and declare this to be my LastWtll and Testament.
FIRST= I direct that m7 Just debts and
fUneral eXgenses he Paid as soon after my death as is
Practicable.
SECOND: I give and devise to my son, JOHN
DAVID SPEAR, my property in Flor/da known as Lot 14. Block
87, of Indian River Estates Unit 9, a Subdivision according
to the Plat thereof, recorded in Plat Book 10. Page 74,
of the Publlc ReCords of St. Lucle County, Florida and
being the same property described in Deed Book 362, page
2025. In the event that my eon JOHN fails to survive me,
then this der/se shall lapse.
All the rest of my estate, herein-
after referred to as my residuary estate, I give as follows:
(A) One-third to my Son, JOHN
DAVID SPEAR, Provided that he survives me. If he should
fai~ to survive me, then in that event I give and dev/se
his Share of my residuary estate to his son, ADA~LEE
SPEA~. subject to the terms and conditions of Paragraph

FOD~TH of this Will, if saidADAMLEE SPEAR has not
attained the age of tWenty-five (25) Years at the time
of my death;
(B) One-third to my daughter,
Ab'DENA S. SYRACUSE, provided that she survives me. If
she should fail to surv/ve me, then in that event I give
and der/se her share of my residuary estate, per stirpes,
Share and Share alike, to such of her children who sur-
Vive me, subject to the terms and conditions of Paragraph
FIFTH of this Will; and
(C) One-third to my daughter,
BARBARA WALTER, provided that she survives me. If she
should fail to survive me, ~hen in that event I give and
devise her Share of my residuary estate, per stirpes,
Share and share alike, to such of her children who sur-
vive me.
(D) If any of my aforenamed three
children, namely JOHN, AUDENA and BARBARA, should fail to
survive me and not have any children SUrviving me, then
that child's Share shall be divided eqUally by and among
those of my three aforenamed children who do survive me.
For purposes of this Paragraph THIRD the term children or
child with respect to my son, JOHN DAVID SPEAR, shall refer
to only his Son, ADA//LEE SPEAR.
FOURTH: If any part of my estate shall be-
COme payable or distributable to my grandson, ADAM LEE
SPEAR, who Shall not have attained the age of tWenty-five

The Term "edUcation,, as nsed in
this Parasraph, includes without lim/tatton, a primary,
SeCondary, vocational, college and P°st'~raduate education.
The Trustees shall PrOVide adequate amounts for all
la=ed ltVin~ and travel eXpenses as the Trustees, in
Their discretion, shall determine to be reasonable.
If my estate any beneficiary hereunder, with the exception
of ADA}fLEE SPEAR, is s minor, then I empower my EXecutrix,
in her discretion, to pay OVer the share of said minor to
the parent of that minor, in Which event the refundln~
bond of such parent shall be a Sood, sufficient and com-
Plete release and discharge of my EXecutrix in the matter'

SIXTH: I nominate, constitute and appeint
my daughter, ~JLARA WALTER, as EXecutrix of this my Last
Will and Testament. If she shall fail for any reason
either to assume or to complete the adm/nistra~ion of
my estate, then I nominate, ConstitUte and appoint my
daughter, AUDENA S. SYRAcuSE, as EXecutrix in the place
and Stead of my dauEhter BARBARA. I nom/nate, constitute
and appoint my dauEhters, BARBARA WALTER and AUDENA S.
SYRACUSE, or the survivor of them, es Trustees of any
trusts created or arising Under thc terms of th/s ~t1!.
I direct that no Executrix or Trustee designated by me
in this I~ill shall be required to §ire any bond or other
security for the faithful performance of =heir duties
as such in any ]Urisdlotion in which they may be called
Upon to act, the same being hereby expressly Waived.
SEVENTH: I make no provision for my son,
~ARTIN HALL¥, and make mention thereof only to indicate
that such was intentional and not inadvertent.
EIGHTH.. I may prepare a writ=eh statement
or list to dispose of certain items of my tangible Personal
property. I will either prepare this list in my hand-
writing, or I Will sign a tYPed list. If I have Prepared
such a list, it will be found with the original or with
a copy of my Last Wil! and Testament. My Executrix shall
make distribution of my tangible personal property as
provided for in such lis t.
I direct my Executrix to pay out
