Thanks for taking the time to speak with me on Monday,1/13/2020 and emailing me the package to file
a complaint. As we discussed this started because I had been told that my roof had received a final
inspection prior to January 12,2020 by Brett Gregory,roofing contractor installing a standing seam
metal roof on my home. Of course,they are looking for final payment.
I reached out to the building department for a status of the inspection,as an online inquiry did not show
any inspections completed. I spoke with Ellen and described the situation,she indicated there were no
inspections done,there was the need for inspections prior to a final being requested and that no
inspections would be done until the contractor provided certain insurance documents that has been
expired for approximately 50+days. She recommended that I speak with you and transferred the call.
Here is the timeline and concerns for our roofing project on our home located at 4707 Regina Drive,Fort
Pierce, FI 34982 Permit#SLC 1911-0015:
September 14,2019 Brett Gregory came to our home to look at our roof,measure and to discuss roof
options. We indicated we wanted to go with a Standing 5eam Metal Roof,we looked at colors from a
color chart. He gave us an estimated verbal price and indicated he would tum the measurements into
the office where they would run a materials list and Issue pricing. The verbal price was quite high,so we
also asked for a priced on SV metal roof for comparison.
September 20,2019 received a written estimate from beregory@rssfiorida.com via email.We then
began corresponding on various details of the bid and contractor info,license info,company name,etc.
All responses were from bereeory0rssfioride,com.
On 5eptember 21,20191 emailed bgregory(@rssfic)rida.com about the deposit check and where to mail
it. Response from Mark Gregory was to make check out to Brett Gregory and mail to 216 S Norton Ave
in Orlando,Fl. We asked about timeline for roof completion and were told since it was out of their
market area,they would work the job in on Friday thru Sunday. It would take 2 full weekends, 1
weekend to strip the roof and install ice&water shield and 2nd weekend to install metal panels and
finish up.
September 27,20191 Barbara Lynn Hawley signed the proposal and mailed with deposit check in the
amount of$5,560.00 with the selection of the Armour Loc 26ga galvalume panels for$13,900 total
price. The roofing scope was to removed shingles down to plywood inspect all plywood for rot&nail
plywood to meet code. Install ice&water shield on hold house,install metal panels and valley&hips&
racks&eves& ridges metal.
Deposit check$5,560.00 cleared my bank account on 10/4/2019
Start date was told to be 2-3 weeks after signing of contract.(Oct 181 would be 3 weeks).Email from
Brett Gregory on 10/4/2019 indicated hoping to start on 10/11/2019.
On 10/7/2019 email from Brett indicating permitting was going well and just waiting for 15`Coast Metals
to send product approval and confirmation date for delivery.
On 10/11/20191 emailed Brett to see if roof would be started today,thinking they would be
transporting materials. Hoping to start on 10/18/2019.On 10/16/2019 estimated start date to be
10/2S/2019.On 10/16/20191 inquired as to the permit status.Brett Gregory responds metal to be
delivered to my house on 10/17/2019.Possibly start 10/19/2019.Brett Gregory responded getting
permit on Friday 10/18/2019.
October 17,2019 materials delivered.
October 21,2019 Brett emails indicating permitting process has changed and I need to sign and have
notarized. Will come Thursday morning 10/24/2019 for me to sign.I suggested they email to me so I
could get them signed and notarized and he could just pick them up. I inquired if the permit had been
rejected for signature and notarization as I could go to Building Department and sign.
October 22,2019 Scott Medlin emailed from smedlin @rssflorida.com emailed the permit application
for me to sign and get notarized.On 10/22/19 1 email Brett Gregory @ bigreeorryC@rssfiorida.com saying I
could sign,scan and email back, he responded he would come pick them up so I left them on my back
porch for him to pick up.
10/28/2019 email from Brett Gregory looks like weather will be good for upcoming weekend and that
he would be down later in week to pick up permit.
Work began on 11/2/2019 however after just a short period of time after they sta rted to remove the
existing shingled roof Brett came and spoke with my husband and said"your roof appears to be solid,
there is no need to remove the existing shingle roof we can install everything on top of shingles are you
okay with that?" My husband asked if there would be any issue with county and permit regarding and
was told no. So,my husband agreed.
I spoke with Brett about the permit indicating that the shingle roof would be removed and what
implications we would be facing with inspections,he said none that he had already spoke with
permitting and permit had been modified. I also inquired about periodic inspections and he indicated
since they were merely going over existing roof there were no interim inspections required.
There was no work performed on the job site from 12/8/2019 until 1/11/2020. On 1/12/2020 as we
were leaving Brett asked if we would be back home in the afternoon. We replied no. He said they
would be finished so if we could look over the roof and just mail the final check. We inquired about the
final inspection and he said it had been done.
We have not yet had the opportunity in daylight hours to look at the roof.
As of writing this complaint on 1/14/2020 at 3:00 p.m, the gutter is still laying in the front yard and
other areas have not been corrected.
Once we can walk the roof in daylight hours, I will contact all parties with any issues or concerns.
There will be no additional funds disbursed on this job, until we are 100%satisfied with the job,the
county has worked with the lice nsed.cont ractor as to what has to be done to grant a final inspection and
resolution to the interim inspections that were not done,meets those requirements set forth by the
county,provides us with engineers letters for warranties(transferrable)and a letter from the licensed
contractor giving us a 5 year warranty on workmanship with no exceptions,deductibles.

