Sub Section: (5) Conspires with an unlicensed person by allowing a certificate of competency to be used by the unlicensed person to evade the provisions of this division. When a certificate holder allows his certificate to be used by one or more business organizations without having any active participation in the operation, management or control of such business organization, such act shall constitute prima facie evidence of an intent to evade the provisions of this division.  The contract shows the name of the business, but the qualifer Mr. Wooley was not aware of the job. Staff Recommendation: To suspend the permitting privileges not to exceed one hundred and eighty (180) days. 5 DISCIPLINARY CASE: 2) AGAINST: Quality Affordable Marine Construction Inc. Sub Section: (8) Abandons a construction project in which the contractor is engaged or under contract as a contractor. A project shall be considered abandoned 90 days after the contractor terminates the project without just cause or without proper notification to the owner, including the reason for termination, or fails to perform work under the contract for 90 consecutive days.  No permits were applied in the building department since the contract was done. Staff Recommendation: To suspend the permitting privileges not to exceed three hundred and sixty-five (365) days. 6 DISCIPLINARY CASE: 3) AGAINST: Faithful Roofers LLC Michael D. Williams State License # CCC1331265 County Cert #30337 Complaint filed by: Marjorie W. Chappell, owner of property located at 3015 Indigo Bunting Ct., Port St Lucie, FL 34952 Investigator: Monica Vargas Barrios First Notification to the Company: February 19, 2019 Follow-ups: Violation: SLC CCL 10-26: - Prohibited activities: Sub Section: (9) Commit any willful, fraudulent act as a contractor as a result of which another is financially injured.  Property owner had to pay another contractor to correct what the inspector failed on the permit Faithfull Roofers LLC pulled. SLC CCL 10-67: Revocation or suspension of certificates of competency. Sub Section: (3) Willfully disregards and violates an applicable state or local building code, regulation or law.  11.05.01 a2a – Permit Faithful Roofers LLC pulled for the roof remains expired. Staff Recommendation: To suspend the permitting privileges not to exceed one hundred and eighty (180) days. 7 DISCIPLINARY CASE: 4) AGAINST: Ark Home Remodeling Inc. Anthony Profeta County Cert # 23144 State License # CCC1326745 Complaint filed by: Tara Campbell, owner of property located at 8 Tosca, Fort Pierce, FL 34951 Investigator: Monica Vargas Barrios First Notification to the Company: February 27, 2019 Follow-ups: Violation: SLC CCL 10-67: Revocation or suspension of certificates of competency. Sub Section: (4) Performs any act which assists a person or business in engaging in the unlicensed business of contracting, as defined herein, if the certificate holder knows or has reasonable grounds to know that the person or business is unlicensed.  The permit was pulled by Ark Home Remodeling Inc and he is not the one who received the money from the property owner. Sub Section: (15) Aids or abets any unlicensed person or business organization to evade any provision of this division.  Pulling the permit for a person who is not licensed to do the work and who is receiving payment from the property owner. Staff Recommendation: To suspend the permitting privileges not to exceed one hundred and eighty (180) days. CITATION APPEAL: 2) Against: Mr. James Proctor / Arc Home Remodeling Inc. Locations: 8 Tosca, Fort Pierce, FL 34951 Violation: Engage in the business or act of the capacity of a contractor without being duly registered or certified.
