Pierce Mark Handzel Case No. 97114 was heard first on the agenda: Case No. 97114, Location of violation, 3847 N. US Hwy 1, Fort Pierce, FL, Tenant, US 1 Golf LLC. Mr. Siwicki was sworn in by the Board’s Secretary. Officer DiFrancesco submitted a total of fifteen (15) photos. Seven (7) photos dated April 13, 2018, one (1) aerial photo from 2010, one (1) aerial photo from 2018, one (1) photo from the Property Appraisal dated March 29 , 2013, two (2) photos dated January 29, 2019, and two (2) photos dated June 3, 2019. She gave a detailed description of the photos presented. Officer DiFrancesco stated during her first inspection she found the property in violation of Section 11.05.01 for a permit being required for the exterior and interior renovations. She issued a notice of violation letter on January 3, 2019 with a compliance date of January 18, 2019. She has had contact with the tenant of the property and explained ways to correct the violations. As of June 6, 2019, the property remains in violation. She noted the companion case for the owner of the property is on the agenda for fine hearing today. Mr. Siwicki stated he was in violation; however he disagreed with Officer DiFr ancesco on her statement about the sheet rock. He noted that it is not sheet rock but instead paneling. He has a cont ract with Andros Roofing who should start construction approximately by July 10th. Mr. Chairman asked if more time is needed to obtain the permit. Lloyd Constant, 2706 Atlantic Ave., Ft. Pierce, FL was sworn in by the Board’s Secretary. Mr. Constant noted that he will be doing everything except the plumbing and the electric. He requested sixty days to get the permit and begin construction. Mrs. Monahan made a motion in reference to Case No. 97114 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by August 30, 2019, a fine of up to $250.00 per day may b e imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be hel d if the violation is not abated by the given compliance date. Mr. Pancoast seconded and the motion carried unanimously. 3 Case No. 97449, Location of violation, 106 S. Cardinal PL., Fort Pierce, FL, Property Owners, Stephen F. Collins and Pamela J. Collins. Stephen Collins, the property owner, were sworn in by the Board’s Secretary. Officer Moise submitted two (2) photos dated January 14, 2019, one (1) photo dated April 23, 2019, one (1) photo dated May 28, 2019, and one (1) photo dated June 3, 2019. She gave a detailed description of the photos presented. Officer Moise stated during her first inspection she found the property in violation of Section 11.05.01, to obtain a permit for the pool, deck, and the wooden structure. She issued a letter and gave a compliance date February 6, 2019. After getting no compliance, a certified Notice to Appear letter for the June 5, 2019 Code Enforcement Board was issued on April 9, 2019. She has had no contact with the owner. As of June 4, 2019 the property remains in violation. Mr. Collins noted he was in violation. He stated he never received the previously notices until one was posted on his gate on May 24th. He has had past history of stolen mail. He noted he was not aware the structures were not permitted when he purchased the property. He wanted the Board to know he was not the violator. It is his intent to file for the permits. Mr. Murdock made a motion in reference to Case No. 97449 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by September 50, 2019, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be held if the violation is not abated by the given compliance date. Mr. Taylor seconded and the motion carried unanimously. Case No. 97603, Location of violation, 2405 N. 44th St., Fort Pierce, FL, Property Owners, Marie O’Brien and Freizer Ventura. Marie O’Brien, the property owner, were sworn in by the Board’s Secretary. Officer Moise submitted one (1) photo dated September 18, 2017, one (1) photo dated February 13, 2018, twelve (12) photos dated February 7, 2019, one (1) photo dated May 24, 2019, and one (1) photo dated June 3, 2019. She gave a detailed description of the photos presented. Officer Moise stated during her first inspection she found the property in violation of Section 11.05.01, to obtain permits for the new roof, all the renovations that was done to the home and the stairs, rails, and deck, and Section 13.09.00, Section 303.2 to remove the mold and mildew from the structure. She issued a letter and gave a compliance date of February 21, 2019. After getting no compliance, a certified notice to appear letter for the June 5, 2019 Code Enforcement Board was issued on April 10, 2019. She has had no contact with the property owners. As of June 4, 2019 the property remains in