This is just to put into writing the areas of the roofing project that we are dissatisfied with
at this point. We do understand you are not finished with the job, but do not see how
these areas can be resolved.
You and Jimmy spoke about many of these by telephone on 111291.2019 and you and I
again today 1113012019.
First, I want to say that we are disappointed in ourselves for two decisions that we have
made since the job started. They are listed below:
Allowing you to take a short cut and not remove the existing shingle roof. This decision
was based on you telling us that our roof was solid and you did not expect to find any
damaged sheeting that would need replacing and that the Peel n Stick(Ultra HT Wind &
Water Seal) could be placed over the existing shingles and would not impact any
material/labor warranties.
After researching the installation specifications of this material, it clearly states this
material is to be installed as shown below:

The surface to which MFM Wind &Water Seal is to be applied must be smooth,
clean, dry and free of contaminants.
Use an asphalt-based primer as necessary to prepare the deck. You must use an
asphalt primer if installing over concrete, weathered OSB, Densdeck or similar
surface.
As you are well aware, many days the shingles were still wet from the rain, so 1 believe
that is an issue. Also, the shingles were in no way smooth, clean or free of
contaminants. There was_no asphalt primer used. And the underlayment that I
observed being laid down I did not see any rolling of the seams.
Additionally, there is not underlayment on 100% of the roof. Primarily in the front of the
house.
You did not state that you would reduce the cost of the contract by taking this
approach. I know this saved at least a full day's labor and the cost of discarding the
materials.
Second poor decision we made was advancing an additional $2,500 to you so you
could pay your guys. This should have been your burden not ours. Reputable
contractors stick to the terms of the contract. I do realize we could have declined, but at
the time felt things were going okay.
Now let's move on with other concerns that have been addressed with you by either
myself, or Jimmy. Jimmy walked the entire roof and has photos which he will be
sending to me of the areas of concern and/or poor workmanship.
1. Several areas of the roof where has metal that is pieced together and not full
sheets.
2. The way the metal is folded under after the drip edge has been installed.
3. The fact that the drip edge does not run with a level straight edge but is wavy.
4. The way the corners are done with the drip edge with multiple small pieces.
5. The fact that the roof is not covered 100% by the underlayment.
6. The concern that the underlayment has been installed overtop of existing shingles
and does not appear to meet installment specifications of the manufacturer,
7. Several panels which are not properly secured and do not run in a straight line
8. Several panels that are indented from nail heads that were raised on the existing
shingles or are not laying level and flat.
9. You agreed to remove the existing gutters and reinstall, however, this did not occur .
and it appears the gutters were loosened and pulled down to install the metal/drip
edge, etc. and now are all bent out of shape and some of the screws pulled through
and there are holes in the gutters that were,not there previously.
10.Finish of the gable's ends are choppy and do not look professionally finished.
Please, do not take this as all of our concerns or issues, but these are the ones off the
top of my head. Once done we will do a walk around and look at the roof from the
ground and walk on the roof at the work.
Timely completion of the job, when the job was bid you indicated one weekend to strip
existing roof and install underlayment. Weekend being Friday, Saturday& Sunday.
Then a second weekend to install. This had not happened; I know a few times the
weather had an impact but just coming one day on the weekend will not get the job
done timely. I do not think there has been a weekend that you and your crew have
been here Friday—Sunday. You have indicated multiple times that you will be back on
a certain day and then don't show and text that it will be a different day. I believe the
first weekend day that you were here was on Nov 2nd and here we are approaching
December 2"d and still not finished.
Here are a few things you stated today when we walked the project from the ground in
response to my concerns above:
Concern Resolution
#1 This morning you indicated that you would order full sheets to replace
those areas that are pieced together. You indicated these were required
by the manufacturer to serve as expansion joints.
This afternoon you indicated that you were going to manufacture material
to cover the seams where they are pieced together. I am not sure until it
is done that it will be aesthetically pleasing to look at.
I indicated that I wanted an engineer letter from the material manufacturer
of the Armour Loc system (1st Coast Metal Roofing System) to my
attention that states these are required and if the pieces are replaced by
full sheets so they look more uniform and blend with the remaining roof
that there will be no impact to the warranty of materials/labor should
issues arise in the future. This should be specific to my property and to
current and/or future owners of the home.

