REVOCABLE LICENSE AGREEMENT
THIS,AOkEEMENT,made and entered this , 1.$ day'of 2020,by-.and

WHEREAS,the Owher.ownsihe,prooertydescribed as follows:
Driftwood Manor,Section One,Lq1t_10j accordtng to:Plat Book 18,.Page.6,of the
'Public Rkords:af 5t.',Lucle County,.Florida

WHEREAS,the Owners have.reguested.a Revocable License Agreement fof-a 6-ft PVC fence
as shown on"Exhibit A. There.is 15-ft drainage&•utility ease'rnerit located-along;the rear-of the;
property line of the subject parcel. The property Owners will-extend a "few feet Into, the,
..easement,but will not go all.the way to the-rear of the properfy.11ne:
'WHEREAS, 'the County is willing to".permit 'the Owners to encroach -in the rear
drainage/utility easement for,the purpose afdnstalling a fence subject to the terms an&conditions
set;forth in this Revocable License Agreement.
NOW,THEREFORE;In consideration ofthe mutual covenants set,forth herein,the parties
agree as follows:

1. The-County agrees to grant the Owner`s a"Revocable License Agreement fora 6-ft PVC,
fence;which will partially encroach in the rear drainage/utility easement. This Revocable License
shall extend only to the referenced PVC fence and shall not-extend to the construction and/or
installation of any additional.struchi'res or utilities:

2: The sole purpose of'this Revoceile License:Agreement is`to:graet the_Owner's.
permission,to Kkail'and maintain the fence!in the rear••drainagelutili, easement. 'T1ie.Owners
agree.that if theXounty Englneee and/ar�Utilities:DepartmerifAtermine the fence is causing
problems ar#he fence needs to•be removed or-relocated the fawners=vrlil da so atthe Owners'We
expense.
3. Pursuant to the terms,and conditions contained In tails,Agreement, the-County

authorizes the Owners to instal!a!?vG fence with`gate's inthe rear,.drainagg4tilky easement.
4. The Owners shall maintain the easement-aiong theirfehce#n'accordance w#th Standard
Specifications for Public Works Construction-_#n St. Lucie W.nty,.Florida. The fence shall not.
interfere-with the use of the easement and,any damage to the.easement shall-be repaired by
'Owners:
S. This.Revocable License Agreementshall be.binding on future successors.and.assignees
of the Owners,provided that Owners g#ve adeouate hotice,to the County pursuant.to Paragraph
twelve,(12)of this Agreement.
6. The.Countyshall,have the right,at the sole discretion of the County-Engineer and/or
Utilities Department to terrtilnate this Agreement with or-without cause and require removal of
the encroachment at the Owner's sole expense upon ninety(90)idays written,notice'to the.Owners;
The County rig#neer or Utilities Department may;'ln.11eu of termination,request that,thii Owners
perform certain alterations to the fence orthe focation.of the fence,at the'Owners'sole.expense.
HaWever,Efsuch alteration ismot performed td:the satisfaction of the County.-Eng#neeror Utilities
Department;.the County shall be entitled to exercise its right-toteiminate this.Agreement.

7. Upon the.abandonment of the Ance,,the.expiration of this Revocable License
Agreement,or the revocation of this Revocable License Agreement,.whichever occurs:first,the
Owners-shall.be responsible for the removal of thefence•and repair of the easement,if necessary.
8. The-term of this Revocable License Agreement,shall begin:on'the,date,first-above
'written and shall remain in effect unless otherwise revoked or abandoned as provided hereln.
9: OWners.agree to relocate the:cefer&iced fence, at any time and at no.cost to-the,.
County,if necessary for the:maintenance or Irri rovefiients of easement by the County or Utilities;
Department.
10. The'fence shall be Installed in accordance-With all applicable building codes and
permitting regulations of the County and shall be.mairitained solely at the expense of the Owners.
.Any maintenance or relocation activity will be subject to the written approval ofthe County
Engineer and/be Utilities Department.
11. The Owners agrees to a1l6w.County employees access'to the location of the fence for
County purposes as determined by the County Engineer and/or.Utilides'Departinent.
12. All.notices;request and other communications•deaiing•dlrectlyor Indirectly with this

license shall be in writing and shall be(as elected.by the person giving such notice)hand delivered
by messenger or carrier service, telecommunicated, or.mailed.by registered or certified.mail
{postage prepaid}return receipt requested;address to:

13. As consideration for the County granting this_Revocable-License Agreement,the Owners;
agrees to indemnify and hold the County harmless from and against:all-claims,liability,demands;
damages,expenses,:fees,fines penaities,suitsproceedings,actions:and costs of;actlons,including
reasonable,attomey's fees of'any,idnd.or nature,arising,or;in any way connected.•with the use,
occupation,..management,_or•control of the'above property-by County or its'agents, servants,
employees, patrons, or invitees, or"resulting injpjury-to persons-&-property, or loss of life or
property of any[rind dr.nature.whatsoever,:sustalned during Llcensee=s use of the property.
-14. The Owners shall promptly pay to recordthis Revocable Llcense Agreement in the Official.
Records of St.Lucie County,Florida. The Owners,shal(pay any document excise taxes.and the
cost of recording this Revocable License Agreement,
IN WITNESS WHEREOF,the parties have executed this Agreement on the,day and year
above first written.