violation. Ms. O’Brien noted she was in violation. She noted that her and Mr. Freizer’s intent were to repair the home and then sell it. Mr. Freizer did not do what he was supposed to do and now he has left the country. She now has a contract with a contractor, Patrick Silas, CBC1254328, who will be taking care of this. She noted that she has contacted an attorney. Mrs. Monahan advised Ms. O’Brien that she needed to keep in contact with Staff and Officer Moise. Mrs. Monahan made a motion in reference to Case No. 97603 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by September 20, 2019, a fine of up to $250.00 per day may be imposed. A cost o f $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month 4 after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be held if the violation is not abated by the given compliance date. Mr. Pancoast seconded and the motion carried unanimously. Case No. 98236, Location of violation, 5012 Killarney Ave., Fort Pierce, FL, Property Owner, Robert Dooling. Robert Dooling, the property owner, was sworn in by the Board’s Secretary. Officer Williams submitted four (4) photos dated May 16, 2016 and two (2) photos dated June 4, 2019 which shows the property is now in compliance. She gave a detailed description of the photos presented. Officer Williams stated during her first inspection on May 16, 2019 she found the property in violation of Section 38- 26 for having unserviceable vehicles and outside storage of tires, auto parts, and other miscellaneous items and Section 3.01.03(L) to cease repairing vehicles which is not allowed in Residential Multi Family zoning. She issued a letter and gave a compliance date of May 23, 2019. She has had contact with the property owner and the tenant. On May 24, 2019 a Notice to Appear letter was issued for the June 5, 2019 Code Board meeting. She noted that she inspected the property yesterday and the property was in compliance. She is requesting the Board to find the property as a “To Have Been” due to the amount of times the property had been cited for the same violations. The Chairman asked Mr. Dooling if he does not see the violations when he visits the property. Mr. Dooling answered he does see it. He noted he has contacted an attorney and the tenants have been given until August 1st. He admitted that this should have been done a long time ago. He submitted a copy of the letter. Mrs. Monahan made a motion in reference to Case No. 98236 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendation of staff with regard to the existence of a violation, we determine the violation, in fact, did occur and the alleged violator committed the violation. An order of enforcement is warranted. The violator is hereby ordered to refrain from future violations. Failure to keep the property in compliance may result in enforcement action as a repeat violation, in which case a fine of up to $500.00 per day may be impo sed from the date of notice to the violator of the repeat violation. Mr. Murdock seconded. All was in favor, except Mr. Pancoast. The motion carried. Officer Williams advised the Board that there are two more cases to be heard. Case No. 97051, Location of violation, 6701 Penny Lane, Fort Pierce, FL, Property Owner, James J. Perry. James Perry, the property owner, was sworn in by the Board’s Secretary. Officer Williams submitted a copy of the building permit and inspection card for Permit #1 406-0451. Officer Williams stated that on January 9, 2019, Officer DiFrancesco issued a Notice of Violation letter for being in violation of Section 11.05.01(2)a for having an expired electrical permit for the electrical connection. After getting no compliance a Notice to Appear was issued for the March 6, 2019 Code Board meeting. The case was removed from the agenda due to Mr. Perry request for more time to renew the permit. After no more communication with the property owner and the permit still not renewed, she issued a Notice to Appear letter for the June 5, 2019 Code Board meeting. She has not had any contact with the property owner since March and as of today, June 5, 2019, the property is still in violation. Mr. Perry noted that he was in violation. He stated he is here today to obtain the permit. Officer Williams stated he would need to renew or obtain a new permit. Mr. Pancoast noted that all Mr. Perry needed to do is get the permit and the case will be closed. 