The e-mail from Mr. Hinkle is asking for the County to consider his seawall as part of the required fencing per section 8.00.05(A) of the LDC. I have made a site visit to the property and find that the seawall is at least 4" high and meets the requirements of 8.00.05(A) LDC and R450.17.1.14.1 FBC, provided that the fence perpendicular to the seawall extends over the seawall 18" to prevent a young child from climbing over or around to access pool. It is my opinion that that the fence permit as constructed above with existing seawall will satisfy both the 8.00.05(A)LDC and section R4501.17 FBC.
