Whigham. There was no one present to represent the property owner. Officer Vargas Barrios addressed the Chairman and Board and stated this morning we received an email from Mr. Whigham, she noted it has been placed on the Board’s folders and stated he is asking for a little bit more time. Mr. Murdock made a motion in reference to Case No. 91393 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on May 2, 2018. Mr. Taylor seconded and the motion carried unanimously. Case No. 91610, Location of violation, 251 N Cardinal Pl., Fort Pierce, FL, Property Owner, Ashley Erickson. Ashley Erickson, the property owner was sworn in by the Board’s Secretary. 3 Officer Vargas Barrios addressed the Chairman and Board and stated this case and the next one are companion cases and the contractor is here as well. Chairman Fogg asked Staff if that is Case No. 91659. Officer Vargas Barrios answered yes sir. Companion Case No. 91610 and Case No. 91659 were heard together. Officer Vargas Barrios addressed the Chairman and Board and stated she is submitting one (1) photo dated September 15, 2005 from a previous case taken by Officer Zervos and one (1) photo dated June 1, 2017 taken by her. She stated on the slide on the top photo it shows where the unpermitted structure and how it looked before it was renovated and on the bottom photo it shows what it looks like now. She stated she is also submitting aerials from 2014 and 2016. She noted the aerial from 2014 shows the unpermitted structure and the aerial from 2016 shows the first unpermitted structure that was renovated and a second structure added. She stated all were done without a permit. She stated she is also submitting two (2) photos dated June 1, 2017, this photo is showing the siding work being done without a permit, the next photo is showing the aluminum porch that was enclosed without a permit and the hardi -siding being added without a permit. She also submitted a copy of the property appraiser photo and sketch to show this was an aluminum porch. She stated on June 1, 2017 a Notice of Violation was sent to the property owner Ashley Erickson to please obtain a permit for enclosing the side porch and for the hardi-siding and also to obtain a permit for the two structures on the property with a correction June 16, 2017. She stated Staff met with the property owner and discussed ways to bring the property into compliance. Officer Vargas Barrios stated on June 15, 2017 a permit for the hardi-siding was applied for but it could not be issued as the aluminum porch was enclosed without a permit. She stated on January 12, 2018 a Notice to Appear was sent. She stated the homeowner is working with the contractor and the engineer to bring the property into compliance. She stated as of April 4, 2018 the permit for enclosing the aluminum porch, the hardi-siding and for the two structures have not been issued, this is in violation of St. Lucie County Land Development Code 11.05.01, Building and Sign Permits. She stated the property owner is here and she is asking for more time. Michael Zabitosky, the contractor was sworn in by the Board’s Secretary. There was discussion among the Board, Staff, Ms. Erickson, and Michael Zabitosky on the violation and the time frame for having it corrected. Chairman Fogg asked the Board if they had any questions. Mr. Taylor made a motion in reference to Case No. 91610 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on August 1, 2018. Mrs. Monahan seconded and the motion carried unanimously. Case No. 91659, Location of violation, 251 N Cardinal Pl., Fort Pierce, FL, Contractor, Zabitosky Construction LLC. Michael Zabitosky, the contractor was sworn in by the Board’s Secretary. Officer Vargas Barrios addressed the Chairman and Board and stated this case and the next one are companion cases and the contractor is here as well. Chairman Fogg asked Staff if that is Case No. 91659. Officer Vargas Barrios answered yes sir. Companion Case No. 91610 and Case No. 91659 were heard together. There was no one present to represent the property owner. Officer Williams addressed the Chairman and Board and stated Case No. 93655 and Case No. 94111 are companion cases and before you is a letter from Mark Handzel asking for a continuation and Staff is requesting sixty (60) days until the June 6, 2018 Code Board meeting. Chairman Fogg asked the Board for a motion. Mr. Taylor made a motion in reference to Case No. 93655 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on August 1, 2018. Mrs. Monahan seconded and the motion carried unanimously. Case No. 94111, Location of violation, 505 N 39th St., Fort Pierce, FL, Property Owner, Mark Handzel. There was no one present to represent the property owner. Officer Williams addressed the Chairman and Board and stated Case No. 93655 and Case No. 94111 are companion cases and before you is a letter from Mark Handzel asking for a continuation and Staff is requesting sixty (60) days until the June 6, 2018 Code Board meeting. Chairman Fogg asked the Board for a motion. Mr. Taylor made a motion in reference to Case No. 94111 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on August 1, 2018. 