- It is our understanding that the plans for Miramar North
II need to be resubmitted in order to change the permit to
the new contractor.
The accompanying plans, less sheets A2, A4, and A22, are
the same as originally submitted. We are aware that code
changes have occurred since the original permit was
granted, and the plans are being revised to cover these
changes. Once they have been done, the plans will be
resubmitted.

Dear Mr. Virta:
This is to request your confirmation, behalf of St. [ooia
County (the "County"), of certain information provided to the
undersigned and The Majestic Group, Inc. relative to the above -
referenced project.
1^ The County will issue a replacement permit for the one
cited above based upon the plans originally filed and approved
for such prior permit. Said replacement permit will he issued to
3eppala & &bo Construction Company, Inc. as the general
contractorb Majestic Group, Inc.,its assigns
' ("Majestic")only to the cooucy'o verification of the
' proper licensing and other legal qualifications of such
construction company. The replacement permit will be issued
within two ) noeba of the Cnuuty'm receipt of the complete
application for same. o
2^ Majestic will, nitblu sixty (68) days of the date of
the ioaouucn I of the replacement permit, file with the county such
changes to too plans for the subject project as are necessary to
(i) ouuoo such plans, and the improvements to be onootcouted in
accordance therewith, to comply with all building and fire codes
in effect as of the date of the issuance of the replacement

compliance with current codes) as Majestic may deem appropriate,

If The Majestic fails to deliver the revised plans within sixty
(60) days or if the revised plans fail to meet current onUoa and

it is understood and agreed that the building permit will be
revoked and that construction shall immediately cease.

3. Upon the issuance of the replacement permit, Majestic
and its construction company will be entitled to commence
construction of the foundation and structural portions of the
subject) project, same to be inspected by a threshold engineer
registered with the County.
4. Subject to the approval, of the County as to the plans
therefore and the necessary minor adjustments to the site plan
for the project, Majestic and/or Seppala & Aho Construction
Company, Inc. will be entitled to apply for and obtain permits
for the construction of a free-standing building in the parking
area of the projectcontainingtwenty-two (22) enclosed garages
and for the construction of a pool and pool deck area on the
ocean 'side of the proposed high-rise building, the latter
constituting a change in the original plans for such area.
Again, though, it is understood and agreed that the permit for
the garage building and for the.enhanced pool and pool deck area
will be subject to the approval of the County in accordance with
its current standard requirements.
If the foregoing is an accurate statement of the position of
St. Lucie County, I would appreciate it if you would so indicate
by counter -signing the enclosed copy of this letter where
indicated and returning same to myself.

The Division of Beaches and Shores of the Department of
Natural Resources has completed a review of the circumstances
concerning the status of the construction on your property
located between approximately 50 feet and 430 feet north of_the
Department of Natural Resource's reference monument R-106, in St.
Lucie County. The Department staff has determined that the con-
dominium, Building 2, the parking garage, the swimming pool and
the parking area were "under construction" pursuant to the defi-
nition contained in Subsection 16B-33.002(56), Florida
Administrative Code, at the time of the reestablishment of the
coastal construction control line on September 15, 1988, based on
a site inspection by the staff on that same date. .
Pursuant to Subsection 16B-33.002(56), Florida Administrative
Code, "under construction" is defined as follows:
..the continuous physical activity of placing the
foundation or continuation of construction above the
foundation of any structure seaward of the coastal
construction control or setback line. Under
construction does not include application for or
obtaining a building permit, a site plan approval or
zoning approval from the appropriate local government
agency having jurisdiction over the activity,
purchasing construction materials, placing such
construction materials on the site, clearing or
grading the site in anticipation of construction,
site suryeying, continuation of site work beyond the
limits of the foundation including landscape work or
construction of nonhabitable major structures or
rigid coastal or shore protection structures, or
reactivating construction after substantially all
construction activity has remained stopped for a
period of six months or more."
