjustment to the approved Preliminary Planned Unit Development site plan for the area at the Reserve, a Development of Regional Impact, known as Parcels 33, Phase 2; Parcel 34, 35, and 36, PUD III @ the Reserve, the purpose of which is to aggregate the density from Parcels 33, Phase 2, 34, 35 and 36 into Parcel 34 A through E (a/k/a The Lakes @ PGA Village) and decrease the density from 647 residential units (single-family and multi-family) to 213 single-family units and one 6.32-acre recreational tract, thereby decreasing the overall density of Parcel 34 from 6.5 du/acre to 2.6 du/acre. On April 1, 2003, this Board held a public hearing on the petition, after publishing a notice of such hearing in the Ft. Pierce Tribune and notifying by mail all owners of property within 500 'eet of the subject property. The proposed Minor Adjustment is consistent with the goals, objectives and policies of the St. Lucie County Comprehensive Plan. The proposed Minor Adjustment is consistent with the Final Development Order (last revised through Resolution 99-143) for the Reserve, a Development of Regional Impact. The proposed Minor Adjustment is consistent with the existing approved Preliminary Planned Unit Development Site Plan for that portion of the Reserve, a Development of Regional Impact, known as PUD III at the Reserve and does not represent a substantial deviatioa from the original plan of development for this area. The Development :leview Committee has reviewed the site plan for this proposed Major Adjustment and found it to meet all minimum technical requirements. The proposed Minor Adjustment is consistent with the general purpose, goals, objectives and stardards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. The proposed Mincr Adjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. CHANGEINZONING Reserve Homes Ltc., L.P., presented a petition for a Change in Zoning from AR- 1 (Agricultural, Res dential - 1 du/acre) to PUD (Planned Unit Development) or certain property in St. Lucie County, Florida, the purpose of which is to receive Final Planned Unit ~)evelopment approval for a 213-unit residential development parcel at the Reserve. On April 27, 1989, t3e St. Lucie County Planning and Zoning Commission held a public hearing, of which due public notice was published in the Ft. Pierce News Tribune and mailed to all property owners within 500 feet at least 15 days prior to the hearing, and rec,ommended to this Board that the requested change in zoning from AR-1 (Agricultural, Residential - 1 du/ac) to PUD (Planned Unit Development), be g'anted. On May 23, 1989, after holding a public hearing, of which a notice of such hearing was published in the Ft. Pierce Tribune and the Port St. Lucie News, and after notifying by mail all property owners within 500 feet of the subject property, this Board, through Resolution 89-144, granted approval to the petition of Reserve Homes Ltc., L.P., for a Preliminary Planned Unit Development Site Plan for the project know3 as PUD III at the Reserve. On April 1, 2003, t3is Board held a public hearing on the petition of Reserve Homes Ltd., L.P., a-ter publishing a notice of such hearing in the Tribune and the Port St. Lucie News and notifying by mail all property owners within the Reserve Development. The proposed zoning change is consistent with the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.06.03 of the St. Lucie County Land Development Code. -'INAL SITE PLAN APPROVAL Reserve Homes Ltc., L.P., presented a petition for a Final Planned Unit Development approval for a 213-unit single-family residential development in Parcel 34 A through E at the Reserve (a/k/a The Lakes @ PGA Village). On May 23, 1989, this Board approved the application of Reserve Homes, Ltd., through Resolution 39-144, for Final Planned Unit Development approval for a portion of the Reserve, a Development of Regional Impact, known as PUD III @ the Reserve. P., is now seeking Final Planned Unit Development site plan approval for a portion of the area within PUD III at the Reserve, known as Parcel 3~ A through E @ the Reserve (a/ida The Lakes @ PGA Village). The Development Review Committee has reviewed the Final Planned Unit Development site plan for the proposed project and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehersive Plan, subject to the conditions set forth in Part C of this Resolution. The Development Review Committee has reviewed the Final Planned Unit Development site p an for the proposed project and found it to be consistent with the Preliminary Planned Unit Development plans for the area known as PUD III @ the Reserve, subject to the conditions set forth in Part C of this Resolution. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Pla ~, and the Code of Ordinances of St. Lucie County. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 33. The proposed project will be served by adequate public facilities and services. The applicant has demonstrated that water supply; evacuation facilities and emergency access are satisfactory to provide adequate fire protection. 35. A Certificate of Cal:acity, a copy of which is attached to this Resolution, was granted by the Community Development Director on April 1,2003. NOW, THEREFORE, BE I- RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: MAJOR ADJUS-MENT TO A PLANNED UNIT DEVELOPMENT Pursuant to the Requirements of Section 11.02.05 of the St. Lucie County Land Development Code the amended Preliminary Planned Unit Development Site Plan referenced in Part A of Resolution 84-101 for the area known as PUD III @ the Reserve, is hereby approved as shown on the site plan drawings prepared by Thomas Lucido Associates, 3.A. dated 7-24-02 and last revised on 2-14-03 and date stamped received by the St. Lucie County Community Development Director on 2-21-02. The specific Minor Adjustment authorized through this Resolution to the Preliminary Planned Unit Development Site plan for the Reserve PUD III are as follows: Aggregate tie density from Parcel 33, Phase 2; Parcel 34; Parcel 35 and Parcel 36 in~ Parcel 34 A through E; Decrease the number of units for Parcel 34 A through E from 647 multi-family and single-family units into 213 single-family units; and, Decrease th~ overall density of Parcel 34 A through E from 6.5 du/acre to 2.5 du/acre. The property effectgd by this amended Preliminary Planned Unit Development Site Plan is described in Section E below. The Revised Prelim nary Planned Unit Development Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Reserve Homes Ltd., L.P., ncluding any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to: The United States Army Corp of Engineers, 'he Florida Department of Environmental Protection, and the South Florida Water Management District. Unless otherwise addressed through the projects final construction plans, all primary infrastructure work for this subdivision plat shall be completed no later than April 1, 2005. The Final Planned Unit Development Site Plan/General Site Plan approval granted under this Resoluticn is specifically conditioned to the requirement that the petitioner, Reserve Homes L-d., L.P., including any successors in interest, shall obtain all necessary developr~ent permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to; the United Stated Army Corp of Engineers, the Florida Department of Environmental Protection, and the South Florida Wate' Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part E. The conditions set =orth in Part F are an integral nonseverable part of the site plan approval granted by this Resolution. If any condition set forth in Section F is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. A copy of this Reso ution shall be attached to the site plan drawings described in Part F, which plan shall be placed on file with the St. Lucie County Community Development Direct 3r.