#9 This morning you indicated that you would have a gutter company that you
do business with quote the job to replace existing gutters and install
gutters around the entire home and you would pay for materials and work
out something on the labor with us. I indicated that you should cover the
entire cost as we should have been given a credit for the lack of stripping
the existing roof materials. You indicated that was fair.
This afternoon you indicated that you had spoke to your gutter guy and
that you would cover all costs to have new 6"gutter and downspouts
installed around the entire house. It will be a cream color to match the
fascia/soffits.
I indicated that I wanted an engineer letter from the material manufacturer
of the Armour Loc system (1st Coast Metal Roofing System) be obtained
by you and RSS Roofing specific to our home that the way you finished
the edge of the roof line meets the specifications for finishing the edges by
folding over the drip edge and that our manufacturer material warranty
remains in place and a letter from you and RSS Roofing that the extended
warranty remain in place for any future issues. This should be speck to
my property and to current and/or future owners of the home.

#6 You indicated you would confirm that the roof is 100% covered with
underlayment by pulling up all the metal in front of the house and installing
the material.
I want a written letter from yourself/RSS Roofing certifying that this has
been done. There will be no way for us to confirm this as we are not
watching it be done unless we have someone lift the panels and spot
check.
I requested that an engineer letter be obtained by you and RSS Roofing
from the manufacturer (MFM Building Products) specific to our home that
installing the underlayment over the existing 15 year old shingle roof that
could have been damp from rain was acceptable to the manufacturer of
the product and that our manufacturer material warranty remains in place
and a letter from you and RSS Roofing that the extended warranty remain
in place for any future issues. his should be specific to my property and to
current and/or future owners of the home.

#8 You indicated that you were aware of a few and this would be resolved as
the roof was being finished. I request that any metal that is indented due
to nail heads from existing roof or other objects underneath be removed
and replaced as well as any panels that are not smooth a lay flat be
resolved.
#10 You were going to re fabricate these to give cleaner lines and a better

appearance.
In summary, this is a large project for a homeowner but in scope and cost. We have
looked at a number of metal standing seam roofs (maybe not Armor Loc) and have not
seen things that appeared like poor workmanship/quality.
Perhaps you could have the metal supplier put us in contact with other roofers and
home owners in our area that have the Armor Loc roof so that we could look at them.
I will be going to the building department on Monday to discuss with them and a building
inspector of my concerns regarding the permit indicating that the existing roof would be
removed and new roof installed. I will also inquire as to if any inspections were required
prior to the final. You indicated none were required and that you notified the building
department of the modified scope and they updated their records. I looked at the permit
online and have not seen such modification and there is no permit on the jobsite site for
me to review for such changes. I have a copy of the original which has not been left on
the jobsite.
Until all issues are resolved to our satisfaction, please accept this as notice there will be
no additional payment made until such issues/concerns are resolved to owner's
satisfaction.
The homeowner at their discretion may have an independent roofer, licensed general
Contractor, wind mitigation inspection, general home inspector and or building inspector
review the roof and provide their opinion of the quality and workmanship and
compliance with manufacture specifications.
The homeowner agrees and encourages that the licensed roofing contractor have a
manufacturers' representatives schedule with the homeowner to do an independent
inspection as may be needed to obtain the engineer letters requested.
If the roof has not been installed per manufacture's specifications this impacts any
insurance homeowner's insurance reduction that I maybe eligible for as well as any IRS
tax advantage that I may be eligible to receive. Not to mention the fact that it could
create obstacles/difficulty in selling the home in the future.
We look forward to a positive outcome to all issues listed above and would like to
amicably resolve all.

