The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives, and standards of the SI. Lucie County Land Development Code, the St. Lucie County Comprehensive Plat, and the Code of Ordinances of St. Lucie County. The proposed project will not have an undue adverse effect on adjacent property, the character of the neig ~borhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The proposed projec- will be constructed, arranged and operated so as not to interfere with the development an¢ use of neighboring property, in accordance with applicable district regulations. 7. The proposed projecl will be served by adequate public facilities and services. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. FileNo.:MJSP-03-003 April 15, 2003 Resolution 03-078 Page 1 OR BOOK i698 PAGE 888 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 NOW, THEREFORE, BE I- RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project to be known as Flagler Plat No. 1, is hereby approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc., dated March 7, 2003, and date stamped received by the St. Lucie County Community Development Director on March 7. 2003, subject to the following conditions: In conjunction with the review of any site plan; major or minor, including any re- platting or re-subdivision of the internal tracts within this development, the developer (Flagler or the r assigns) shall agree to construct, or agree to cause the construction of, primary uti ity lines (water/sewer) along the east right-of-way of South Jenkins Road from the intersection with Glades Cut-Off Road, to the pi'oposed area of development. The terms of this condition shall not appiy to any development application proposed for Tract 6, 6a and 6b of this development plat. Prior to the issuance of any type of site plan approval; major, minor, including any re- platting or re-subdivision of the internal tracts within this development, a environments impact assessment report consistent with the requirements Section 1 t .02.09(A)(5 of the St. Lucie County Land Development Code will be required as part of the ind vidual request for site plan or re-plat approval. Upon recording of the final plat for this subdivision, not other extension action for the site pan described in Part A above is required. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Flagler Development Inc., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permts of authorizations to commence development activities on the property described in Part A. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. A copy of this Order shall be attached to the site plan drawings described in Section A, which plan shall be on file with the St. Lucie County Community Development Director.