5 Mr. Stepalavich stated that there is a note in the system that states additional work such as mechanical work was also done. He noted that there might be more permits needed than just the electrical. Mr. Murdock made a motion in reference to Case No. 9 7051 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleg ed violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is n ot complied with by September 3, 2019, a fine of up to $250.00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Please take notice that on the 1st Wednesday of the month after the date given for compliance, at 9:00 am or soon thereafter, as may be heard, a Fine Hearing will be held if the violation is not abated by the given compliance date. Mrs. Monahan seconded and the motion carried unanimously. Case No. 96563, Location of violation, 2601 Essex Dr., Fort Pierce, FL, Property Owner, Rose Mary Harrison. Rose Mary Harrison, the property owner, was sworn in by the Board’s Secretary. Officer Moise submitted one (1) photo dated June 10, 2003 taken by Officer Zervos, one (1) photo dated October 10, 2018, and one (1) photo dated May 28, 2019. She gave a detailed description of the photos presented. Officer Moise stated during her first inspection she found the property in violation of Section 11.05.01 to obtain permit a permit for the enclosed garage. She issued a letter and gave a compliance date of January 10, 2019. After getting no compliance, a certified notice to appear letter for the June 5, 2019 Code Enforcement Board was issued on March 11, 2019. She has had contact with the property owners. As of June 4, 2019 the property remains in violation. Ms. Harrison noted the reason she has not taken care of this is due to medical issues. She requested two months. Mr. Murdock made a motion in reference to Case No. 96563 that the Code Enforcement Board makes the following determination: After hearing the facts in this case, the testimony, and the recommendations of staff with regard to the existence of a violation that we determine the violation in fact did occur and the alleged violator committed the violation. An Order of Enforcement is warranted. If the Order of Enforcement is not complied with by September 5, 2019, a fine of up to $250 .00 per day may be imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Langfitt Mr. Taylor made a motion in reference to the cases read into the record that the Code Enforcement 6 Board enter an Order of Finding against the violator finding the violator in default and if the violator does not appear to contest the violations against him/her that the Board adopt the recommendation of staff as set forth on the agenda. Mr. Murdock seconded and the motion carried unanimously. IX. REPEAT VIOLATION HEARING: Case No. 98190, Location of violation, 6406 Oleander Ave., Ft. Pierce, Property Owner, Michael A. Tracey. There was no one present to represent the property owner. Officer Goycochea submitted four (4) photos. Two (2) photos dated May 7, 2019 and two (2) photos dated June 3, 2019 which shows the violations have been corrected. She gave a detailed description of the photos presented. Officer Goycochea stated the property came before the Board on February 6, 2019 and was found in violation of Section 38-26 for having outside storage of items and materials. On May 7, 2019, she found the property again in violation of Section 38-26 for having outside storage. On May 8, 2019, she issued a Notice of Repeat Violation. She has had contact with the property owner’s daughter. She noted that the property has been brought into compliance; however, it was in violation for twenty-six (26) days. Mrs. Monahan made a motion in reference to Case No. 98190 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation previously committed has been repeated and having considered the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $500.00 per day shall be imposed for each day the violation exists starting May 8, 2019 with a maximum fine not to exceed $5,000.00. A cost of $200.00 has been imposed as the cost for prosecuting this case. The motion fails due to lack of a second. Mr. Pancoast stated he understood about the repeat violation, but he does not want to fine someone a fine that size. Mrs. Monahan noted that the property was a rental. Officer Goycochea clarified that the property is not a rental. Mr. Pancoast noted that they needed to get their attention so they should do a one-time fine along with the prosecution cost. Mrs. Monahan stated it took them almost a month before they cleaned it up. She inquired about the previous case. Officer Goycochea stated that the case abated before the fine hearing. Mr. Pancoast made a motion in reference to Case No. 9 8190 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation previously committed has been repeated and having considered the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A one-time fine of $500.00 has been imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. Mr. Murdock seconded. All was in favor, except Mrs. Monahan and Mr. Pancoast. The motion carried. Case No. 98221, Location of violation, 221 SE Camino St., Port St. Lucie, FL, Property Owner, Frank D. Acquaro. Frank D. Acquaro was sworn in by the Board’s Secretary. 