This contract document represent the entire agreemerd of both parties and supersedes any prior oral or written agreement. Any changes to this Contract must be approved by Sunpro in writing. Sunpro will also complete the Monitoring system if applicable and va assist the Owner with entering into an Interconnect Agreement between Owner and the applicable utility company. OWNER -The Owner veil have no control over or charge of installation means, methods, techniques, sequences, procedures, or for safety precautions and programs in connection with the installation of the System, since these are solely Surip ids responsibility. -Owner is responsible for obtaining any approvals necessary from then Homeowners Association. -Owner wn1) provide access point for Enphase envoy to connect to home in lemet service through a wired connection. This is typically done through the homes muter. Owner will provide WiFI internet access to take advantage of Enphase's monitoring system- - Owner recognizes that Sunpro Solar is not qualified to offer any tax or legal advice. Owner should consult with a CPA or a qualified tax advisor to ensure owner receives any local, slate or federal incentives that fray be available- - Owner acknowledges that the federal incentive for costs associated with qualified solar property is in the form of a nonrefundable TAX CREDIT QINKNOWN CONDITIONS 2d3 Sunpro is not responsible for conditions that are encountered at the installation site which are concealed physical conditions or unknown physical conditions of an unusual mire, which caller naturally from those ordinarily found to exist Sunpro is not responsible for existing electrical service deficiencies that mayor may not be code compliant Existing electrical service components, i ncudmg but not limited to, breaker boxes/panels, disconnects, meters, fuse boxes, wiring, conduit and all other necessary components to energize an existing structure are not the responsibility of Sunpro. At the sole discretion of Sunpro. Sunpro may cancel this Contract due to n any conditions encountered that impact the performance, installation or code requirements of the System's installation, or iiany other conditions that impact the safe and effective installation of the System. ARBITRATION AND LEGAL Any controversy or claim arising out of or relating to this Contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Construction Industry Arbitration Rules, and judgment on the award rendered by the arb-i rator(s) may be entered in any court having jurisdiction thereof. in the event of any arbitration or litigation relating to this Contract, the prevallmg party shall be entitled to reasonable attorney fees, costs and expenses If any amounts due tinder this contract are not paid when due, any such unpaid balances shall be charged irderesi at the rate of 1112 % per month which is an annual percentage rate (APR) of 18 `.b per year.
