Informational Letter to Applicants for a Variance
BOARD OF COUNTY COMMISSIONERS COMMUNITY DEVELOPMENT DIRECTOR JULIA 5HEWCHUK The Board of Adjustment has the authority to grant variances from the lot size and dimensional requirements of the St. Lucie County Land Development Code. However, pursuant to Section 10.01.02 the Land Development Code, the Board of Adjustment shall no grant a variance unless it makes specific findings of fact based upon the particular evidence presented which supports the standards for granting variances. Accordingly, the applicant for a variance must address the standards as contained -in Section 10.01.02 and addressed in the application form enclosed. At the Board of Adjustment hearing, the applicant should plan to make a presentation which answers.the questions listed on the enclosed sheet entitled "Questions to be Answered by the Applicant for a Variance." Although these same questions are addressed in the application form, it is important that the applicant make a presentation which addresses these questions at the hearing. If the applicant does not provide the Board of Adjustment with sufficient.information to support the standards, pursuant to Section 10.01.02, the Board of Adjustment would be required to deny the request for a variance. How does the variance requested arise from a condition that is unique and peculiar to the land, structures and building involved? 2. What unnecessary hardship, as distinguished from mere inconvenience, would result if the particular provision of the ordinance from which you are seeking a variance was literally enforced? Economic hardship is not sufficient justification. You must demonstrate hardship of another type. 3. Please provide evidence for the Board that this is a condition that is not ordinarily found in the same zoning district. 4. Please provide evidence that this condition was not created by your actions or those of a previous owner, but was created by regulations of the Land Development Code. 5. Verify for the Board that the granting of the variance will not impair or injure other property in the neighborhood. 6. Provide evidence that granting the variance will not impair an adequate supply of light or air to adjacent streets or increase the danger of fire or endanger the public safety. Why won't the granting of this variance diminish or impair property values within the neighborhood? 8. Verify that this is the minimum variance that will make possible the reasonable use of the property involved. 9. Demonstrate that the granting of the variance will not be opposed to the spirit and intent of the Land Development Code or Comprehensive Plan. IMPORTANT NOTE!!!