5 Mrs. Monahan seconded and the motion carried unanimously. Case No. 92365, Location of violation, 2607 Arnold Ct., Fort Pierce, FL, Property Owner, Alia Kazmi. Michael Waldrop, Innovation Contracting Inc. contractor for the property owner was sworn in by the Board’s Secretary. Officer Difrancesco addressed the Board and stated for the record she is submitting a total of five (5) photos, four (4) dated August 3, 2017, the photo you are looking at is the inside of a garage that has been converted to a living quarter, the next photo is also another photo of the same area, inclusive is also the drywall work on the ceiling , a window and also as you can see that wall has been fully enclosed which used to be a garage door, next is another photo of drywall as well above the hot water heater and that is a closer view of the garage enclosure near where the garage door used to be and a window and wall are now located. She stated she has another photo dated March 20, 2018 from the exterior of the home also showing again where the garage door has been enclosed and a wall and window installed. She stated she found 2607 Arnold Court to be in violation of 11.05.01 to obtain a building permit for the enclosed garage, new windows, and drywall. She issued a Notice of Violation letter on August 9, 2017 and gave a compliance date of August 23, 2017. She stated she has had contact with the property representatives Tony and Huda along with the contractor, Innovation Contractors, and explained the ways to remedy the violation. She stated they are here to ask the Board for more time to be issued the permit. She stated as of April 4, 2018 the property remains in violation. There was discussion among the Board, Staff and Michael Waldrop of Innovation Contracting Inc. on the violation and when it will be corrected. Chairman Fogg asked the Board if they had any questions. Mrs. Monahan made a motion in reference to Case No. 92365 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on June 6, 2018. Mr. Currie seconded and the motion carried unanimously. Case No. 92806, Location of violation, 338 Pandora Ave., Fort Pierce, FL, Property Owner, Investment Ventures Inc. Richard McGee, the property owner was sworn in by the Board’s Secretary. Officer DiFrancesco addressed the Chairman and Board and stated she is submitting a total of eight (8) photos, two (2) dated October 5, 2017, which the photo you are looking at is exposed wires behind the wall that the tenant complained upon and also some leaks under the structure from the bathroom specifically. She stated she also has six (6) dated March 28, 2018, these photos as well are again underneath the structure directly below the bathroom where a building inspector had come out and noticed there is not a trap to the plumbing and also the plumbing fixtures do not fit correctly as well. She stated those are still the exposed wires that are outside of the structure that is also a plumbing issue those are the washer and dryer hook-ups that do lead directly outside onto the ground. She stated she found 338 Pandora Ave. to be in violation of 13.08.01, Section 504, Plumbing Systems and Fixtures and 13.08.01, Section 604.3, Electrical Systems Hazards. She issued a Notice of Violation letter on October 6, 2017 and gave a compliance date of October 23, 2017. She stated she has had contact with the property owner, Mr. McGee and explained the ways to remedy the violation. She stated he is here to ask the board for more time to correct the violations. She stated as of April 4, 2018 the property remains in violation. There was discussion among the Board, Staff and Mr. McGee on the violations and when they will be corrected. Chairman Fogg addressed the Board stated we are looking for a motion. Mr. Currie made a motion in reference to Case No. 92806 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by June 6, 2018, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be held if the violation is not abated by the given compliance date. 6 Mrs. Monahan seconded and the motion carried unani mously. Case No. 93260, Location of violation, 6611 Fort Pierce Blvd., Fort Pierce, FL, Property Owner, Mohammad Afzal and Ghazanfar Saeed. There was no one present to represent the property owner. Officer DiFrancesco addressed the Chairman and Board and stated both this case along with the following Case No. 92891 there is a letter from the owner asking for a continuance to the May Code Board and a copy of it should be in the Board’s packet. Chairman Fogg addressed the Board stated we are looking for a motion. Mr. Currie made a motion in reference to Case No. 93260 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on May 2, 2018. Mr. Taylor seconded and the motion carried. Case No. 92891, Location of violation, 9301 Deland Ave., Fort Pierce, FL, Property Owner, Ghazanfar Saeed and Mohammad Afzal. There was no one present to represent the property owner. Officer DiFrancesco addressed the Chairman and Board and stated both this case along with the following Case No. 92891 there is a letter from the owner asking for a continuance to the May Code Board and a copy of it should be in the Board’s packet. Chairman Fogg addressed the Board stated we are looking for a motion. Mr. Currie made a motion in reference to Case No. 92891 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on May 2, 