Thanks for you prompt response.
I was not aware until this afternoon that this was a side job for Brett. As today, Brett told my
husband and I that maybe he did not make it clear that the job was a side job for him. We are
not friends with Brett, but I am aware that my son knows Brett from bowling and he inquired if
there was any interest in quoting the job. We were told that RSS was a reputable company in
Orlando and they may be interested in doing the job outside of their market area.
When Brett came to our home to measure he indicated that he would turn the measurements
over to the office and they would run a materia list and then we would receive a quote for the
job.
I saw that all emails received from Brett and Scott Medlin were from Rssflorida.com when
sending over the Notice of Commencement, Building Permit Application and responses
from inquires as to the warranties, license information, business insurance/workman's comp,
etc and that the company could do work in St. Lucie County.
I even inquired about the deposit check making it to RSS and I believe it was you who said to
make it to Brett, but it was to be mailed to the address of RSS.
I pulled information on RSS to be sure they were a valid company, verified the license, etc.
The trucks that were on our property had RSS Roofing Services and Solutions on the sides.
The Notice of Commencement did as well. I questioned the name on the permit as MSG
Legacy Inc and not RSS as shown on the permit application and was told that it was a
subsidiary of the other.
If I recall correctly that was the names on the materials list as well was RSS.
Therefore that is why I addressed my letter and concerns to all parties identified.
I do not think our roof has been done in a professional manner, I do not think it meets the
manufacturer installation specs and the quality of the work is less than acceptable. Brett said
today he did not think the issues would rise to the level of a letter going to the main office.
The roof o is still not complete! and we are told they will ill be back next week to finish. We have
heard this week after week.
We are not sure what to do to get this project completed in a satisfactory manner and to have
the expected quality and appearance of a nice metal standing seam roof. Right now it looks

like a hack job. Brett is very aware of our concerns and the issues. I believe there were
shortcuts taken that were unnecessary.
We are asking for some assistance in getting a resolution to the issues as identified in the

November 10, 2019—Brett ask us for a draw on the job in the amount of$2,500 as the job was taking a
little longer than anticipated and they needed to make payroll to the crew working the job. At that time
things seemed ok,so we agreed.
On Thanksgiving Day,my son was here and went on the roof to look at the work. Yes,based on timeline
for roof completion being 6 days,Friday through Sunday for 2 weekends—the roof should have been
done.However,what was installed was not acceptable. My son did some research on installing the
materials we had purchased and called and spoke with Brett on the phone about the Installation. Brett
made all kinds of excuses,like we are not done with the job yet, panels that were sections had to be that
way because you needed expansion joints,etc. There are/were areas of the roof that had no ice and
weather shield at all. The area above the garage where they began removing the shingles had a big dip
in the metal and was not even with other panels.The roof was literally a hack job. This caused me to
write my letter that was emailed to all parties on 12/1/2019.Copy enclosed in package. In the letter as I
stated an issue,I also gave what I thought was a good solution.
In the interim I contacted the manufacturer of the ice and water shield after reading their installation
instructions indicating that the material must be installed on a clean,dry, smooth surface. I did not
think this included installing over an existing 15-year shingle roof and knowing that we had significant
rain before installation and sometimes while installing. l received an email from manufacturer
confirming their material was not to be installed over shingles and that it would void any and all
warranties. Email from manufacturer included in package.
Brett and crew were back on the job site on December 1,2019(another one of those we will be finished
today visits). Brett indicated to us that he was surprised that the issues had risen to the level of sending
a letter to the main office. We then discussed all our concerns while walking on the property looking at
the roof. I explained that I was not happy with the roof edge and how it was finished that it was very
uneven,did not run in a straight line,was not uniform. Brett's solution was to have his gutter guy who
owed him a favor come and install gutter around the house to eliminate the visual effect of the
unevenness of the drip edge and roof edge. He would do this at no cost as the gutter guy owed him a
favor. I guess his gutter guy had a back log of work and so he took it upon himself to hire a local gutter
guy to price and install gutters,our only involvement was picking a color. The gutters were installed
without our knowledge. Well,the gutters look terrible and when I had Brett walk the property and look
at them,he agreed. He then told me it was a local company"Budget Gutters". He would contact them
to come and fix. As of today,the gutters have not been fixed in fact Brett and Gutter Guy met and the
front gutter was removed and is laying in the front yard.
re-iterated that I wanted an engineering letter from the manufacturer of the metal and the ice and
weather shield,and such letter and warranty should be specific to the property as well as to future
owners. I have received no such letter. Brett arranged for a sales representative from the metal
company to come out and look at the roof. This was done on 12/16/2019. 1 spoke with the
representative and-asked if he would accept the roof as is? He said no that some items needed to be
corrected. I then asked him if our roof required less than full panel sheets or pieced together sheets as
told was need for expansion joints,he said no.
Brett agreed to order replacement panels forthose areas and install. I also asked him about how the
ridge cap had been cut and installed. He said they were incorrect and stayed on site and showed Brett
how to cut and finish them.