7 Officer Goycochea submitted eight (8) photos. Four (4) photos dated May 7, 2019, two (2) photos dated May 29, 2019, and two (2) photo dated June 3, 2019 . Officer Goycochea stated the property came before the Board on February 2019 and was found in violation of Section 38-26 for having outside storage of items and materials and Section 8.00.03(F) for having more than two (2) recreational vehicles. On May 7, 2019, she found the property again in violation of Section 38 -26 for having outside storage of items and materials and Section 8.00.03(F) for having more than two recreational vehicles. On May 8, 2019, she issued a Notice of Repeat Violation. As of June 3, 2019, the property is in compliance; however the property was in violation for twenty-six (26) days. Mr. Acquaro stated he will be installing a storage shed on the side of the property along with a driveway where he will park his boat. Mrs. Monahan inquired about the last case. Officer Goycochea stated that the case was found in default and abated before the fine hearing. Mrs. Monahan noted that there are two cases before them. The first one did not have the courtesy to appear before the Board so Mr. Acquaro should not be treated the same because he is here today. Mr. Pancoast made a motion in reference to Case No. 9 8221 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation previously committed has been repeated and having considered the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A one-time fine of $500.00 has been imposed. A cost of $200.00 has been imposed as the cost for prosecuting this case. The motion fails due to lack of a second. Mr. Murdock made a motion in reference to Case No. 9 8221 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation previously committed has been repeated and having considered the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A one-time fine of $100.00 has been imposed. This fine must be paid within thirty (30) days or an additional $200 prosecution cost will be imposed. Mrs. Murdock seconded and the motion carried unanimously. IX. FINE HEARING: Case No. 94718, Location of violation, 3847 N US 1, Ft. Pierce, FL, Property Owner, Fort Pierce Driving Range Prop. Mr. Siwicki and Mr. Constant reintroduced themselves. Officer DiFrancesco resubmitted a total of twelve (12) photos. Seven (7) photos dated April 13, 201 8, one (1) aerial photo from 2010, one (1) aerial photo from 201 8, one (1) photo from the Property Appraisal dated March 29 , 2013, two (2) photos dated January 29, 2019, and submitted two (2) photos dated June 3, 2019. She gave a detailed description of the photos presented. Officer DiFrancesco stated the case was brought before the November 7, 2018 Code Board meeting and found in default for being in violation of Section 11.05.01 for a permit being required for the exterior and interior renovations. The Board found the case in default and gave a compliance date of December 7, 2018. The case was brought to the February 6, 2019 Fine Hearing. The manager Jeff Carpenter was present and requested a continuation to the June 5, 2019 meeting to allow time to correct the violation. As of June 6, 2019, the pr operty is still in violation. 8 Mrs. Monahan made a motion in reference to Case No. 94718 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting August 30, 2019 with a maximum fine not to exceed $10,000.00. Mr. Pancoast seconded and the motion carried unanimously. Case No. 93819, Location of violation, 370 E. Midway Rd., Fort Pierce, FL, Property Owner, Steven R. Patterson. There was no one present to represent the property owner. Officer Williams resubmitted two (2) photos dated July, 2018, two (2) dated December 4, 2018, one (1) photo dated January 7, 2019, one photo dated February 4, 2019 taken by former Officer Brubaker and submitted two (2) photos dated June 3, 2019 taken by her. She gave a detailed description of the photos presented. Officer Williams noted the case was brought before the December 5, 2018 Code Board meeting and was found in default for Section 13.09.00, Section 303.2 to obtain a permit to repair the section of the home that is falling apart. The Board gave a compliance date of January 4, 2019. At the February 6, 2019 Fine Hearing, Mr. Patterson was present. The Board continued the case to June 5, 2019. As of today’s date, the property remains in violation as no permits have been issued to either repair or demolish the home that is falling apart. Mrs. Monahan made a motion in reference to Case No. 93819 