2018. Mr. Taylor seconded and the motion carried. Case No. 93605, Location of violation, Post Office Rd., Fort Pierce, FL, Property Owner, Midway Industrial Park POA. There was no one present to represent the property owner. Officer Brubaker addressed the Board and stated we received an email requesting a continuance to the next meeting and the Board should have a copy of the email. Mr. Murdock made a motion in reference to Case No. 93605 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on May 2 2018. Mr. Taylor seconded and the motion carried unanimously. Monir, & Sabone Monir 7 Mr. Taylor made a motion in reference to the cases read into the record that the Code Enforcement Board enter an Order of Finding against the violator finding the violator in default and if the violator does not appear to contest the violations against him/her that the Board adopt the recommendation of staff as set forth on the agenda. Mr. Murdock seconded and the motion carried unanimously. IX. FINE HEARING: Case No. 92345, Location of violation, 5106 La Salle St., Fort Pierce, FL, Property Owner, FLLI Homes LLC. There was no one present to represent the property owner. Officer Vargas Barrios addressed the Board and stated for the record she is submitting one (1) photo dated November 4, 2013 taken by Officer Swartzel from a previous case this photo shows the old doors, two (2) photos dated February 24, 2017 taken by Officer Swartzel, and one (1) dated January 9, 2018 taken by her, these photos are showing the new doors replaced without a permit. She stated this case was brought before the February 7, 2018 Code Enforcement Board and was found in violation by default of St. Lucie County Land Development Code 11.05.01, Building and Sign Permits, for not having a permit for the front doors. She stated the Board gave a compliance date of March 9, 2018. She stated on March 21, 2018 the permit has been issued, the property was in violation for twelve (12) days. Mr. Currie made a motion in reference to Case No. 92345 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff with regard to the existence of a violation, that we determine the violations have been abated and no fine is imposed. Mrs. Monahan seconded and the motion carried unanimously. Case No. 91299, Location of violation, 5900 Bamboo Dr., Fort Pierce, FL, Property Owner, Donald and Shonda King. Donald King, the property owner was sworn in by the Board’s Secretary. Officer Brubaker addressed the Board and stated for the record she is resubmitting four (4) photos, one (1) dated April 17, 2017 (showing the structure that was built) and two (2) dated February 5, 2018 (showing the structure built, the rails, he changed the structure and a pergola with a fence), the last photo is dated April 3, 2018 (showing the structure still built) is still in violation with no permit. She stated this case was brought to the February 2018 Code Board and found in default for Section 11.05.01, building a structure and rails without a permit, the Board gave a compliance date of March 9, 2018. She stated she has had contact with Mr. King and as of April 3, 2018 there is no permit and property remains in violation. Mr. King submitted a picture and a copy of deposit receipt to prepare engineering for the 2nd level deck. There was discussion among the Board, Staff and Mr. King on the violation and how he is correcting the violation. Chairman Fogg stated to the Board we are looking for a motion. Mrs. Monahan made a motion in reference to Case No. 91299 that the Code Enforcement Board continue this case to the Code Enforcement Board hearing on August 1, 2018. Mr. Taylor seconded and the motion carried unanimously. Case No. 92330, Location of violation, Lot east of 3906 Avenue O, Fort Pierce, FL, Property Owner, Amaral Petit and Oluremi Odediran. There was no one present to represent the property owner. Officer Moise addressed the Board and stated for the record she is submitting two (2) photos dated July 28, 2017, the photo before you shows the invasive species which are pepper trees which are encroaching the complainant’s property, the second photo shows that the pepper trees are still encroaching the property and have not been corrected , one (1) dated January 25, 2018, which shows the pepper trees still encroaching the neighboring property and one (1) dated April 3, 2018 which shows the property is still in violation. She stated at the February 7, 2018 meeting, the property 8 owner was not present and the Board found the property in default for Section 7.09.05 (B), Removal of Exotic Vegetation and gave a compliance date of March 9, 2018. She stated she has had no contact with the owner and as of April 4, 2018 the property remains in violation. Mrs. Monahan made a motion in reference to Case No. 92330 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by th e violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting March 10, 2018 with a maximum fine not to exceed $10,000.00. Mr. Murdock seconded and the motion carried. Case No. 92744, Location of violation, 1008 Shorewinds Dr. Unit A, Fort Pierce, FL, Property Owner, US Bank NA. There was no one present to represent the property owner. Officer Moise addressed the Board and stated for the record she is submitting one (1) photo dated September 27, 2017, which shows a hole in the roof of the structure and one (1) dated January 22, 2018, which shows the repairs have not been made to the roof and one (1) dated April 3, 2018, which shows the property is still in violation. She stated at the February 7, 2018 meeting, the property owner was not present and the Board found the property in default for Section 13.08.01, Section 304, for exterior structure to repair to the hole in the roof and gave a compliance date of March 9, 2018. She stated Staff has had contact with the owner and as of April 3, 2018 the property remains in violation. Mrs. Monahan asked Staff what the contact with the owner was. Officer Moise answered the owner is Bank of America and they have been in contact with Katherine Barbieri, Assistant County Attorney. Chairman Fogg asked Katherine Barbieri, Assistant County Attorney if she has been in contact with them. Katherine Barbieri, Assistant County Attorney, addressed the Board and stated the bank obtained title to this through foreclosure, we contacted the attorney that represented the bank for the foreclosure and sent them pictures and asked them for their assistance. She stated there was some communication back and forth at one point, but there has been nothing recently. There was further discussion among the Board and Staff on the violation and sending it to the Board of County Commissioners Chairman Fogg stated to the Board we are looking for a motion. Mrs. Monahan made a motion in reference to Case No. 92744 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting March 10, 2018 with a maximum fine not to exceed $10,000.00. Mr. Currie seconded and the motion carried unanimously. 2nd Motion to Refer to the B.O.C.C. Mrs. Monahan made a motion in reference to Case No. 92744 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the recommendation of staff with regard to the existence of a violation, we determine: The condition caused by the violation represents a serious threat to the public health, safety and welfare and Staff is directed to notify the St. Lucie County Board of County Commissioners of this condition. 9 Mr. Currie seconded and the motion carried unanimously. X. REPEAT VIOLATION: None. XI. REFERRAL TO THE BOARD OF COUNTY COMMISSIONERS: None. XII. FINE REDUCTION HEARING: Case No. 73461, Location of violation, 170 Bonita Ct., Port St. Lucie, FL, Property Owner, James L. Preston (EST). Fine Reduction requested by Kamau Kihohia. Kamau Kihohia, the new property owner was sworn in by the Board’s Secretary. There was discussion among the Board, Staff and Kamau Kihohia on the fine reduction request and his reasons for requesting a reduction in the fine. Mr. Currie made a motion in reference to Case No. 73461 that the Code Enforcement Board makes the following determination: The fine of $5,000.00 and prosecution cost of $200.00 imposed by the Code Enforcement Board is hereby reduced to the amount of zero. STAFF BUSINESS:  Discussion on Lien Amnesty Program – Officer Williams addressed the Board and stated we are getting ready to launch our second annual Lien Amnesty Program. She stated we give the citizens thirty (30) days to do the application and she recapped what the program is all about. She stated the Lien Amnesty Program is an incentive program to achieve compliance on code cases. She stated it is available on residential and commercial properties with outstanding liens. She noted eligibility is for 90% reduction of lien if they bring the property into 100% compliance. She stated this year it is between June 1, 2018 to June 30, 2018 and property must be in compliance with all code enforcement ordinances and the property owner must not have any active code cases for any properties owned in St. Lucie County. She stated a press release will be issued, applications will be accepted between June 1, 2018 and June 30, 2018, properties will be inspected to confirm there are no code violations and upon approval the reduced lien must be paid within thirty (30) days. She stated Staff will process the Satisfaction of Lien and Release of Lien, Staff will have the orders signed by the Board Chairman and Board Attorney an d record the liens with the Clerk of Court. She gave a recap of how many notices were mailed out last year and the monies collected. Katherine Barbieri, Assistant County Attorney addressed the Board and stated we are requesting a motion because all fine reductions are the pleasure of the Board so if you do not approve this program we cannot proceed. Mr. Currie made a motion to that the Board approves the 2018 Lien Amnesty Program. Mrs. Monahan seconded the motion and it carried unanimously.  River Park Sweep – Officer Williams informed the Board that Staff is doing their first neighborhood sweep in River Park on April 9, 2018. The Board has a copy of the letter that was mailed out a few weeks ago to the citizens of River Park. She stated Staff will be looking for outside storage, high grass, exterior maintenance, and unserviceable vehicles and will send notices out to the residents. She stated on the screen you will see how big the River Park area is and it is located in the center of Port St. Lucie. ADJOURN: The meeting was adjourned at 10:16 a.m.