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the viola tion, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting June 5, 2019 with a maximum fine not to exceed $10,000.00. Mr. Murdock seconded and the motion carried. Mr. Murdock noted that the Board gave Mr. Patterson six months to bring the property into compliance and he did not have the courtesy to come today. Case No. 97102, Location of violation, Behind 5913 Bamboo Dr., Port St. Lucie, FL, Property Owner, Andy M. Cordiero. There was no one present to represent the property owner. Officer Williams resubmitted one (1) photo dated December 17, 2018 taken by former Officer B rubaker. She submitted one (1) photo dated March 22, 2019, one (1) photo dated April 1, 2019, and two (2) photos dated June 3, 2019 taken by herself. She gave a detailed description of the photos presented. Officer Williams noted the case was brought before the April 3, 2019 Code Board meeting and was found in default for Section 7.09.05 to trim back the pepper trees that are hanging over the neighbor’s property. Since no one was present to represent the property owner, the Board gave a compliance dat e of May 3, 2019. She has had no contact with the property owner. As of June 3, 2019, the property remains in violation. Mrs. Monahan made a motion in reference to Case No. 97102 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting May 4, 2019 with a maximum fine not to exceed $10,000.00. Mr. Murdock seconded and the motion carried unanimously. 9 Case No. 96277, Location of violation, 167 NE Hemet St., Port St. Lucie, FL, Property Owner, Adriana M. Serna. There was no one present to represent the property owner. Officer Goycochea submitted four (4) photos. Two (2) photos dated September 14, 2018, one (1) photos dated March 4, 2019, and one (1) photo dated June 3, 2019. She gave a detailed description of the photos presented. Officer Goycochea noted the case was brought to the March 6, 2019 Code Board meeting for being in violation of Section 11.05.01 to obtain a permit for the roof. The Board found the case in default since no one was present to represent the property owner. The Board gave a compliance date of May 2, 2019. She has not had any contact with the property owner and as of June 3, 2019 the property is still in violation. Mrs. Monahan made a motion in reference to Case No. 96277 that the Code Enforcement Board makes the following determination: After hearing the facts in the case, the testimony, and the report of staff that the violation still exists, after considering the gravity of the violation, the actions if any taken by the violator to correct the violation and any previous violations, we make the following determination: A fine of $250.00 per day shall be imposed for each day the violation exists starting May 3, 2019 with a maximum fine not to exceed $10,000.00. Mr. Spatara seconded and the motion carried unanimously. Case No. 96482, Location of violation, 4216 Rose Lane, Ft. Pierce, FL, Property Owner, Lauren M. Blaylock. There was no one present to represent the property owner. Officer Goycochea submitted six (6) photos. Two (2) photos dated February 7, 2019, one (1) photos dated March 22, 2019, one (1) photo dated April 2, 2019, and two (2) photos dated June 4, 2019. She gave a detailed description of the photos presented. Officer Goycochea noted the case was brought to the April 3, 2019 Code Board meeting for being in violation of Section 38-97 for having excessive overgrowth of grass and weeds and Section 38 -26an unserviceable vehicle. The Board found the case in default since no one was present to represent the property owner. The Boar d gave a compliance date of May 2, 2019. She has not had any contact with the property owner . She noted the overgrowth has been abated and as of June 4, 2019 the property is still in violation for the unserviceable vehicle. There was no one present to represent the property owner. Officer Moise resubmitted one (1) photo dated February 22, 2019, two (2) photos dated March 4, 2019, one (1) photo dated March 5, 2019. She submitted one (1) photo dated May 24, 2019, and one (1) photos dated June 3, 2019. She gave a detailed description of the photos presented. Officer Moise noted the case was brought to the March 6, 2019 Code Board meeting for being in violation of Section 38-26 for outside storage, Section 38-97 for overgrowth, and Section 11.05.01 (2)A to renew the expired permit for the roof. She stated the owner was present and the Board found the violation and gave a compliance date of May 2, 2019case in default since no one was present to represent the property owner. The Board gave a compliance date of May 2, 2019. She noted the overgrowth has abated.
